Minutes of July 31, 1986
The public hearings of July 31, 1986 were called to order at 7:30 p.m.
Members present were: Peter Dunwiddie, Lee Dunn, Carl Borchert, William Willet,
Maryjane Williams, Lucy Leske and Donald Visco.
A. Public Hearings
1. Madaket Realty Trust - Oakland Street. Lucy Leske moved to continue the
hearing for a file number to be issued by DEQE. SO voted.
2. Ken Cross and Joan Barr - SE48-360 - Crows Nest Way. Glenn Wills was
present as the agent and reviewed the easement agreement between the
applicants and their abutters concearning a joint well. L. Leske moved
to close the hearing. So voted.
3. Robert Elliott - SE48-361 - Elliott's Way. Glenn Wills was present as the
agent. Peter Dunwiddie read Nikki and Allan Toole's letter of July 23, 1986
expressing their opposition to the retaining wall. Mr. Wills reviewed
exhibi t IIAII of the Notice of Intent. Carl Borchert moved to continue the
hearing for more information from the applicant. The commission requested
a cross sectiQn of the portion of the wall near the bank and plans showin~
the deadman to be used. So voted.
4. Thomas Barrows - Cambridge and Tennessee Ave. L. Leske moved to continue
the hearing for a file numbert to be issued from DEQE. SO voted.
5. Stephen McMaster - 26 Western Ave. Bob Emack was present as the agent.
The field inspection report of July 28, 1986 was read. The field inspection
team defined this location as a secondary dune and felt that the area
was unstable and the house location was too close to a coastal bank.
Mr. Emack feels that the only wetland interest applicable to this project
is erosion and the applicant plans to vegetate the area with beach grass.
The commission requested to see plans of what the applicant proposes to
build on the site with cross sections, elevations, foundation plans, decks,
etc. Mr. Emack however is only requesting a footprint in which to work in.
The Commission requested that the project be located no closer than 15'
from the top of the bank and requested that the agent bring in a North/
South cross section of the bank to find out what type of soils are under
the house. Donald Visco moved to continue the hearing. So voted.

6. Granger Frost - 80 Madaket Road. Mr. Frost was present. The field
inspection report of July 28, 1986 was read. The inspection team
felt that the project would be beneficial for flood control and wildlife.
The Commission requested that Mr. Frost use the natural spoils from the
area mixed with rye seed to revegitate initially and then to allow the
natural vegetation to grow back. Maryjane Williams moved to continue
the hearing for a file number to be issued by DEQE. SO voted.
B. Regular Meeting
1. Lucy Leske moved to accept the minutes of July 17, 1986 with the following
correction: Under (D) Other Business should read, L. Leske moved to
inquirer about hireing Gregor McGregor. So voted.
2. Requests for Determination
a. Peter Dooley - Polliwog Pond Road. L. Leske moved to issue a negative
determination stating the work described is within the Buffer Zone
but will not alter an area subject to protection under the act. So voted
3. Orders of Condition
a. Bruce Killen - SE48-359. Donald Visco moved to issue orders of conditions
adding these additional conditions written by Lucy Leske: (1) A minimum
10 ft. border of native shrub species shall be maintained around the
perimeter of the wetlands. (2) There shall be no construction of any
kind within 12 ft. of the wetlands. (3) Driveway and parking area design
shall direct runoff in such a manner as to prevent siltation of the
wetlands and erosion of the bank (4) During construction, a line of
staked hay bales and/ or snow fence shall be installed on the house side
of the natural vegetation border. (5) Final plans of the house and
attached construction shall be submitted to the Commission before any
construction takes place. So voted.
4. Certificate of Compliance
a. Norma Minstrell - SE48-349. Carl Borchert moved to issue the
Certificate of Compliance. So voted.

5. Other Business
a. John Kessler - Wan om a Way. Mr. David Moretti was present as the
agent, his letter of July 31, 1986 requesting an extention of
time to make a complete filing of a Notice of Intent was read.
The commission granted a two week extention but reminded Mr.
Moretti that the enforcement order states that the existing
stairway be removed.
b. Marie Schnetzler - SE48-90. The commission signed an enforcement
order requesting a Notice of Intent for work done in violation
of Orders of Conditions SE48-90.
c. Committee Appointments - The following additions were made to the
Commissions Committees: (1) Wetlands - Lee Dunn. (2) Land Management
- Carl Borchert. (3) Land Acquisition - Donald Visco. (4) Planning -
Lee Dunn. (5) Education - William Willett. (6) Wildlife - William
Willett.
d. Harvey B. Matthews - SE48-300. Glenn Wills was present as the
agent to request a change in location of a well without filing
a new Notice of Intent. L. Leske moved to allow the change without
filing as long as the applicant does not use anything larger than
a ditch witch to minimize disturbance of the area. So voted.
e. Gary Winn - Sam Stark - SE48-272. John Shugrue was present as the
agent to request a change in location of the proposed house,
without filing a new Notice of Intent. Carl Borchert moved to
require the filing of a new Notice of Intent as he feels the change
is substantial as more fill is needed and the proposed change
involves the expansion of the septic system. L. Leske and D. Visco
opposed. So voted.
f. The commission requested that copies of National Fisherman's August
publication reporting on Salt Ponds be purchased for the office
along with copies of MCZM's publication titled: Salt Pond and Tidal
Inlets.
There being no further business the meeting was adjourned at 9:30 p.m.
