Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 MINUTES OF APRIL 16, 1987 The public hearings of April 16, 1987 were called to order at 7:30 PM. Members present were: Carl Borchert - Vice-chairman, Donald Visco, William Willet and Lee Dunn. Members absent were: Peter Dunwiddie, Chairman, Lucy Leske and one vacancy. A. PUBLIC HEARINGS 1. Chase/Hill - 39 Quidnet Road. Ms. Tina Coughanour of IEP, Inc., consulting environmental scientists, was present as agent. Ms. Coughanour described the project in general, while concentrating on the vegetative make-up of the property and what she felt would be minimal impact of the project on the ecosystem. She said the access road falls almost completely within areas classified as evesboro soils, known as being characteristically deep and excessively drained. Carl Borchert voiced concerns about the extent of clay composition on the property, and Donald Visco added he thought tbere could be isolated areas of silty soils. Ms. Coughanour said the property is significant to flood control and storm damage prevention as well as being valuable to many species of wildlife. The results of a recent field inspection were read, and the Commissioners agreed that the impact of the project would likely be minimal. It was pointed out that this application is for the construction of the access road only, and that the 8 proposed lots on the site would be subject to filing individual Notices of Intent with the Commission in the future. Lee Dunn moved to continue the hearing for a DEQE file number. So voted. 2. Richards, Everett & Jackson - Tristram Ave., Dionis. Carl Borchert moved to continue the hearing for a DEQE file number. So voted. 3. Stephen Paradis - SE48-404 - 28 Grove Lane. Glen Wills was present as agent. The current standing water situation was discussed. The project had been discussed at length during prior meetings. Carl Borchert moved to close the hearing. So voted. 4. Beach Box Trust - SE48-400 - Hallowell Lane. John Shugrue was present as agent. The March 3, 1987 field inspection was referred to regarding the suggestion that the applicant consider pulling the addition back further Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 page -2- minutes of 4-16-87 from the bank. Mr. Shugrue responded that whereas the deck used to be 8 feet back from the bank, the new plans show it to be 17 feet back. He pointed out that the deck is at grade. The new plans were further reviewed. Carl Borchert moved to close the hearing. So voted. 5. Robert & Ruth Klausmeyer - SE48-403 - 15 Crow's Nest Way, Wauwinet. Jeffrey Blackwell was present as agent. Title 5 and the possible necessity of a variance was discussed. No problems were foreseen. Carl Borchert moved to close the hearing. So voted. 6. Old North Wharf Company - Old North Wharf. Roger Church was present as agent. Mr. Church described the installation of drainage pipes, and added that the applicant's interest was in improving what is already there. Carl Borchert questioned the maintenance of those drainage pipes and sug- gested in advance that the applicant look into contacting a hazardous waste contractor. Donald Visco was concerned with the permeability of the area, and Carl added that several areas do seem to pool up at times. Donald Visco moved to continue the hearing for a DEQE file number. So voted. 7. Ronald Bamber - Alliance Lane (proprietor's road), off Eel Point Road. John Shugrue was present as agent. There was some disagreement over whether or not a particular site on the property was a kettlehole. Donald Visco moved to continue the hearing for a field inspection and a DEQE file number. So voted. B. REGULAR MEETING 1. Minutes of April 2, 1987. Since only four of the seven Commission members were present, Carl Borchert moved to wait until more members were available to review the minutes and accept them at a later date. The secretary will mail copies of the April 2 minutes to those members not present. So voted. 2. Audience to press in public a. DianeCoombs - Thomas Taylor - SE48-397 - 61 Hulbert Ave. - SHAB appeal. Carl Borchert read Ms. Coombs' letter of appeal. Donald Visco asked whether this appeal was actually representative of SHAB or, rather, representative of Ms. Coombs and nine other people. An appeal from Ms. Joan R. Kolle was received, and since it was lengthy, it was announced that the document was available to the public in the files. c. Ted Tillotson - Beverly Hall - SE48-393 - 44 Tennessee Ave. }1r. Tillotson was not present. Glen Wills commented that he thought this would be brought up at the next meeting. d. Phil Shea - pond openings. This item was not originally on the agenda, but was incorporated inao the meeting. }1r. Shea, Superintendent of the Nantucket DPW, presentJa proposal which described a recent inspection of high water conditions at Sesachacha Pond and Hummock Pond and sub- sequent recommendations of the Department to open the ponds. Carl Borchert read a related letter from the DEQE which issued Superseding Orders of Conditions denying the opening of Sesachacha, Hummock, Miacomet, Squam and Reed Ponds and Clark Cove. Carl also read another letter from DEQE which presented guidlines for Emergency Certifications available to Massachusetts towns, an option which may apply to this case. Mr. Shea stressed his concern for public safety from the threats of road deterioration, property damage and increased breeding areas for mosquitoes due to flooding. Donald Visco added that the Town of Nantucket does not have jurisdiction over the ponds of Nantucket. A member of the audience asked what the towns on Marths's Vineyard do in similar cases, and suggested looking into it. The pros and cons of pond openings were discussed at some length. Carl Borchert suggested the DPW apply for the above mentioned Emergency Certification, file a Notice of Intent and consider the use of sandbags as a temporary measure of protection. e. Jamie Marks - Bruce Connolly house, Cisco. This item was not originally on the agenda, but was incorporated into the meeting. Mr. Marks described what the owner, Mr. Connolly, considers to be an emergency situation existing at his house at Cisco beach. The southern side of the property is eroding away and Mr. Connolly wishes to fill in an area of "drop- off" for aesthetic reasons. Donald Visco was in favor of this as a knowingly temporary measure as long as the fill used was a clean mix of clay and sand. Carl Borchert suggested the filing of a Notice of Intent right away. Lee Dunn moved to issue a standard Order of Conditions with the following special conditions: 3. No fill is to be stockpiled on the site and all material storage is to be within siltation fencing. 4. The finished grade is to be the same as the existing grade. 5. All excavations are to be less than 5 feet. 6. The sewer line excavation is to be no wider than 6 inches. 7. Staked haybales are to be installed prior to any construction and are to be maintained in good condition until construction is complete and ground cover of vigorous plant species sufficient to prevent erosion is established. 8. The applicant is advised that this particular area is notorious for its impermeability, and may often be a wet lot in the spring. "Draining of Hummock Pond" to dry the lot will not be undertaken by this Commission. So voted. b. Robert & Ruth Klausmeyer - SE48-403 - 15 Crow's Nest Way, Wauwinet. Bill Willet moved to issue a standard Order of Conditions with the addition of the following: 3. Section 30(3) of the Wetlands Regulations, promulgated under G.L. c. 131, s. 40, requires that no coastal engineering structure, such as a bulkhead, revetment, or seawall, shall be permitted on an eroding bank at any time in the future to protect the project allowed by this Order of Conditions. 4. No work shall be carried out forward of the easterly face of the house. So voted. c. Beach Box Trust - SE48-400 - Hallowell Lane. This item was not originally on the agenda for issuance of an Order of Conditions, but was incorpor- ated into the meeting. Donald Visco moved to issue an Order of Conditions with the following special conditions: 3. Excavation shall be limited to 4'8" beyond the building line and limited to 1'0" beyond the deck lines. 4. No activity is to take place north of the house, i.e. excavation, machinery, etc. So voted. Robert Elliott - Elliott's Way, Torn Nevers - letter. Glen Wills was present as agent. A letter from Mr. Elliott was read, and Mr. Wills presented photos of the completed plantings on the property. Lee Dunn moved to issue a Certificate of Compliance. So voted. b. Harvey B. Matthews III - SE48-300 - Quidnet Road - 4/8/87 field viewing. The results of a field viewing were discussed. Glen Wills was present as agent. Mr. Wills discussed a recent phone conversation with Peter Dunwiddie. Peter had suggested the applicant move the haybales back 5 feet from their present location. Carl Borchert suggested the applicant send the Commission a letter describing his proposed moving of the driveway. c. Edward Murphy - SE48-382 - Ames Street, Madaket - req. for ext.; NLC letter. A request for a filing time extension to June 1, 1987, during which time a response to a complaint is to be made, was read from the office of Elisabeth Goodman, an attorney for the Commission. Another letter from the Nantucket Land Council, Inc. was read concerning the possible violation of the Wetlands Protection Act by an apparent change in the location of the leaching field, placing it closer than 50 feet from the wetlands edge. The NLC has notified DEQE of this observation. d. Susan Hayford - mosquito ditches. The results of a recent field viewing by Peter Dunwiddie were discussed. Mr. Riley Hayford presented at length his concern over the dangers of encephalitis infection in horses and humans, and he wants the ditches cleaned out to reduce habitat favorable to mosquito breeding. Mr. Hayford was referred to the Commission by the Nantucket DPW. Mr. Hayford said Billy Holdgate is willing to clean the ditches for free, and that Carl Jelleme had expressed similar interest. During much discussion, Donald Visco pointed out the state of Massachusetts has the ultimate jurisdiction over this issue. Carl Borchert added, from Peter's field viewing notes, that the entire ditch system must be cleaned out, if anything, and that the particular ditch to which Mr. Hayford was referring was graded incorrectly to start with. Discussion continued about various mosquito control options and rainfall cycles. Lee Dunn suggested Mr. Hayford present the Commission with addi- tional information about encephalitis outbreaks and the actual benefits of ditching on mosquito control. Carl Borchert suggested the filing of a Notice of Intent if a specific project materializes in the future. Carl Borchert read a letter from the Daylor Consulting Group, Inc. representing Woodbury Lane Realty Trust which stated that no new filing will be made in reference to confusion at the last meeting (April 2, 1987). The project will not change the wetland and sedimentation control will be put in place. f. Conservation Commission purchases. The secretary reminded the Commission of their opportunity to spend the balance of certain accounts before the end of the fiscal year. The Commissioners decided to purchase a new camera for use on field inspections, and the secretary will submit a proposal for purchase of a word processor for the office. 5. Correspondence a. Mark & Barbara White - letter: Po chick Ave. & Adams Street. Bill Willet read the results of a recent field inspection in which it was determined that the area was not under the jurisdiction of the Conservation Commission. Mr. Willet felt blocking off the road would be a good idea in order to further protect the area, and agreed to write a letter to the Whites to that effect. b. Valerie Swett/DeRensis - Surfside parking lot. A letter was read which suggested the Conservation Commission transcribe an enclosed letter to the Nantucket County Commissioners to certify the unanimous vote taken on November 6, 1986 by the Commission to approve the proposed acquisition of the Surfside parking lot by the Town of Nantucket. The Commissioners asked the secretary to transcribe said letter. c. Elisabeth Goodman - Longview Realty Trust. Ms. Goodman's letter was read and Carl Borchert mentioned that he had taken the DEQE to the lo- cation in question. No further action by the Commission at this time is needed. i. DEQE - letter to John S. Conway - re: SE48-J80 and SE48-381. was read which stated to Mr. Conway that his appeal had been on the grounds that he is neither an aggrieved person nor an the sites of the proposed activities. A letter dismissed abutter to All other correspondence was read and accepted. There being no other business, the meeting was adjourned at 10:15 PM.
