MINUTES OF ~AY 28, 1987
The public hearings of May 28, 1987 were called to order at 7:38 PM. Members
present were: Carl Borchert - Vice Chairman, Lee Dunn, Bill Willet and Henry
Wasierski. Members absent were: Lucy Leske, Peter Dunwiddie - Chairman and
Donald Visco.
A. PUBLIC HEARINGS
1. Robert S. Yates - SE48-408 - Great Point Road. Glen Wills of Nantucket
Surveyors was present to say the applicant had requested a continuance
of the hearing in order to gather more information.
Lee Dunn moved to continue the hearing. So voted.
2. Old North Wharf Company - SE48-410 - Old North Wharf. No agent was pres-
ent for the applicant, and no further discussion was needed on the project.
Bill Willet moved to close the hearing. So voted.
3. Hughes/Lang - SE48-411 - Poverty Point. No agent was present for the
applicant. Lee Dunn moved to continue the hearing for more information.
So voted.
4. Robert Elliott - SE48-412 - Lot 903, Elliott's Way, Torn Nevers. Glen
Wills of Nantucket Surveyors was present with the applicant, Mr. Robert
Elliott. Murray Freedman, an abutter, was also present reviewing the pro-

Mr. Wills proceded to discuss the visual specifications per the Commission's
request. Mr. Freedman expressed concern about the house being too close
to his. Carl Borchert said it appeared the house was centered on the lot,
84 feet wide, however, the height above an imaginary line between the two
existing houses appeared to be 7 - 9 feet. Carl stressed the Commission's
concern with the visual disruption of the existing skyscape on the bluff.
He felt strongly that the building as planned was too high and did not
blend favorably with Torn Nevers Bluff, a naturally unique and fragile land-
form. As viewed from the cul-de-sac at the bottom of the hill and from the
outer beach, the houses should all line up.
Mr. Freedman was also concerned about potential filling and the strength
of the retaining wall. Mr. Wills said the wall is sufficiently strong.
Potential runoff problems created by the well were discussed, and Mr. Wills
went on to describe the use of haybales and Mirafi fabric as siltation

fencing to prevent the formation of gullies by lowering the runoff
velocity. He was prepared to add second and third catchments if neces-
sary. Henry Wasierski added that a good southeaster could create a lot
of runoff on this lot next to the wall, considering it often rains
horizontally and with great force along that bluff.
Mr. Freedman inquired as to the proposed building schedule claiming he
lost valuable rental income last year due to an intolerable ruckus at
Mr. Elliott's lot. Mr. Elliott spoke in his own defense saying Mr. Freed-
man was mistaken and last year's activity had only involved tearing down
an old wall and building a new one.
Mr. Elliott stressed his interest in being treated fairly and with the
same restrictions (or lack of them) as had the other houses on the bluff.
He felt he had done something good by plotting the house 30 feet back
from the bluff, more than most other houses. He added the majority of
the other houses did not have height restrictions imposed upon them when
they were built. Carl Borchert felt he was unfortunately being caught in
the web of the zoning by-laws and that some of the others may have been
constructed prior to the adoption of the local by-law.
Lee Dunn highlighted the difficulty in addressing the issue of wetlands/
scenic views protection, and felt the Commission's proposed 24 foot height
restriction provided generous latitude within which to work out an accept-
able design. There followed extensive discussion over height, setbacks
and design diagrams. Carl Borchert suggested the HDC and the Conservation
Commission engage in a joint meeting to discuss the project.
Mr. Elliott respectfully requested keeping the hearing open pending further
discussion with the HDC. Lee Dunn moved to continue the hearing at the
applicant's request in order to obtain a recommendation from the HDC. So
voted.
5. Richards, Everett, Jackson - SE48-413 - Tristram Ave., Dionis. Glen Wills
of Nantucket Surveyors was present as agent for the applicant.
There was discussion of whether or not this was still an emergency situ-
ation, as it had been when the project was originally filed after a storm
in Fall, 1986. Bill Willet moved to close the hearing and perform a field
inspection. So voted.
6. Bruce Connolly - 286 Hummock Pond Road. Although Jamie Marks was not pre-
sent as agent, Mr. Robert Emack of Nantucket Surveyors said he may soon

submit a Notice of Intent to move the house back from the edge of the
eroding bluff. Lee Dunn moved to continue the hearing for a DEQE file
number and a field inspection. So voted.
7. M/M Ted Godfrey - 325 Polpis Road. There being no further discussion, Lee
Dunn moved to continue the hearing for a DEQE file number. So voted.
8. Lawrence and Shirley Schaffer - 12 Tennessee Ave., Madaket. Robert Emack
of Nantucket Surveyors was present as agent for the applicant. The possi-
bility of filling in portions of the saltmarsh was discussed, and the
Commission was also concerned with debris being kept off the marsh during
construction. The secretary was asked to include a copy of the applicant's
Request for Determination on this project in the file.
Bill Willet moved to continue the hearing for a DEQE file number. So voted.
B. REGULAR MEETING
1. Minutes of May 14, 1987. The minutes of May 14, 1987 were read, and Lee
Dunn moved to accept them as written. So voted.
2. Audience to press in public
a. Bob Ernack - Perkins/LaFrance retaining wall. Mr. Robert Ernack of
Nantucket Surveyors was present to request for the applicant a modifi-
cation of the Order of Conditions issued to the project. Mr. Emack
showed preliminary plans to raise the foundation and the grade.
Carl Borchert felt the request did not represent a major change. Bill
Willet moved that the change was not major and does not require a filing
of a Notice of Intent. So voted. Mr. Emack agreed to submit better-
looking plans to the Commission.
3. Requests for Determination
a. Russell M. Lawton - Cranberry Bogs. Mr. Glen Wills was present as agent
for the applicant and stated the proposed work was simply a duplication
of previous work. Mr. Russell Lawton was also present and fielded
questions about the project.
Lee Dunn moved to issue a negative Determination with the addition:

The field inspection report results were as follows:

d. Map 1973 Town Topographic Map
e. Photo in Selectmen's 1965
Discussion from those present determined that no new bogs had
been created, but 115 acres had been in continuous production
and 117 acres had been completely replanted to begin harvesting
in 1988. Phillips Run Bogs have been reworked.
So voted.
4. Orders of Conditions - open
a. Old North Wharf Company - SE48-410 - Old North Wharf. Bill Willet
moved to issue a standard Order of Conditions to include the follow-
ing Special Conditions:
1. The applicant must show a contract with a hazardous waste
hauler which will provide 4 cleanings per year of the catch
basins and separators shown on the plan prior to the issuance
of a Certificate of Compliance.
2. Precautions must be taken to prevent siltation of the harbor
during construction.
So voted.
5. Other Business
a. Conservation Office Advertisement. The vacancy announcement was read
and will be circulated freely and advertised over the coming months.
b. Flood Insurance Rate Maps - current set available in office.
c. Marion H. Morton - SE48-281 and SE48-341 - Wauwinet Road. The Commission
was notified by letter that driveway construction in accordance with
the approved plan was to begin on or about May 26, 1987, as required
by the Order of Conditions on project SE48-341. On the other project,

SE48-281, the Commission was provided by letter with the founda-
tion plan and detail sheet for the proposed dwelling.
The letters were read with little discussion and the Commission
saw no problems with the new foundation plans.
d. Beverly Hall - SE48-393 - 44 Tennessee Ave., Madaket. Mr. Ted Til-
lotson was present representing the applicant. Although additional
work had been done with IEP, Inc. in efforts to appeal the Commission's
denial of Ms. Hall's project, Mr. Tillotson requested a continuance of
the discussion until the Chairman, Peter Dunwiddie, was present.
e. Warren's Landing Bid. No bids were received by 7:30 this evening, the
bid deadline, most likely due to the timing in the busy season in
which the bid was advertised. The Commission decided to hold off
further bidding advertisements until the fall.
6. Correspondence
All correspondence was read and accepted.
There being no other business, Lee Dunn moved to adjourn the meeting at 10:15 PM.
