MINUTES OF MARCH 19, 1987
The public hearings of March 19, 1987 were called to order at 7:30 PM. Members
present were: Peter Dunwiddie, Carl Borchert, Lee Dunn, Lucy Leske, William
Willet and Donald Visco. Members absent were: Maryjane Williams.
A. PUBLIC HEARINGS
1. Winn, Low & Everett - SE48-383. Michael Bachman was present as agent.
The total square footage of the ground coverage, decks and liveable
space was discussed, as shown on the plans. Michael stated that decks
could be removed if the Commission wanted, the widow's walk could be
removed and the height of the chimney could be reduced.
Donald Visco moved to close the hearing. So voted.
2. Richards, Everett & Jackson. Joe Forns was present as agent. Lucy
Leske moved to continue the hearing at the applicant's request.
So voted.
3. Beach Box Trust - SE48-400. A letter from Jennifer Shakespeare was read
which stated that the walkway had been removed. John Shugrue was present
as agent.
Lucy Leske moved to continue so that the proximity of the east end to
the bank could be staked for field inspection. So voted.
4. Walter J. Cairnes - SE48-401 - 82 Baxter Road. Glenn Wills was present
as agent. New plans showing removal of steps were submitted. The
setback is now 35 feet. A siltation fence will be placed a minimum of
20 feet from the wetland. This leaves 4 feet from the house in which
to work.
Lee Dunn moved to close the hearing. So voted.
5. Walter J. Cairnes - SE48-402 - 119 Baxter Road. Carl Borchert moved
to close the hearing. So voted.

6. Robert Klausmeyer - 15 Crow's Nest Way. Jeff Blackwell was present
as agent. Peter read the field inspection report. Carl Borchert
moved to continue the hearing for a file number. No other questions
were asked. So voted.
B. REGULAR MEETING
1. The minutes of March 5, 1987 were read. Carl Borchert moved to accept
them with the following changes:
a. page 1 - Thomas Taylor, paragraph #2: correct name from
Farms to Forns.
b. page 1 - S/J Wauwinet Trust, paragraph #1: add that Carl
Borchert removed himself from the room.
c. page 2 - Porter Cliff Realty Trust, paragraph #2: delete
second sentence completely.
d. page 5 - S/J Wauwinet Trust, item d.: add that the adaptations
to Lucy's Orders were submitted by Melissa Philbrick and
marked as Holly's copy in the file.
So voted.
2. Requests for Determination
a. Milton Rowland - Tennessee Ave. Lucy Leske moved to issue a
positive determination that the work described, which includes
all/part of the work in the request, is within an Area Subject
to Protection Under the Act and will remove, fill, dredge or
alter that area. Therefore, said work requires filing of a
Notice of Intent.
So voted.
b. Sam Stark - 7 Paradise Drive. The field inspection report
was read. Bill Willet moved to issue a negative determination
stating that the work described in the request is within the
Buffer Zone, as defined in the regulations, but will not alter
an Area Subject to Protection Under the Act. Therefore, said
work does not require the filing of a Notice of Intent.
So voted. Carl Borchert abstained as an abbuttor.

3. Orders of Conditions
a. Thomas Taylor - SE48-397. Joseph Forns was present as agent.
Peter read a letter from John Stackpole of SHAB with Mr.
Forns' consent. Lucy stated that if approved, this would be
the first pier built in Nantucket Harbor since 1978, when the
Town Pier was built.
Lucy Leske moved to issue Orders adding the following special
conditions designed to mitigate the effect of the pier on the
existing shellfish beds:
1) Length of the permanent section of the pier shall be
shortened to coincide with the demarcation on the plans
of Extreme Low Water.
2) The 8 foot by 24 foot platform at the end of the pier
shall be removed from the plans.
3) The floating dock shall be relocated to a position off
the end of the shortened permanent pier and shall be
removed seasonally.
4) There shall be no filling or dredging of the area
surrounding the pier that would result in destruction
of the eelgrass bed~. Any excavated materials shall be
disposed of offsite.
5) Construction practices shall be consistent with current
standards in Nantucket Harbor.
6) The coastal beach shall be restored to its original
condition after construction. Sediment replenishment
shall be with a similar grain size.
7) Final plans for the project shall be submitted to the
Nantucket Conservation Commission prior to construction.
So voted. Carl Borchert opposed.
b. Winn, Low & Everett - SE48-383. Lucy Leske moved to issue Orders
adding the following special conditions in order to further
protect the interests outlined in the Findings:
1) The widow's walk shall be eliminated from the house
design. The chimney shall be lowered accordingly to
the minimum allowable height according to state building
codes.

2) Revegetation of any areas disturbed by construction
shall consist completely of native vegetation, such
as Rosa rugosa, bayberry, Arctostaphylos uva-ursi,
and beach grass. Because of wildlife habitat consid-
erations, lawns and landscaping shall be prohibited.
3) Siltation fencing shall be relocated on the plans to
a maximum of 12 feet from the building envelope
(including decks).
4) Applicant will provide Conservation Commission with
48-hour pumping data on the well according to DEQE
standards before a Certificate of Compliance will be
issued. Data is necessary to determine if the well
is artificially drawing saltwater into the ground-
water table and adversely affecting private water
supply.
5) Applicant shall submit as-built plans to the Conser-
vation Commission after all foundation pilings are
in place.
So voted. Carl Borchert opposed.
c. Jeanne Berrian - SE48-399. Carl Borchert moved to approve the
project with the following special conditions:
1) Any equipment used to complete this project shall
access the beach area by the public way only.
2) Revegetation shall consist of native species only,
such as Rosa rugosa, bayberry and beach grass.
So voted.
d. Porter Cliff Realty Trust - SE48-398.
issue a standard Order of Conditions.
Carl Borchert moved to

e. S/J Wauwinet Trust - SE48-392. Lee Dunn moved to change the
wording in Article #23 of the Orders of Conditions to a
$250,000 letter of credit to be required at the recommendation
of Town Counsel. Carl Borchert abstained from voting.
David Stein's letter of March 19~1987 regarding the opening of
the Public Hearing to consider alternative II Orders of
Conditions was read.
So voted.

4. Certificates of Compliance
a. Robert Elliot - SE48-361. Lee Dunn moved to send a letter
requesting 12 more shrubs be planted before a Certificate of
Compliance will be issued. So voted.
b.
Richard Steadman SE48-76.
a Certificate of Compliance.
Carl Borchert moved to re-issue
So voted.
5. Other Business
a. Ed Deenehy - Sconset Bluff. Plans for revegetating a home
owned by Mike Bloomberg were discussed.
6. Planning Board Referral
a. Harriet Ward - Old South Road. Carl Borchert moved to send
a letter stating that the work on the subdivision is not sub-
ject to protection under the Wetlands Protection Act.
So voted.
7. Correspondence
a. Jennifer Shakespeare - McIlvain's. Lucy moved to write a
letter to clarify a misunderstanding of some details discussed
on site at the field inspection of December 8, 1986.
So voted.
b. All other correspondence was read.
There being no other business, the meeting was adjourned at 10:00 PM.
