Minutes of July 17, 1986
The public hearings of July 17, 1986 were called to order at 7:30 p.m.
Members present were: Peter Dunwiddie, Carl Borchert, Lucy Leske, and
William Willet. Members absent were: Maryjane Williams, Lee Dunn and
Donald Visco.
A. Public Hearings
1. Madaket Realty Trust - Oakland Street,Madaket. Carl Borchert moved
to continue the hearing as DEQE has requested that the applicant
submit plans with wetland delineations befor a file number is issued.
So voted.
2. Ken Cross and Joan Barr - 17 & 19 Crows Nest Way. Glenn Wills was
present as the agent. An easment document for well rights that has
been recorded on the deed was presented and made part of the file.
L. Leske moved to continue the hearing for a file number to be issued
by DEQE. SO voted.
3. Bruce Killen - SE48-359 - 67 Cliff Road. Glenn Wills was present as
the agent. A picture of the lot showing the pond was submitted by
Donna Cuzins. The commission wants to review Sherburne Associates
file, number SE48-277, to review their policy on minimum set back
allowances when building near an inland wetland. L. Leske moved to
close the hearing. So voted.
4. Robert Elliott - Elliotts Way. Glenn Wills was present as the agent.
Mr. Wills reviewed Exhibit "A" of the Notice of Intent with the
Commission. Mr. Murray Freedman and Mr. Curtis Barnes were present
to state their opposition to the project as they feel that the
erosion problem due to runoff was minimal befor the construction of
the retaining wall and therefore the wall is unecessary. L. Leske
moved to continue the hearing for a file number to be issued by DEQE
and approved plans from the Nantucket Historic District. So voted.
5. Thomas Barrows - Cambridge and Tennessee Ave. Warren Linds~y was
present as the agent. The project is a laundry shed which will be
built on wood piers and plumbing will be connected to the existing
house. Little excavation will be done near the kitchen. Carl Borchert
moved to continue the hearing for a file number<.to be issued form
DEQE. SO voted.

B. Regular Meeting
1. The minutes of July 3, 1986 were approved as written.
2. Planning Board Referral
a. Deccorfano & Solmando - 80 Washington Street (Christman Cottages).
Carl Borchert moved to advise the Board that the area is subject
to protection under the act. So voted.
3. Extention Permit
a. Marie Schnetzler - SE48-90. L. Leske moved to issue an extention
permit for a period of three years. So voted.
4. Other Business
a. John Kessler - Mr. Kessler responded to an enforcement order, issued
by the commission regarding a stairway, by requesting a two week
extention for filing a Notice of Intent. Carl Borchert moved to
extend the filing date to July 31, 1986. So voted.
b. Marie Schnetzler - During a field inspection requested by the
applicant, the Commission found a violation of Orders of Conditions
on the property. A cut was made into a hillside and a retaining wall
was constructed, both were not part of the original Notice of Intent.
The commission felt that the hillside between the dunes and fresh
water marsh were unstable. Natural drainage patterns are disrupted
and a serious erosion problem exists.
Lucy Leske moved to issue and Enforcement Order stating that: (1)
The property owner, his agents, permittees and all otehrs shall
immediately cease and desist from further activity affecting the
wetland portion of this property (2) Completed application forms
and plans shall be filed with the Commission on or before July
31, 1986. (3). The property owner shall take every reasonalbe
step to prevent further violations of the Act, and the property
owner should be preapred to remove some part or all of the work
in question.

c. Lorretta Lane - In response to a phone call from Mr. John Johnson
reporting the use of a pathway off Loretta Lane thru a marsh, the
Conservation Commission made a field inspection on July 14, 1986.
The field inspection was read and the commission voted to advise
the property owner, Mr. Gene Mahon of Loretta Lane that the con-
struction of a spit rail fence would be appropriate for preventing
unwanted vehicles from trespassing and from damaging the marsh
further. A copy of a letter stating this will be sent to Mr. John
Johnson. So voted.
d. Rent-an-Expert. L. Leske moved to order a set of sample Mass.
communities wetlands by-laws and to hire Mr. Gregor McGregor from
MACC to speak on the subject of how to write, pass and implement
local by-laws. So voted.
e. Examples of job descriptions for the position of a full time
Conservation Admistrator from other communities were given to
Commission members for their review befor nomination members to
a committee for the purpose of implementing such a position for
Nantucket.
5. Correspondence
a. Arthur W. Grellier - C. Borchert moved to have Peter Dunwiddie
send a letter on techniques of cattail removal to Mr. Grellier
in response to his letter of July 9, 1986 regarding cattails in
White Goose Cove, Long Pond. So voted.
b. An example oth the Town of Falmouth's "Guide to the Wetland
Protection Act" was presented to the commission. The education
Committee is to use this as a guide in revising the Nantucket
Guide.
c. The minutes of the Nantucket Historic Districts meeting of July 1,
1986 regarding Mr. Robert Elliotts retaining wall were submitted
to the Commission and made part of that file.
d. Mr. Carl Borchert volunteered to meet Elizabeth Kouloheras of
DEQE on Monday, July 21, 1986 for a field inspection on Catherine
Conover's property for a request of Certificate of Compliance.

6. Field Inspections - were scheduled for Monday, July 28, 1986 at 3:00 p.m.
to view Stephen McMaster - 26 Western Ave. and Granger Frost - 80
Madaket Road.
There being no further business the meeting was adjourned at 9:30 p.m.
