Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of September 25, 1986 The public hearings of the Nantucket Conservation Commission were called to order at 7:30 p.m. Members present were: Peter Dunwiddie, Carl Borchert, Lee Dunn, Maryjane Williams and William Willet. Members absent were Donald Visco and Lucy Leske. A. Public Hearings 1. John Kessler - Carl Borchert moved to continue the hearing for a file number to be issued by DEQE. SO voted. 2. Michael Sparrough - SE48-371. - Maryjane Williams moved to close the hearing. So voted. 3. Nantucket Commons Trust - SE48-365. The field inspection that was conducted on Wednesday, September 24, 1986 was discussed. The Commission voiced their concerns with the discrepency in the flagged building sites proximity to the wetlands and the proximity stated in the plans. Mr. Sarvis stated that the buildings will be 15' away from the wetlands as shown on the plans and not as the rough flagging indicated. Mr. Marcus of IEP noted that they are revising plans to show that the narrow peninsula area which that had planned to use for replication will now be left alone and replacement will now be in the grassy field area. Mr. Notopoulas stated that the proposed grass crete paving system had been dropped at the advise of the Planning Boards engineers (Vanasse/ Hangen). Plans will now show parking areas to be macadam except in the peninsula area which subject to approval of the Planning Board will remain grass crete. The applicant feels that with the nine oil seperators and 19 dry wells they will adequately protect the interests without the use of grass pavers. Mr. Marcus reviewed page six of his letter of September 9, 1986 regarding compliance with Wetlands Regulation 310 CMR 10.57 (4) (b). Mr. Borchert questioned the five and 100 year storm runoff going into the wetlands. Mr. Marcus stated that due to the use of oil seperators the runoff will be free of pollution. Mr. James Hall of IEP reviewed the operation of the oil seperators. The Commission asked for an engineers report of the performance of oil seperators and a report regarding "first flush". Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of 9/25/86 page 2 Mr. Marcus brought up Hatch's as being in such close proximity to the Wetlands with runoff from oil and gas going into wetlands without seeming to adversly affecting them. The Commons project is using much more of a buffer than this project. Lee Dunn asked if there was an engineering design that would eliminate all 100 year runoff volume from going into the wetlands. Mr. Hall stated that a detention basin could be designed to do that but they have tryed to keep the hydrology of the wetlands the same, leaching facilities would have to be increased to do this. Mr. Borchert voiced his concerns about the amount of oil on the site determined by Mr. Hall. Borchert feels that by his calculations there will be ten times the amount. Mr. Marcus discussed the use of buffers in other Cape towns and Harland Dolingers recomendation that any buffer should be related to the wildlife species using the wetland. Buffers of 15' of trees or shrubs being better than 50' of grass. The Commission discussed the responsibility of maintenance of the project with respect to the Condo Association. The Commission requested that the applicant submit a copy of the proposed schedule of maintenance stating Conservation Commission's rights for enforcement of the maintenance. Mr. Larry Spalding (attorney for Marine Home Center and Sherburne Associates) was present. He introduced Arlene Wilson of BSC. Ms. Wilson submitted a letter dated September 25, 1986. Ms. Wilson reviewed her conclusions about the project and recommendations to the Commission noted in her letter. There was discussion about the leaching catch basins shown on the plans. Mr. Hall stated that these plans are incorrect as the leaching basins are closed bottom not open. Mr. John Roe of the Nantucket Land Council was present and submitted his letter dated September 25, 1986 along with a Summa~Y:r of Ground Water Levels of July, 1986, and Mr. John Sevie's letter of September 24, 1986. Mr. Roe reviewed these letters with the Commission. Mr. Bose' and Mr. Oats were present to voice their support for the dedication shown by the Commission members. Mr. Borchert wanted to clear up the difference of definition that the Conservation Commission and the applicant have for the type of wetlands on the site. Carl defines these as bordering wetlands and not isolated wetlands. Mr. Marcus feels that the new wildlife by law covers only what happens in the wetland and not the buffer zone. John Roe stated that when you interfere with the borders, that changes the makeup of the wetlands. Lee Dunn voiced his concerns with the applicants proposed 4' to 15' setbacks. Lee feels that the applicant should be more along the line of a 25 feet buffer to protect the wetlands from any possible accidents that are bound to happen. Maryjane Williams moved to continue the hearing for the following infor- mation to be submitted by the applicant: 1. A Compenstory flood level study for 100 year storm. 2. Report on "First Flush" 3. A Cross Section of the site showing slopes. 4. The five year storm volume 5. EPA document on oil and gas 6. A site specific soil and ground water determination study. 7. A draft of the Condo Association maintenance schedule So voted. B. Regular Meeting 1. Lee Dunn moved to approve the minutes of August 28, 1986 and September 11, 1986 as written. So voted. 2. Certificate of Compliance a. Jospeh Teelier - SE48-307. The Commission signed the Certificate. Carl Borchert moved to issue Orders of Conditions adding that hay bales shall be placed within 10 feet from the pond side of the house. So voted. 4. Other Business a. Gardner Enforcement Order - Carl Borchert moved to recind issuing an enforcement order and to request Frank and James Powers to attend the meeting of October 9, 1986. So voted. b. Robert Elliott - SE48-361. - The Commission signed revised Orders of Conditions showing the closing date of the hearing as August 14,86 instead of July 31, 1986 c. Harvey B. Matthews - SE48-300. Mr. Glenn Wills was present as the agent. He requested the Commission to determine whether the proposed building and septic system relocation was a significant change and requiring a new Notice of Intent. Carl Borchert moved to write the agent stating that the proposed change is not significant and therefore does not require the filing of a new Notice of Intent. So voted. d. Warrens Landing - The Commission extended their thanks to Mr. Willet for getting Mr. Watts to start the burning at Warren's Landing. e. Board of Selectmen - Peter Dunwiddie moved to send a copy of mosquito control techniques to the Board. So voted. 5. Correspondence a. Julia A McCrights letter requesting consideration on job opportunities was read. The Commission voted to make her application part of the personel file. for consideration when a job arrises. b. Peter Coffin's letter of September 17, 1986 regarding erosion control Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of 9/25/86 page 5 on Sankaty Bluff was read. The Commission scheduled a field inspection for Monday the 28th to view the site. c. Martha Wells letter of September 10, 1986 regarding the rare heathland species on her lots was read. There being no further business the meeting was adjourned at 11:00 p.m.
