Nantucket Wetlands Regulations Draft. Peter Dunwiddie reperted on a recent ccJDversation with Town CO"l,nsel DeRensis, who is continuing to revise the regulations. Carl Borchert brought out 2 points of concern and cited a sense of urgency in passing the new regulations. He felt the ,,,'hole process was taking longer than originally planned. He ;:.poke on verbal and written testimony about 1) \vater quality iit Gibbs Pond and the cranberry bogs not being drinking water quality, as reported by Russell Lawton, and 2) the irrigation po~d at Bart:!.ett 's F,s.rm may be 1es:::. than drinl::ing water quality, as reported by Phil Ba:r:.tlett. Carl thought these COmITlEmts should be brought to the attention of the Health Agent 2nd looked int:.o. Aileen Barth was present as agent for the applicant and explained she never received the notice from DEQE stating the application submitted to them had been incomplete. She agreed to come in and get a copy from the Commission office. It was suggested that a standard Order of Conditions be issued eventually. Bill Willet moved to centinue the hearing for a DEQE file nu~ber. So voted. 3. Dcoley Family Trust - SElJ-8-i,;,!,j,7 - 13 Polliwog Pond Road. Glen Wills of Nantucke~ Surveyors was present as agent for the applicant. Lee Dunn moved to close the hearing, ~entiening the plan dated October 11, 1987 should be cited in the Order or Cc)nditions. So voted. ~. John Mark - SE4:8-~~3 - 28 & 30 Gosnold Road. Tina Coughanour of IE? and John Shugrue were present as agents for the applicant. Ms. Coughanour concurred with Mickey Marcus' site assessment saying there was less than 50% coverage or facultative wetland species present on the lot. There was extens~ve discussion and disagreement over when ~he site assessment "las made (September) and the amount of Ser.si tive Fern present. Bill Willet moved to continue the hearing for more information. So voted. 6. Nantucket Commons Trust - SE~8-~49 - Pleasant, Dave, Orange and Bear Streets. Attorney Ted Tillotson was present as agent for the applicant. Henry Wasierski cited several possible violations in another portion of the project where siltation from the road was washing into the wetland. Henry felt an Enforcement Order was needed. J'v1r. Peter Dunwiddie read the results or the field inspection which suggested the proposed driveway would have a strong negative impact on the wetland. IvIT'. Henry Wasierski pointed out that there were no utilit.y plans presented. Hr. Emerson said they Hould all be below ground and would have no negative impact. He asked Mr. Shugrue to draw in an explicit location for a snowrence'line and submit a vlritten transcription of the grading activities. The general feeling was that the plan would greatly improve the let. Henry Wasierski moved to close the hearing. So voted. 9. James Driscoll - One Osprey Road. Tina Coughanour of lEP was present \.Jit.h LTames Driscoll. Ms. Coughanour believed the sept.ic was outside the Commission! s jurisdiction at 130 f-t. from tt-.e nearest wetland. Peter Durn.,riddie offered 3 years! worth of his own data on the relationship of pond water level to ground water level and suggested that even at the new location ~he sep~ic may flood. When the Order of Conditions is issued on the project, Peter wanted his data to be made available to Heath Agent Richard Ray. With regards to the bulkhead. Ms. Coughanour argued the site was of miner significance to storm damage and flood control, that erosion rates are less than 1 ft. per year and the sandy area ca~e about due to 20 years' worth of grazing by domestic geese. There was discussion relative to a I=rior filing in the nar:lE: of Mc..bbs. Ms. Coughanour felt the bulkhead could }:,e permit.tea based on non-significance. Dupont - Codfish Park Road. ,John Shugrue was present as agent for the applicant and was working on a plan with ~he deck draKl1 in. The extent of high water levels was dlscu5sed. Bill Wille~ moved to continue the hearing for a DEOE file number. So voted. 11. Elizabeth McIlvain - Millbrook Road. Mark Avery of Design Associates was present as agent for the applicant and described the new deck plan, now 12 ft. wide. The overall size or the deck was smaller than before, but was just as close to the ,>Jet 1 an 1:1 . Peter Dum.,riddie said from a recent conversation y.,1i th fI'Irs. McIlvain, he had expected a smaller deck design and some visual screening using vegetation shielding the view from nearby Sanford Farm. Mr. Avery felt this design vJaS a good att.empt at a compromise that did protect the vegeta~ion. While on a recent field inspection, it was discovered the haybales originally required during the driveway construction had actually been used as retaining walls with the driveway built up to the tops of them. Peter DUl1i..riddie asked Mr. Avery to address the problem with the McIlvains, o~herwise an Enforcement Order would be issued. Peter Dunwiddie described an area which had been stripped of vegetation which seemed to consitute a violation of the Order of Conditions. The extent of the grading was discussed. Mr. Wills said the grading had been done along a line of stakes delineating the wetland. There was a discrepancy over which plan had been appr::Ned and \-lhether it had beell stamf,ec1 and signed by an engineer. It was ~entiened that the Order of Conditions had expired under the Tow~ Bylaw in August 1987. Carl Borchert said the local regulations contain a prOV1SlC}~ which overrides the 1 year limit in the Bylaw.
