Members present.: Peter W. Dunwiddie - Chairman, Lee Dunn, William Willet, Lucy Leske, Donald Visco, Carl Borchert and Henry Wasierski. Members absent: none. A. PUBLIC HEARINGS 1. Harold E. Booker, Jr. - SE48-420 - 22 Folger Ave., Surfside. Robert Emack of Nantucket Surveyors was present as agent for the applicant and presented revised plans of the leaching trenches. The trenches are to be located 70 - 75 feet from the vegetated wetland and a good deal further away from the actual pond. Mr. Emack stated there '\-lould be 6 feet to what he had perc-tested as grolmdwater, and that the septic system '\-lould not be mounded, but would have a pw~ping system now. Peter Dunwiddie and Lee Dunn felt this represented an excellent response to the Commission's request for redesigning the sept.ic system and used conservative values. Lee moved to close the hearing. Jeffrey Blackwell of Hart-Blad:.:well Assoc. and Tina Coughanour of IE:? were present as agents for the applicant. Ms. Coughanour explained why she considered this Isolated Land Subject to Flooding and did not foresee any problems with high water because it eventually equilibrates in the area. Town of Nantucket DPW - SE48-427 - Madaket Ditch/No. Head of Long Pond. Greg Bakos of Vanasse Hangen Brustlin was present as agent for the applicant. Mr. Bakos had spoken with Bud Clute about removing some cattails in the area. The Town is investigating its rights to remove them, such a project is not connected directly with this application and would require a separate filing. Carl Borchert added the Commission may have some money in its budget to contribute to the work. Peter Dunwiddie's concerns with water flow and salinity changes had been satisfied by speaking with local landowners in the area. Henry Wasierski asked about moving the large pipe now sitting in the parking lot at the first bridge. ~IT. Bakos said he would look into removing it. Henry felt future work by Wannacomet Water Co. in the area should take advantage of the siltation barriers of this project. Donald Visco moved to close the hearing. So voted. 5. John 1'1. Eaton - SE48-429 - 6 Squam Road. Glen Wills of Nantucket Surveyors was present as agent for the applicant. The results of the field inspection were read and the opinion of the inspection team included consideration of wetland scenic views. Mr. Wills described proposed renovation of the old fieldstone foundation and new addition, said the closest distance to the wetland would be 62 feet and drainage would be away from the wetland. Mr. v-Jills also stated the height of the structures would not be any higher than any existing dwellings in the neighborhood. Some consideration was being given to abandoning the existing septic system and moving the existing well east of its present location. Carl Borchert thought the COffi'Tlission should require it to be moved an~~ay if it's old and unstable. Peter Dunwiddie wanted specifics on the septic location and heights of the dwellings. Lucy Leske wanted to know about the Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of September 24, 1987 Page 3 wildlife characteristics of the area. Peter said Spotted Turtles occur in that marsh, a species rare on Nantucket. Mr. Wills claimed no wildlife habitat would be disturbed or taken away and that there was a good buffer now. Lucy Leske moved to continue the hearing until the October 1, 1987 meeting for elevation information. So voted. 6. Barry Lehman - SE48-430 - Salt Marsh Road. Glen Wills of Nantucket Surveyors was present as agent for the applicant. The results of the field inspection were read. Mr. Wills described the HDC-approved dwelling which he claimed conforms to the landscape. The applicant may eventually wish to enter the wetland to clear out some non-organic debris. Lucy Leske moved to close the hearing. So voted. 7. Herbert Goldsmith - SE48-431 - 24 Grove Lane. Glen Wills of Nantucket Surveyors was present as agent for the applicant. The results of the field inspection were read. There Has some discussion about extending the siltation fencing along the west side of the lawn. Lee Dunn moved to close the hearing. So voted. 8. Alfred A. Lane - SE48-432 - Lot 74, West Chester Street. Glen Wills of Nantucket Surveyors was present as agent for the applicant. The results of the field inspection were read. Mr. h7ill s stated the house will be 45 feet away from the Isolated Wetland subject to flooding, all utilities will be underground and the topography is such that all drainage will be away from the wetland. Lucy Leske moved to close the hearing. So voted. 9. Sherburne Associates - Boat Basin/Easton Street. John Shugrue was present as agent for the applicant and elaborated on the field inspection for the project to dredge and resheet the entire marina and area by the White Elephant. Mr. Shugrue said they would be transported by barge to Cleveland Ledge in Buzzard's Bay. Peter Dunwiddie felt it was appropriate for the Commission to ask advice from the Shellfish Advisory Board. Donald Visco thought it was appropriate to ask SHAB's opinion, but he basically had no problem with the dredging since all spoils were to be deposited on IJDfr. ~~ ~l..~~~ ~ In response to further questions, Mr. Shugrue said only some rods will be replaced as necessary and the project may take up to 3 winters to complete so as to not interrupt the profitable SUITm1er seasons. He described proposed maintenance '\~ork on the bulkhead. Peter Dunwiddie thought the estimate of 1500 - 2000 sq. ft. to be filled in the harbor should be more specific. Lucy pointed out that a waterways license and Army Corps of Engineers license would be necessary. Peter and Henry Wasierski thought the plans should show the bulge near the old granary. Carl Borchert felt the building where the Water Club used to be needs some attention soon. Ted Tillotson speaking as a private citizen felt the applicant should provide much more detail ensuring there will be no adverse effects on the harbor. He cited the high algae counts in the upper harbor that Pocomo residents had been concerned about recently. He suggested waiting until the other licenses had been secured for ",hich this additional detail would be necessary. Hr. Shugrue explained that if the Conservation Commission denies the application, then the other licenses cannot be obtained. He said some siltation of the Category II type will occur and presented a copy of the analysis. Lee Dunn didn't feel comfortable about such a seemingly significant project presenting such a minimal amount of eVlcence that no adverse impacts would occur. He wanted third-party input. Lucy Leske thought the Town should hire a consultant and Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of September 24, 1987 Page 5 that there was more at stake than just the tourist industry here. Mr. Tillotson felt it was the applicant's, not the taxpayers', responsibility to hire a consultant. Henry Wasierski agreed that more information was needed and cited the large oil slick*~ the Electric Company's. <li_1GLa....~c. He added that this would be the most risky time of year to the scallop industry for dredging to occur. He also felt the exact area of bulkheading to be created should be indicated. Carl Borchert asked if MEPA should be involved in this. Mr. Shugrue said not if the project involves less than 10,000 cubic yards, adding the amount calculated for this application was 9800 cubic yards. Lucy offered to write a letter to SHAB requesting evaluation on the application regarding impact on shellfish populations and water quality in Nantucket Harbor. Donald Visco moved to continue the hearing for more information and a DEQE file nu~er. So voted. 10. Rhoda H. Weinman - 284 Polpis Road. Robert Emack of Nantucket Surveyors was present as agent for the applicant and outlined plans to replace a failed septic system, redesigned for a 4 bedroom capacity. This application was for the cottage only, as one for the house had already been filed. Lucy Leske moved to continue the hearing for a DEQE file number. So voted. 11. William and Ruth Greider - 10 "F" Street, IVIadaket. Lucy LesJ:e moved to continue the hearing for more information and a DEQE file number. So voted. 12. Barth/Taddonio - 79 Eel Point Road. Bill Willet moved to continue the hearing for a field inspection and a DEQE file number. Dooley Family Trust - 7 Polliwog Pond Road. Glen Wills of Nantucket Surveyors was present as agent for the applicant and stated the dwelling would be 76 feet away from the closest wetland. He said the snowfencing would limit traffic and siltation debris near the wetland. Lee Dunn moved to continue the hearing. So voted. 14. Dooley Family Trust - 11 Polliwog Pond Road. Glen Wills or Nantucket Surveyors and Arthur Reade of Reade and Alger were present as agents for the applicant. Mr. Wills described this 2 - part project involving access through the wetland to the building site. The driveway Hill have hardening and ,.,rill contain the utilities. There will be 900 sq. ft. of total fill. The wetland is an Isolated Vegetated Wetland. Lee Dunn asked about the viability of the wetland after being segmented by the driveway. Mr. Wills said it is perched, is the smaller of the bw areas and there would be no decrease in drainage. Peter Dunwiddie asked what the effects of a house 8 feet away from the wetland would be. Mr. Wills said not much, adding the area already has a nurnber of houses anyway and approx. 1/2 acre designated as conservation land was designed into the subdivision. There was some discussion about the 2100 sq. ft. footprint. Carl Borchert and Peter Dunwiddie wanted a it reduced. Lucy Leske wanted the dwelling moved further back from the wetland and wondered about the feasibility or wetlands replication. She wanted to see a maximum setback to increas,e the J:mffer and felt erfc,rts should be made in the best interest or the wetlands and wildlife. She suggested having a wildlife inventory done. Mr. Reade felt they could consider changing the building envelope and footprint, as well as moving it back. Peter Dunwiddie asked to see ",hat leaving 25 feet would look like, to see if that's reasonable, ror illustrative purposes. Lucy Leske moved to continue the hearing. So voted. Glen Wills of Nantucket Surveyors and Arthur Reade of Reade and Alger were present as agents for the applicant. This application represents the closest driveway to the wetland of the three. Mr. Reade added this subdivision goes back about 10 years and would be difficult to layout today. Lucy Leske suggested changing the configuration of the 35 X 45 foot dwelling to increase the distance from the wetland. Peter Dunwiddie requested a design alternate using a 25 foot buffer. Lucy moved to continue the hearing until October 15, 1987. So voted. 16. R. Griffin/M. Zodda - 3 Dionis Beach Road. Robert Emack of Nantucket Surveyors was present as agent for the applicant. The results of the field inspection were read. The proposed dwelling is 75 feet from the Bordering Vegetated Wetland. Peter Dun'\-liddie cited some wild brushcutting which had occurred in a swath through a wetland, however it was determined it ,\.,ras not. on thi=-. lot. He felt the Order of Conditions should req'uire a snowfence 25 feet from the wetland. Lucy Leske moved to continue the hearing for a DEOE file nurnber. So voted. 17 . Crow' s Nest Associates - 7 Cro"r' s Nest Way, 'i.Jauwinet (Lot 4:,). Tina Coughanour of IEP was present as agent for the applicant and gave a basic description of the site. Owner Steve Lindsay was also present. Ms. Coughanour stated the erOSlon rates in this area are 5.2 ft./yr. and there has not been much dune migration in 30 years. The walb.;ay is des:"gned to minimize footpath impact on the dUDe. Mr. Lindsay said he wishes to improve the appearance of his lot by incorporating the old house and moving it closer to the ocean. Bill Willet moved to continue the hearing until October 1, 1987. So voted. Crow's Nest Associates - 9 Crow's Nest Way, Wauwinet (Lot 44). Tina Coughanour of IEP was present as agent for the applicant. Owner Steve Lindsay was also present. Ms. Coughanour explained the results of the original test pit were unfavorable, so a leaching pit and septic system are proposed within the buffer zone. The old house would be incorporated into a ne,,; dwelling and the site is not an area of moving sands. The deck will be situated 60 ft. from the dune and house 70 ft. back from it. Peter Dunwiddie felt scenic views should be addressed. Carl Borchert felt the house is too close to the dune. Lee Dunn moved to continue the hearing until October 1, 1987. So voted. B. REGULAR MEETING 1. Minutes of September 3, 1987. with the following changes: Carl moved to accept the minutes *p. 10 - paragraph #3: Add after installed: "An on-the-spot field inspection based on extensive photos was conducted. The Co~missioners felt the photos supplied by Mr. Cohen demonstrated that no windscour is likely to occur now." *p. 10 - paragraph #6: Add after originally issued: "to I"Iartin D. Fife". So voted. 2. Other Business a. Nantucket Comrnons Trust/Brant Point Corp. - Enforcement Order. Ted Tillotson was present with Robert Sarvis. Engineer Richard Earle was also present. Mr. Tillotson outlined a 9/17/87 letter sent to the Commission which refuted the 6 alleged violations of the Order of Conditions issued on 1/29/87 on file SE48-365. He also cited what he felt was a misinformative newspaper article about the Enfcrcement Order. Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of September 24, 1987 Page 9 Mr. Sarvis contended the Comrnissicin had made a malicious press release to thwart his company and that he was never given formal notification to come to the 9/17/87 Commission meeting to discuss the Order. Mr. Sarvis claimed the Commission had in its possession all current working copies of the plans and offered to prove it by letters of transmittal in his files. He thought the field inspection team inadvertently did not have the correct plans with them in the field. Peter Dunwiddie stood by the points of the Enforcement Order. Mr. Earle confirmed that during construction the plans cited in the Order of Conditions had been complied 'I~ith. Mr. Sarvis said heatedly that Carl Borchert in particular had been against his project all along and had something t.o do \-lith the "press release." Mr. Tillotson added they felt Lucy Leske might be In conflict of interest since she works for a party currently filing an appeal with Brant Point COTp. Lucy Leske stated Mr. Sarvis had been adequately notified that he was on the 9/17/87 agenda and added the Conservation Commission never makes press releases and cannot be held responsible for what the I & M prints. Mr. Tillotson felt lack of communication was largely responsible for the misunderstanding and bad press. He felt the Enforcement Order ,~as meaningless now and requested it be rescinded. Mr. Sarvis repeated that he thought the Order was maliciously and negligently issued. Lee Dunn felt care had not been used in some of the brushcutting which went beyond the siltation fencing or closer to the wetlands than the plans had allowed. Mr. Sarvis said it is necessary t.o cut some vege"tation when installing the fencing and 'I",ill revegetate where necessary. He admitted that brushcutting is not delicate work and thought the \-lorkmen may have mistaken the wetlands flagging for the proposed line of siltation fencing. He added this was why he wanted the Commission to come out to inspect the site regularly in order to avoid such situations. Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of September 24, 1987 Page 10 Peter Dunwiddie attempted to clarify the misunderstandings, admitted it did not. occur to t.he field inspection team that they may not have been working with current plans and felt mistakes had been made on both sides. In efforts to get things moving along more smoothly from now on. Peter offered to go out again with Mr. Sarvis' engineer to confirnl the correct placement of the sil t.ation fencing aEd recoIT'mend revegetation 'I",here necessary. They agreed to meet at 10:30 AM on Friday, September 25, 1987 at the corner of Bear and Pleasant Streets. Carl Borchert asked Mr. Tillotson and Mr. Sarvis to review both the Commission's and DECiE's Order of Conditions to point out differing points bet'l~7een them. Peter Dunwiddie said Mr. Sarvis must then request modifications to the Commission's Order of Conditions. Mr. Sarvis agreed to have his engineer Gerald Buzanoski review them. Lynn Zimmerman or the Nantucket Land Council expressed concern that the revegetation might not necessarily be done with native speCles. Lee Dunn moved to send a letter back thanking her for her interest end stating the apf'eal peri.oel for the Order of Conditions issued on Jl.ug. 22, 1986 c,n the proj ect. had expired. So voted. c. Susie C. stone - recommendation for filing. Ms. Stone Has present to ask the Commission if her pToperty on the north shore of Tuckernuck falls under its jurisdiction. It ,-las, determined the lot included a relatively stable bluff and her project vlas outside the 100 foot Buffer Zone of any wetlnnd. Thus, no filing is necessary if the plans as presented are followed. Mr. Winn was present to request an extension on an Order of Conditions due to expire on Dec. 26, 1987. There was some discussion about the height of the water on the lot now as opposed to when the Order '\~as issued in 198~. Carl Borchert and Lee Dunn noted this is a very sensitive area, and theoretical discusssion continued about the purpose of expiration dates on Orders of Conditions and the function of extension permits. The fact that Extension Permits must be voted upon implied that in some cases they may not be issued. Lucy Leske moved to issue the Extension Permit for one year. Lucy, Donald Visco and Bill Willet voted in favor, Lee Dunn opposed, and Carl Borchert and Henry Wasierski abstained. So voted. e. Michael Bloomberg - 115 Baxter Road - field inspection report. Henry Wasierski read the results of a recent field inspection held to determine if the conditions set forth in a letter from the Commission dated Aug. 24, 1987 had been complied with. The hole had been filled in but was now being used as a parking area. The Commission decided to send another letter requesting the remaining disturbed areas within 100 feet of the bluff be revegetated as soon as possible and that vehicles not be permitted to park on said disturbed areas until they are well stabilized by vegetation. 3. Req-.lest for Determination a. Nancy Chiswick - ~2 Meadowview Drive. Carl Borchert moved to issue a negative Determination stating the work described in the request is within the Buffer Zone, as defined in the regulations, but will not alter an Area Subject to Protection Under the Act. Therefore, said work does not require the filing of a Notice of Intent. So voted. CooperlDaSilva - SE48-416 - 53 Madaket Road. discussion about the Enforcement Order issued May a DEQE Notice of Noncompliance issued May 5, 1987 Realty Trust. There was some 8, 1986 and to LongvieH Carl Borchert wanted to deny the application and let the applicant appeal it to DEQE. He felt the pipe sets a bad precedent, wanted the pipe taken out and the ditch restored to its natural state. He felt this was not a valid mosquito control measure or way to alleviate a health threat. Lucy Leske said Donald Oliver may have wanted to avoid maintenance problems by putting the pipe in. Donald Visco said the ditch is man-made and the entire system needs cleaning out all the way to Hunmlock Pond. Peter Dunwiddie wanted to avoid setting a precedent for putting in pipes at other ditches. Lynn Zimmerman of the Nantucket Land Council pointed out it lS important to detellTIine whether the prior activities were done legally. Donald Visco warned that it may appear the Commission is trying to punish someone. Lucy Leske felt denying the application would give DEQE jurisdiction over the issue. Glen Wills mentioned if the Corrmission lapsed on issuing an Order of Conditions on this application, then it would go to DEOE anyway. Carl Borchert felt that would be a real cop out. Lee Dunn was likewise concerned about setting a precedent, but wanted to leave the pipe in place. Carl Borchert moved to issue a standard Order of Conditions with the following Special Condition: 1) The pipe must be removed and the area restored to its original condition. Peter Dunwiddie, Lucy Leske, Bill Willet and Carl Borchert voted in favor and Lee Dunn, Henry Wasierski and Donald Visco opposed. So voted. Bill Willet removed himself from the Commission to the public. There was some discussion about whether or not the Commissioners were in conflict of interest issuing an Order of Conditions to another Commission member. Lucy Leske was concerned it would appear that way, felt it would be difficult to offer an unbiased opinion on the application and wanted it referred to DEQE. Donald Visco said Boards and Commissions have no reason to treat applications of their members any differently and felt it was passing the buck. Donald moved to issue an Order of Conditions, however the motion was not seconded. Peter Dunwiddie agreed to contact Town Counsel on the issue. c. Robert Howell - SE48-423 - Crow's Nest Way. Carl Borchert moved to issue a standard Order of Conditions citing the Sept. 3, 1987 plans. So voted. d. Patricia M. English - SE48-424 - 158 Orange Street. Lucy Leske moved to issue a standard Order of Conditions. So voted. e. Cranberry Construction Corp. - SE48-425 - West Chester Street. Peter Dun-widdie recommended offering the position of Conservaticn Administrator to one of three applicants, Tom Baptist. Carl Borchert moved to accept the Chairman's recommendation and have him check references provided. Pet_er agreed to do so. So voted. b. Lucy Leske reported on a call received from a resident in the Monomoy Creeks area about excessive and damaging use of All Terrain Vehicles on Shore Reservation. Lynn Zimmerman of the Nantucket Land Council said she had called the police about this and added the vehicles must be licensed. Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of September 24, 1987 Page 15 Lucy Leske moved to send a letter to the Board of Selectmen stating the disturbance has come to the Commission's attention and that ATVs are causing heavy damage to the beaches and marsh in this area. The noise pollution that these vehicles create is disturbing many species of wildlife in the area, including shorebird populations. The letter will also report a vote by the Commission to ask the Board of Selectmen to post "No Trespassing" signs on the Town-owned land designated as Shore Reservation and, once posted, that the Nantucket Police enforce the signs to reduce further damage by ATVs to this important resource. So voted. Lucy Leske also announced her resignation from the Conservation Commission for personal reasons, effective November 1, 1987. She agreed to send a letter to the Board of Selectmen.
