Minutes of May 8, 1986
The public hearings of May 8, 1986 were called to order at 7:30 p.m.
Members present were: M. Arnold, L. Dunn, L. Leske, P. Dunwiddie, D. Visco
and P. Waine. Members absent were: M.J. Williams.
A. Public Hearings
1. Richard Kotalac - Miacomet - The hearing was continued for a file
number to be issued from DEQE.
2. Leonard Sherman - SE48-335, Squam Road. P. Waine moved to continue
the hearing and to get in touch with John Shugrue to ask if
definative plans have been completed.
3. Nantucket Airport Commission - SE48-349 - Nantucket Shipyard.
Joseph
Forns was present as the agent.
Mr. Forns requested that the commission define this project
as an emergency so that the Chapter 91 License could be
issued as soon as possible. The commission voted not to
consider this an emergency situation under the Wetlands
Protection Act.
The commission was concearned that there was not a spill
contingency plan to review and that plans that were submitted
for the design of the project were not stamped by an engineer.
Mr. Forns assured the commission that a letter of adequacy
from the Captain of the Port of Providence U.S.C.G. would be
filed with the commission before construction began and that
this report would contain all the final plans of design and
method of construction along with a spill contingency plan.
The commission was also concearned with how temporary the
structure really would be and the need to have reviews of the
project periodically to assure that this method of fuel
transportation should continue. The durability of the system
was addressed and suggestions were made from Prentice Clauflin
and Peter Kaizer to have the structure removed during the winter
months.
4. Earle M. Craig Jr. - Kimball Ave. - Leon Sherburne Jr., the agent for
the applicant requested that the commission continue the hearing
until the fall of 1986 as new plans for construction and location

will be submitted at that time. The commission voted to have
Mr. Sherburne to withdraw his Notice of Intent and to file a
new Notice of Intent at a later date.
5. Commonwealth of Massachusetts - Madaket Boat Ramp - The commission
voted to continue the hearing for a file number to be issued from
DEQE.
6. Stephen Karp - SE48-348. The project is located at Shimmo Point
in Madaket. The project calls for a 4' by 222' pier. David
Anderson from Braman Engineering Company was present as the agent.
- L. Dunn asked Mr. Anderson if the pier is considered to
be on public land and if the public will have access to
the pier. Douglas Cameron also from Braman Engineering
addressed this question stating that only abbutters to the
beach may construct piers and the piers may only be
constructed so that the public will have access under the
pier but the pier itself is only for private use.
The commission asked the agent to address the issue of
scenic views. Mr. Anderson stated that there are many
piers in the area and Mr. Karp's neighbor has a pier which
is 145 feet longer than this proposed pier.
The commission asked Mr. Anderson if a shellfish inventory
had been done. Mr. Anderson stated that one had not been
done as the project did not call for any dredging.
Diane Coombs was present representing the Shellfish Advisory
Board raised six issues on why SHAB feels the project
should be denied.
(1) This area had the highest yield of scallop seed last year.
(2) Nantucket is one of the few areas ehere scallops are free
of MPX disease and the seeds in this area could be critical
for restocking other areas that have been killed by the
disease.
(3) The pier will effect the growth of Eel grass in the area
which is critical for the scallop beds.
(4) The length of the pier will not allow enough room for
fishing boats to manuver between the two piers for towing
of scallop dredges.
(5) This area is very popular for family scalloping as the
water is only 5 ft. deep. The pier will interfere with
this activity.
(6) The pier will be subject to damage by ice movements in
the winter months.

L. Leske moved to close the public hearing. So voted.
7. Norma Minstrell - 50 Tennessee Ave. - The field inspection team
advised that the project should be allowed as planned. P. Dunwiddie
moved to continue the hearing for a file number from DEQE. SO voted
B. Regular Meeting
1. The commission voted to approve the minutes of April 24, 1986 with
a correction under Other Business. The minutes should read: A private
individual filled a culvert without any public hearings to determine
whether the work was exempt from the Wetlands Protection Act. L. Dunn
is to call Toscana Corporation,as they did the work, and find out who
the owners of the land are.
2. Extention Permits
a. Andrea Dodds - Gallanter - SE48-148. L. Leske moved to issue a final
three year extention permit. P. Dunwiddie and P. Waine opposed the
extention. So voted.
3. Orders of Conditions
a. Ken Cross and Joan Barr - SE48-347. P. Waine moved to issue Orders
of Conditions adding (1) A complete foundation plan with elevations
shall be presented to the Commission for review before construction
begins. (2) All building materials shall be stockpiled in the area
to be used for the septic system or the area designated for the
parking area. (3) When constructing the foundation as little vege-
tation is to be disturbed as possible; preferably only the area
where the piles are actually installed.
b. Nantucket Airport Commission - SE48-349 - D. Visco moved to issue
Orders of Conditions adding: (1) This Order of Conditions is subject
to review by the Commission on November 1, 1986 and anytime thereafter
in order to determine if this temporary method of fuel transfer should
continue. (2) Before construction begins a letter of adequacy from the
Captain of the Port of Providence U.S.C.G. will be filed with the
Commission. (3) Stamped plans must be submitted to the commission by
May 30, 1986. Lee Dunn & P. Dunwiddie opposed. So voted.

4. Requests for Determination
a. Robert Webb - Low Beach Street, Siasconset. L. Dunn moved to issue
a positive determination stating that the area described in the
request is an area subject to protection under the act. Therefore
any work in the area requires the filing of a Notice of Intent.
b. Carl Gewirz - Chicago Street, Madaket - P. Dunwiddie moved to issue
a positive determination stating that all areas within 100 feet of the
line drqwn on the plan on file with the applicants Request for
Determination is subject to protection under the act, therefore
any work to be done in that area requires the filing of a Notice of
Intent.
c. Katherine Nerrie - Caroline Way, Cisco - The applicant has not
staked the area as yet so no determination was made.
d. Harold Cohen - Top Gale Lane. Lee Dunn moved to issue a negative
determination stating the work described in the request is within
a Buffer Zone, but will not alter an area subject to protection
under the act. Therefore said work does not require the filing of
a Notice of Intent.
5. Certificates of Compliance
a. Norma Minstrell - SE48-54. The commission voted to issue a
Certificate of Compliance.

b. Easton Management - SE48~. The commission voted to issue a
Certificate of Compliance.
c. Stuart Steele - SE48-273. The commission voted to advise the
applicant that the project is in violation to the Orders of Conditions.
The first floor elevations appear to be lower than plans show and
therefore the elevation of the proposed deck shown in the plans would
require the leveling of the dune in front of it.

6. Other Business
a. Culvert at Crooked Lane, Madaket. Lee Dunn moved to have P. Dunwiddie
send an enforcement order to Longview Realty Trust stating that the
filling of the culvert was conducted without a valid Order of Conditions
therefore wetland alterations resulting from said activity shall
be corrected and the site returned to its original condition.
There being no further business the meeting was adjourned at 11:00 p.m.
