Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of December 18, 1986 The public hearings of December 18, 1986 were called to order at 7:42 p.m. Members present were: L. Leske, P. Dunwiddie, C. Borchert, M.J. Williams, W. Willett, D. Visco and L. Dunn. A. Public Hearings 1. Winn, Low and Everett - SE48-383. Michael Bachman was present as the agent. At the request of the agent, Lucy Leske moved to continue the hearing. So voted. 2. Cochran Et Al - SE48-385. John Shugrue was present as the agent. At the request of the agent, Lucy Leske moved to continue the hearing. So voted. 3. Elizabeth McIlvain - SE48-387. John Shugrue was present as the agent. The Co~ission discussed the driveway plan: Peter Dunwiddie stated that the driveway plan is a substantial change from the original intent_of plan, where emphasis was placed on minimizing disturbance of the buffer zone. " Mr. Shugrue stated that the drive is extended around the septic system and will be gravel material. The driveway is 25' to 40' from the edge of the wetland. He admits that brushcutting is too extensive. Shugrue stated that it is the intent of the applicant to slope the driveway away from the wetlands but this is impossible in all areas. The Commission discussed the access road improvements. Plans show improvements but order does not request construction of access before construction of the house. The Commission would like to. tie this into an Orders of Conditions. Thedore Tillotson, attorney stated that the driveway is within 1~' buffer zone. Carl Borchert moved to close the hearing. So voted. 4. Perkins- LaFrance - SE48-386. Bob Emack was present as the agent and submitted plan with parking area on old plan and an alternative plan . ., Town of Nantucket Conserva tion Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of 12/18/86 page 2 where the building is moved towards the back of the lot - within 16-18 feet of the wetland. Parking area is moved between the building and the drive. Lee Dunn asked if that much parking is required and Peter Dunwiddie asked if the garage entrance can be moved. Mr. Emack said that it could not be moved and the only impac~ to the wetland in the new plan would be during construction. SIltation fencing below the house and parking is proposed. Peter Dunwiddie viewed the site and determined the area to be a bona fide wetland. Carl Borchert suggests a permanent fence at the edge of the wetland to prevenL dpplicant from using the buffer zone and wetland in the future. Maryjane Williams moved to continue the hearing for grading and fence designs for the new plan. So voted. 5. Robert Greenhill - John Shugrue was present as the agent and submitted topo map. Carl Borchert moved to continue the hearing for a file number. No other information is requi~ed. So voted. " 6. Harborside Realty Trust - Carl Borchert moved to close the hearing contingent on receiving rile number. Plan calls for replacing existing buildings, step& added to beach, granite pavers on parking lot. Bulkhead reinforced but at the same location. Oil separators are to be used for parking lot runoff. Separators are located 135' - 150' from the beach. The maintence schedule calls forthe separtors to be cleaned four times a year and disposed of by a licensed hazardous waste operator. No fill is proposed. 7. Madaket Bike Path - To"~ of Nantucket - Joseph Magni of VanasseHangen was present as the agent. The Notice of Intent for the six wetland areas that will be affected were reviewed. William Willett motioned to continue the hearing for !..he>.following information: 1. Areas and square yards of fill. 2. Information on moving the road in the area of Crab bridge to minimize the impact of the path. 3. .Information on digging a pond on Frost's property. 4. Philip Notopoulous submitted revised plans in color. Changes: - Deletion of building number 3. - Spillway deleted off Bear Street. -. Parking on old railroad bed deleted. - Retaining walls added at narrow spots where wetland comes up to road. Only two fill areas 130ft. and 350ft. Buffer narrows in several spots within 11', 16', 24', 21', 15'; total of about 300 lineal feet. Stormwater retention area on site of deleted parking lot; 100' storm calculation - organic filtration system; 100% backup system. Adding 11,000 square feet of undeveloped open space to plan. This brings open space to 54% of the total eite (160,000sq. ft.) 8 or 9 parking spaces have been deleted elsewhere to add to undisturbed buffer. Retaining walls are constructed of concrete, maximum height of " 2~ feet, designed to prevent runoff from going directly into wetland. Replication will be only 500 square feet. Siltation fencing will go in on line between green areas and developed areas. Stormwater retention basin at elevation 7~, walled in requires no maintenance. Removes oil through absorption. Water goes thru separators into a pipe into this basin. (Planning Board may require fill up to grade. (2~ maximum height above grade) .... Arlene Wilson now of A.M. Wilson Associate with Daylor Engineering submitted color coded plans. - No leaching facilities in buffer zone. All will be piped into retention basin. - Arlene suggest that bottoms on any leaching facilities should be above groundwater levels. She also suggests to change the location of siltation fence and show reduction of replication area. Peter Dunwiddie suggested that sloping earthen walls be used to basin instead of vertical concrete. The applicant requested that the hearing be closed and Orders of Conditions be issued/ Carl Borchert stated that there is nothing on the plans showing drainage from separators to basins. Lee Dunn stated that he had doubts on writing an Order of Conditions without plans. Carl Borchert outlined possible conditions as follows: - Bond of $100,000 to cover work within wetlands and buffer zone. Checkpoints, certified by professional engineer: 1. Siltation controls in fence 2. Parking lot drainage 3. Building site locations & footings in place. 4. Parking lots and buildings constructed. 5. Prior to Certificate of Compliance - a written contract with licensed hazardous waste hauler. Peter Dunwiddie asked to see the earthen wall ar.ound the retention basin and al~o asked to have the surface area expanded to achieve more wetland like conditions. William Willett moved to continue the hearing. So voted. B. Regular Meeting 1. No approval was given for the minutes of 11/20, 11/25, and 12/4/86 as all have changes. 2. Request for Determination a. Longview Realty Trust - Commission wants lot staked. b. Town of Nantucket, Road Ways - Mr. Joseph Magni of Vanasse/Hangen asked if repairs and maintenance can be done without filing a Notice of Intent. All changes ( widening) will be achieved in existing shoulders, never more than 6 inches of fill. Carl Borchert moved to issue a positive determination but said work will not ~- alter an area subject to protection under the act. D. Visco opposed. All others in favor. So voted. 3. Certificate of Compliance a. J. Daniel Lugosch - SE48-378. The Commission wi,ll hold a field in- spection. . , 4. Orders of Conditions a. Manning - Borchert moved to reissue Orders of Conditions with proper certificate number on front at the next meeting Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of 12/18/86 page 5 b. Edwara Murphy - SE48-382. Lucy Leske motioned to issue standard Orders of Conditions. Willett, Visco, Leske approve, Williams, Borchert, Dunn, Dunwiddie oppose. Carl Borchert says that the septic outflow will pollute saltmarsh. The applicants own engineer admitted last week 'that pathogens and viruses are knm.;r to travel more than 100 feet in sandy soils. Borchert moved to deny the project for the following reasons: 1. Septic system will pollute the saftmarsh, based on testimony at public hearing. 2. Applicant did not address scenic views and wildlife. Dunwiddie, Borchert, Dunn, Williams approve. Visco, Willett, oppose. So voted. Carl Borchert will write Orders with areas significance being: a. Land containing shellfish b. Wildlife c. Scenic Views d. Recreation Leske of i" c. Mary S. Huffman - revision in the certificate number was not understood. No action was taken. 5. Enforcement Order a. Elizabeth McIlvain - SE48-332. John Shugrue was present as the agent. Shugrue stated that the reason for the discrepency in setbacks is that water has risen one foot vertically and 19 feet horizontally, the house is located .in position on plan. Borchert and Dunn stated that water does not rise 19 feet horizontally. Mr. Dunn said that the house was located at the time 35 feet from the marsh - plans were "'rong from the beginnil:g;" Donald Visco moved to remove the enforcement order. So voted. Minutes of this meeting are to be entered into the file to alert future commissioners of the discrepencies between plans and as built . Lucy Leske ~otioned to issue Orders of Conditions adding the following conditions: 1) Revegetate between haybales and wetland. 2) Drive , , ~ Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of 12/18/86 page 6 shall slope away from wetlands. 3) No further work without repairing access rOqd. Lee Dunn abstained from voting. All others in favor. 6. Other Business a. 1987 Budget - Maryjane Williams motioned to approve the 1987 budget. b. Job description - Carl Borchert moved to write a letter to the Personnel Board requesting a Conservation Officer position. c. Town of Nantucket Surfside and Siasconset Sewer request for revised Orders of Conditions - The Commission voted to write a letter requiring the applicant to submit a new Notice of Intent. 7. Orders of Conditions <:. a. Harborside Realty Trust - SE48-390. Lucy Leske moved to issue Orders of Conditions adding: " 1) Contract with licensed hazardous waste handler 2) Granular sand as fill 3) Snow fencing to prevent debris from collecting on beach and water. 4) Bulkhead repairs only 5) Subject to permits required for point discharges ....
