MINUTES OF APRIL 2, 1987
The public hearings of April 2, 1987 were called to order at 7:30 PM.
present were: Peter Dunwiddie--chairman, Carl Borchert, Lucy Leske,
Willet and Lee Dunn. Members absent were: Donald Visco and Maryjane
Members
William
Williams.
A. PUBLIC HEARINGS
1. S/J Wauwinet Trust - SE48-392 - Wauwinet Road. Melissa Philbrick was
present as agent. John Sullivan of the Geo-Tech Group represented an
abutter, Marion H. Morton. Carl Borchert removed himself from the room
during the hearing.
The purpose of re-opening the hearing was to modify the original Order
of Conditions issued on March 17, 1987. Melissa Philbrick highlighted
the changes illustrated on Plan II which included the relocation of one
cottage and the addition of another catch-basin beneath the parking lot.
John Sullivan outlined the details of the catch-basin and its improved
drainage capabilities via an extensive leaching field design.
Lucy Leske moved to close the hearing. So voted.
2. Richards, Everett & Jackson - Tristram Ave., Dionis. Lee Dunn moved to
continue the hearing for a file number. So voted.
3. Beach Box Trust - SE48-400 - Hallowell Lane. John Shugrue was present
as agent. Peter Dunwiddie mentioned that a second field inspection was
attempted on March 23, however, the area in question still had not been
staked. Another inspection was scheduled for Monday, April 6, 1987.
Bill Willet moved to continue the hearing. So voted.
4. Robert & Ruth Klausmeyer - 15 Crow's Nest Way, Wauwinet. Lee Dunn moved
to continue the hearing for a file number. So voted.
5. Stephen Paradis - 28 Grove Lane. Glen Wills of Nantucket Surveyors was
present as agent. Lucy Leske removed herself from the room during the
hearing. The results of a recent field inspection were discussed. Glen
Wills presented a description of the project and the proposed procedure
during construction. Siltation fencing, driveway fill and the sewer line
were discussed.
Carl Borchert voiced concern about where the excavated material from the
cellar hole would be deposited. Mr. Wills said it would not be stockpiled

on the site and would be hauled away. Peter Dunwiddie proposed that the
storage of building and construction materials be limited on the building
site, and that the finished grade equal that of the initial existing
grade. As a final note for the record, Peter advised the applicant that
this particular area is notorious for its impermeability, and warned that
it may often be a wet lot during the spring.
Bill Willet moved to continue the hearing for a file number. So voted.
B. REGULAR MEETING
1. The minutes of March 19, 1987 were read. Lucy Leske moved to accept the
minutes with the following changes:
a. page 1 - Beach Box Trust, paragraph #1: delete 3rd and 4th
sentences.
b. page 3 - Thomas Taylor, paragraph #3: add Carl Borchert opposed.
c. page 4 - Winn, Low & Everett, item 114: change "72-hour" to
"48-hour." Paragraph #2: add Carl Borchert opposed.
2. Audience to press in public
a. Siasconset Sewer - SE48-381. Norman Lanman was present as agent. A
letter from the Board of Selectmen dated April 2, 1987 was read re-
questing the Commission's comment on the need for an expanded work
area. Discussion followed regarding the construction area, impact
and size of the drilling rigs and revegetation specifications. Re-
vegetating with Pinus rigid a was suggested, and may in the future be
included in the Order of Conditions.
Norman Lanman will look into various drilling rig specifications and
report back to the Commission.
b. Surfside Sewer - SE48-380. Norman Lanman was present as agent. A
letter received at the meeting from the Board of Selectmen dated
April 2, 1987 was read. It contained a revised site plan and requested
an expanded construction area beyond that identified in the Order of
Conditions for the project. It also requested review from the Commission
on the elimination of the paved road to be replaced by a gravel road.
After discussion, Mr. Lanman indicated he will get back to the Commission
with additional details.

c. Woodbury Lane - SE48-312. Bob Daylor was present as agent. Mr.
Daylor briefed the Commission on work to be done in a claypit area.
On examination of the plans, it was noted that this involved construc-
tion of a driveway in what was termed a "greenbelt area."
There was some discussion over an apparent difference between Mr. Day-
lor's plans and the approved plans in the Commission's files. The
secretary left the room to look for other plans. When like plans
could not be located, and after discussion surrounding the viewing of
Mr. Daylor's plans, Carl Borchert and Peter Dunwiddie suggested the
filing of a Notice of Intent.
3. Requests for Determination
a. Elizabeth McIlvain - Millbrook Road. John Shugrue was present as agent.
A letter written on March 25, 1987 by Lucy Leske of the Commisssion was
read. It was mentioned that Ms. McIlvain had not contacted the
Commission requesting determination on the installation of an oil
tank on her property.
Lucy Leske moved to contact DEQE for a recommendation on an area as
sensitive as this. Carl Borchert moved to issue a positive Determina-
tion and that he will contact DEQE regarding the oil tank. Mr. Shugrue
agreed to contact Ms. McIlvain. Lee Dunn abstained from voting.
So voted.
4. Orders of Conditions
a. Walter J. Cairnes - SE48-401 - 82 Baxter Road. Glen Wills was present
as agent. Lee Dunn moved to issue a standard Order of Conditions
referencing the new plans. So voted.
b. Walter J. Cairnes - SE48-402 - 119 Baxter Road. Glen Wills was present
as agent. Carl Borchert moved to issue a standard Order of Conditions
with the addition of the following clause:
The Order of Conditions and the Certificate of Compliance for any
new building within 100 feet landward of the top of a coastal bank
permitted by the issuing authority under this Act shall contain
the specific condition:
Section 30(3) of the Wetlands Regulations, promulgated under
G.L. c. 131, s. 40, requires that no coastal engineering structure
such as a bulkhead, revetment, or seawall, shall be permitted on

an eroding bank at any time in the future to protect the project
allowed by this Order of Conditions.
So voted.
c. S/J Wauwinet Trust - SE48-392 - Wauwinet Road. Melissa Philbrick
was present as agent. Carl Borchert removed himself from the room
during the meeting. Lucy Leske moved to issue an ammendment to the
original Order of Conditions dated March 17, 1987, by attaching the
following:
Order of Conditions - Ammendment
At the hearing of April 2, 1987, the Nantucket Conservation Commission
determined that the proposed changes in the plans submitted by the
S/J Wauwinet Trust on that date were not significant enough to require
the filing of a new Notice of Intent. However, the following adjustments
shall be made in the Order of Conditions, issued March 17, 1987:
1) Change condition #12 to refer to plans B2, C2, D2, E2 (all
plans with 4/1/87 revision dates).
2) Change condition #15 to refer to plan D2.
3) Change condition 1116 by adding after construction.: "in
order to report levels of hydrocarbons, coliform, phosphates
and nitrates."
4) Change condition #19 by deleting the last sentence and adding,
"Building 113 shall be linked to the existing hotel building
septic system as shown on the 4/1/87 revision of plan B2."
Lucy Leske volunteered to write the ammendment. So voted.
5. Other Business
a. Ted Tillotson -
1) Stuart Steele - SE48-273 - 49 Hulbert Ave. Mr. Tillotson requested
a Certificate of Compliance. The Commission expressed its concern with
the top of the dune having been lopped off during construction and the
consequences of storm damage to the area. Lee Dunn suggested the deck
may have to be removed in order for the dune to be restored to its
original slope.

Carl Borchert suggested the applicant submit a proposal to revegetate
the dune area to the Conservation Commission.
2) Carter Cafritz - SE48-343 - 47 Hulbert Ave. Mr. Tillotson requested
a Certificate of Compliance. The Commission mentioned the dune line
had been breached during construction, and a condition exists similar
to the Steele project (above).
3) Beverly Hall - SE48-393 - 44 Tennessee Ave. Mr. Tillotson said
a response to the denial will be forthcoming and should be on the
agenda for the next meeting.
b. Richard Glidden - Po chick Ave. - Adams Street. A field inspection was
not held due to inclement weather. Another will be scheduled for next
week.
c. Toscana Corp. statement of 3/31/87. The Commi.ssion reviewed the bill
for work performed and agreed to pay it promptly.
d. Toscana Corp. proposal of 4/1/87. After review of the proposal, Lucy
Leske moved to advertise for a new bid in the next newspaper. So voted.
e. Cape Cod Coalition of Conservation Commissions - delegate. The Commis-
sion agreed to appoint Bill Willet as delegate, to attend the November
meeting.
6. Correspondence
a. Maryjane Williams' letter of resignation was read and accepted. At
this time, the Commission decided to contribute towards purchasing a
gift of appreciation for the departing secretary, Holly Santos.
b. DEQE - Richard Lane - SE48-396 - 2 items. The items were read and Peter
Dunwiddie agreed to call DEQE to discuss them further.
c. Nantucket Surveyors - Winn, Low & Everett - SE48-383. Peter Dunwiddie
agreed to visit the site at 8 AM on Sat. April 4, 1987 to view the
saltwater pumping testing.
d. Charles Burkin - 18 Federal Street. Carl Borchert agreed to inspect
the lot by looking at the flood maps, and then write a letter of recom-
mendation.
e. Inland Pollution Control, Inc. - Harborside Realty Trust - SE48-390.
The Commission decided that the submission of the letter at hand did
not constitute a contract as required in the Order of Conditions. The
secretary agreed to call and make that clarification to them.
