MINUTES OF AUGUST 6, 1987
The public hearings of August 6, 1987 were called to order at 7:35 PM.
Members present were: Lee Dunn - Vice Chairman, Donald Visco, Bill
Willet, Carl Borchert. Members absent were: Peter W. Dunwiddie -
Chairman, Lucy Leske, Henry Wasierski.
A. PUBLIC HEARINGS
1. Robert S. Yates - SE48-408 - Great Point Road. Glen Wills of
Nantucket Surveyors was present as agent for the applicant. He
stated they were continuing to look at variation in the data
being taken on water quality. Another series of tests is
scheduled for next week. More information is still forthcoming
from Daylor Consulting Group.
Bill Willet moved to continue the hearing for more information
from the applicant. So voted.
2. Robert Elliott - SE48-412 - Lot 903, Elliott's Way, Tom Nevers.
Glen Wills of Nantucket Surveyors was present as agent for the
applicant. He said the project will once again present plans
before the HDC in an upcoming meeting.
Carl Borchert moved to continue the hearing at the applicant's
request. So voted.
3. CooperlDaSilva - SE48-416 - 53 Madaket Road. Carl Borchert
mentioned a phone conversation with Lealdon Langley at DEQE who
said a letter to the Commission outlining answers to recent
questions in some detail is now in the final draft stage.
Carl Borchert moved to continue the hearing for more information
from DEQE. So voted.
4. Bruce Connolly - 286 Hummock Pond Road. Carl Borchert moved to
continue the hearing until a formal letter of withdrawal is
received from the applicant. So voted.
5. Harold E. Booker, Jr. - 22 Folger Ave., Surfside. Robert Emack
of Nantucket Surveyors was present as agent for the applicant.

The results of a recent field inspection were read during which
it was determined the 4-bedroom house was within the Buffer Zone
of a vegetated wetland, Weeweeder Pond.
The exact boundaries of the wetland and the high water mark were
agreed upon. Mr. Emack presented a revised plan of the building
envelope which was designed to maximize flexibility while
building was underway. The envelope is to include all decks.
He expressed the applicant's desire to minimize siltation into
the pond.
Donald Visco moved to continue the hearing for a DEQE file
number. So voted.
6. Flint and Judy Beale - Bosworth Road, Tom Nevers. David Bentley
and Elizabeth Churchill were present as agents for the
applicant. Lee Dunn questioned the 2 conflicting septic plans
noticed during the field inspection.
Mr. Bentley and Ms. Churchill explained they had presented two
alternate plans. The septic system as originally designed is
outside the Buffer Zone and places the house within the Zone.
Alternatively, a second plan moves the house outside the Buffer
Zone, placing the septic system within the Zone and closer to
the bluff. They wanted to know which plan the Commission would
prefer.
Lee Dunn felt this project was a bit different from the Elliott
project nearby and the second plan would place the house well
back from the bluff. Carl Borchert wanted to see a more
specific locus map.
Carl Borchert moved to continue the hearing for another field
inspection, a locus map and a DEQE file number. So voted.
B. PUBLIC MEETING
1. Minutes of July 23, 1987. Carl Borchert moved to accept the
minutes as written with the following change:
* Page 6: paragraph #3 - change first sentence to
read: Carl Borchert felt the lot was subject to the

wetlands scenic view bylaw, but that the project was not
violating any wetlands scenic view from a public way.
So voted.
2. Audience to press and public
a. Ted Tillotson - Elizabeth McIlvain - SE48-407 - Millbrook
Road. Ted Tillotson was present as attorney for Ms.
McIlvain requesting the Commission reconsider Special
Condition #3 of an Order of Conditions issued May 21, 1987
which stipulates no stoops will be permitted on the pond
side of the house.
Mr. Tillotson stated the Building Commissioner will not
issue a Certificate of Occupancy on the dwelling without
some form of steps or deck down to the ground. He said
landscape designer Juliette Perkins suggested placing a
narrow deck with a bench seat or railing along that side of
the house to limit direct access to the pond and bank and
to minimize impact on the wetland.
The consensus was absent members would want to take part ln
any decision on this. Carl Borchert suggested Mr.
Tillotson send a letter to include new deck plans and
elevation information and the Commission could then decide
whether it represented a major change or required a new
filing. Mr. Tillotson agreed to send said letter.
b. Norman Lanman - ValentinelCedarcrest Realty Trust. Mr.
Lanman was not present to discuss an item in the Trust's
enviromental notification form which at a later date could
cause reason for concern (see page 4 & 5 of notification,
on file in office). The Commissioners felt there was no
need for discussion at this time.
c. John Roe - New Wetlands Regulations. John Roe of the
Nantucket Land Council presented a draft of the proposed
Nantucket Wetlands Regulations. The document is the result
of 10 months of work by Mr. Roe, Lee Dunn and former
chairman Mark Arnold. Mr. Roe said it is now time for the

Commission as a whole to comment on the regulations and to
set a public hearing date.
Carl Borchert moved the hearing be advertised for Thursday,
August 20, 1987 as part of the regular meeting. So voted.
Copies of the draft will be available at the office at 4
North Water Street.
3. Other Business
a. Richard Gamble - SE48-232 - Pocomo Road. The applicant
had been granted an extension permit at the last meeting,
however, it was realized later the Order of Conditions had
expired on May 6, 1986. Carl Borchert moved to deny the
extension permit and request the applicant file again. He
also suggested the filing include the new house plans. So
voted.
b. Proposed ban on commercial sale of Marlins and Sailfish.
Lee Dunn expressed to the rest of the Commission his
concern for diminishing stocks of White Marlins and
Sailfish taken by commercial fisheries. He urged the
Commission to send a letter to the New England Fishery
Management Council urging them to support the proposed ban
on the sale of Marlins and Sailfish from the Atlantic and
to support other management measures designed to protect
this resource.
Carl Borchert agreed that a letter from this Commission
might have favorable impact on the issue, and moved to send
such a letter. So voted.
c. Tristram's Landing - Long Pond - cutting of vegetation.
Lee Dunn described some cattail removal activity reported
to him by George Nyren. Donald Visco felt even though the
cattails are very abundant on Long Pond, a filing is
necessary to regulate such activity.
Carl Borchert moved to send a letter to the Madaket
Conservation Group Trust, clo Stanley Jacobs requesting the
filing of a Request for Determination for any further
cattail control activity. So voted.

d. Building Dept. complaint - D. Marken, 23 Chuck Hollow Road.
The Building Dept. had mistakenly forwarded a complaint to
the Commission rather than to the Conservation Foundation
on whose property some trucks had been parked and done
possible damage. The complaint will be forwarded to the
Foundation.
4. Requests for Determination
a. Frank Marks/Land Bank - 23 North Liberty Street. Bill
Willet moved to issue a negative Determination stating the
work described in the Request is within the Buffer Zone, as
defined in the regulations, but will not alter an Area
Subject to Protection Under the Act. Therefore, said work
does not require the filing of a Notice of Intent. So
voted.
b. Rhoda Weinman/Polpis Farm Realty Trust - 282 Polpis Road.
Robert Emack of Nantucket Surveyors was present as agent
for the applicant and presented sketch plans. The
consensus was the plans were incomplete and another field
inspection was warranted.
Carl Borchert moved to continue the Determination period at
the request of the applicant in order to present a more
detailed sketch plan and perform another field inspection.
So voted.
5. Certificates of Compliance
a. Michael E. Sparrough - SE48-371 - 68 Miacomet Ave. Donald
Visco moved to issue a Certificate of Compliance certifying
the work regulated by the above-referenced Order of
Conditions has been satisfactorily completed. So voted.

All correspondence was read and accepted.
There being no other business, the meeting was adjourned at 9:30 PM.
