BSC - Appeal on Thomas Hood - SE48-379 '- .... . ., Town of Nantucket, Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of December 4, 1986 The public hearings of December 4, 1986 were called to order at 7:30 p.m. Members present were: Peter Dunwiddie, Carl Borchert, Lucy Leske, William Williett and Donald Visco. Members absent were: Maryjane Williams and Lee Dunn. A. Public Hearings 1. Edward Murphy - SE48-382. Mr. Edward Murphy and his representatives Robert Gray and Mario Digregorio from Sabatia Environmental Planning were present. Revised plans were presented and reviewed. Mr. Murphy has an agreement with abutters to purchase land which would allow him to locate his house 35 feet from the edge of the Marsh. The septic system is being mounded four feet to meet Title V. The first floor elevation is at eleven feet. " Mr. Dunwiddie asked the applicant or his representatives to address the Nantucket By-laws scenic views and wildlife interests. The agent stated that they could not address these interests. Mr. John Roe of the Nantucket Land Council voiced his concern with the project being located in a flood zone A and the possibility of pollution to the Shellfish Beds. The agents agreed that viruses and nitrates travel more than 100 feet in sandy soils. Lucy Leske moved to close the hearing. So voted. 2. Winn, Low, Everett - SE48-383. Michael Bachman was present as the agent. He requested that the hearing be continued for two weeks and requested a copy of the field inspection report. Lucy Leske moved to continue the hearing. So voted. 3. Cochran ET AL - SE48-385. The field inspection report of December 1, 1986 was read. Mr. John Shugre was present as the agent and requested a copy of the field inspection report. Mr. David Gray, one of the applicants, read a statement on why the lot is wet now: . ., ., Town of Nantucket Conservation Commission -. -. Town and County Building Nantucket, Massachusetts 02554 Minutes of December 4, 86 page 2 1) every lot on North Beach Street has been filled except theirs. There was never water before the others were filled. 2) The North Beach Street storm drain do not function as they should and therefore water can not drain off their property. 3) The abbutters who own the tennis courts dug a drainage ditch which emptys on to their property. Mr. Gray requested that the Commission continue the hearing. Mr. Borchert pointed out that the Commission must be blind to whate the site might have been at one time and only consider what condition it was found to be at the field inspection. Carl Borchert moved to continue the hearing. So voted. 4. Mary S. Huffman - SE48-384. The Commission discussed the issue of a splid foundation on shifting sand on. the site and determined that this was not a problem for this site.. Lucy Leske moved to close the hearing. So voted. 5. Elizabeth McIlvain - SE48-387. Lucy Leske moved to continue the hearing ,- for a field inspection scheduled for }1onday the 8th of December. So voted. 6. Perkins - LaFrance - SE48-386. Bob Emack was present as the agent. He described the lot as being isolated land subject to flooding. The house is located 20 feet from the edge of a wetland. The retaining wall meets grade at five feet. There was discussion about the location of the driveway being switched with the location of the house to minimize disturbance caused by traffic. Carl Borchert moved to continue the hearing for more infprmation (i.e. driveway plans, and alternative layout plan). So voted. .... 7. Robert Greenhill - John Shugrue was present as the agent. The minutes of November 20 and November 25, 1986 were submitted to the Commission for review. No action was taken on them. 2. Request for Determination a. Longview Realty Trust - The Commission requested that one lo.t line be brush cut for a field inspection 3. Certificate of Compliance a. Robert Elliott - SE48-361. The field inspection report of December 1, 1986 found that rose bushes had been planted. The Commission voted to advise Mr. Elliott that this did not constitute natural vegetation. 4. Orders of Conditions i" a. Nantucket Commons Trust - SE48-365. Lucy Leske read her draft for reasons of denial of this project. Mr. Theodore Tillotson attorney for the applicant requested that the Commission vote to reconsider the denial and then vote to reopen the hearing so that the applicant can submitt revised plans. A draft copy of revised plans showing more of an undisturbed buffer and an organic system that would handle a 100 year storm runoff was submitted. .... William Willett~oved to reconsider the vote of denial form last meeting. All were in favor. So voted. Lucy Leske moved to reopen the hearings on December 18, 1986 at the request of the applicant and to advertise the reopening on December 11, 1986. So voted. .J . b. Mary S. Huffman - Lucy Leske moved to issue Orders of Conditions adding a no coastal revetment clause. So voted. There being no further business the meeting was adjourned at 9:45 p.m.
