Minutes of March 5, 1987
The public hearings of March 5, 1987 were called to order at 7:30 PM. Members
present were: Peter Dunwiddie, Carl Borchert, Lee Dunn, William Willet and
Donald Visco. Members absent were Maryjane Williams and Lucy Leske.
A. Public Hearing
1. Thomas Taylor - SE48-397. The March 5, 1987 letter from the Nantucket
Shellfish Advisory Board was read. It is the opinion of that Board
that this area around the proposed pier which was seeded with quahogs
six years ago is very significant to fisheries. Karen Powers of SHAB
noted that the major concern of their Board is the precedent that the
building of this pier will have in accepting many piers at a later
date which would severely hurt the ability of the fishermen to tow in
the area.
Mr. Joseph Forns, the agent for the applicant stated that the design of
the pier allows for recreational fishing of scallops and will enhance
the growth of eel grass, therefore enhance the shellfish bed. He
stated that the Commission should not consider denying this project
on what piers might go up in the future but make their decision on
the application before them. Regulations regarding piers would need
to be added to the town By-law if the Commission wants to control
the building of piers in Nantucket.
Lee Dunn moved to close the hearing. So voted.
2. Winn, Low & Everett - SE48-383. Michael Bachman was present as the
agent. House plans showing a design that steps up to a maximum
height of 26 feet were shown to the Commission.
Carl Borchert expressed his concern with the impact this house will
have on the views in the area. Lee Dunn expressed his approval of
the design stating that the applicant had adequately addressed the
concern voiced by the Commission in previous hearings. William Willet
moved to continue the hearing for square footage including decks
calculations. So voted.
3. Jeanne Berrian - SE48-399. Donald Visco moved to close the hearing.
So voted.
4. SjJ Wauwinet Trust - SE48-399. William Willet moved to reopen the hear-
ing so that Donald Visco and Lee Dunn who were absent during the past
public hearings would be able to vote on the Orders of Conditions. Carl
Borchert again removed himself from the public hearing.
Letters from Marion Morton and Louis Ames were read.

Melissa Philbrick, David Stein, Tina Coughanowr and John Sullivan
were present as representatives. Information regarding the septic
system and removal of buildings on alternative #2 were submitted.
Perc test calculations were also submitted.
Donald Visco stated that any relocation of buildings must have the
septic system approved by the Board of Health to meet Title V.
Engineers from Daylor Consulting Group, Less Smith and Matt Naparala
were present and submitted their drainage analysis. Their calcula-
tions show that there would be an increase of storm water runoff.
Hr. Sullivan argued that there would not be a significant change in
the amount of runoff.
Peter asked that the Daylor Consultants provide more evidence that
there would be a significant change than what the applicants have
shown before he can require more information from them.
William Willet moved to close the hearing. So voted.
5. Beach Box Trust - SE48-400. Carl Borchert moved to continue the
hearing with the consent of John Shugrue, the agent for the appli-
cant.
William Willet moved to issue an enforcement order to Design Associates
and Beach Box Trust for work that was done at Hallowell Lane without
a valid Order of Conditions.
6. Porter Cliff Realty Trust - SE48-398. Bob Emac was present as the
agent. Richard Glidden was present as the applicant's attorney.
The applicant wishes to construct a stone-lined drainage ditch.
Lowden Langley of DEQE suggested using
the stone rather than grass sheeting as gullies would probably occur
because of the slope. Peter wants the area vegetated with grass. Lee
Dunn moved to close the hearing. So voted.

7. Walter J. Cairnes - 119 Baxter Road. The hearing was continued for
a file It.
8. Walter Cairnes - 82 Baxter Road. Carl Borchert moved to continue
the hearing for a file # and to revise plans showing the relocation
of the steps so that the deck is 25 feet from the edge of the wetland
and the siltation fence is 23 feet. So voted.
9. Richard, Everett & Jackson - the hearing was continued for a file #.
B. Regular Meeting
1. Lee Dunn moved to accept the minutes of February 19, 1987 as written.
So voted.
2. Request for Determinations
a. Amos B. Hostetter - Carl Borchert moved to issue a negative
determination adding that no work shall be done within 25
feet of the wetland.
3. Orders of Conditions
a. Beverly Hall - SE48-393. Glenn Wills was present as the
agent. The Commission requested that a two week extension
be granted to them so that they can contact Beverly Hall
to scale down the house to reduce the impact the project
will have on scenic views and wildlife in the area. Mr. Wills
stated that he could not grant the extension as he was unable
to reach Ms. Hall for permission.
Carl Borchert moved to deny the project adding:
1) This notice of Intent is denied under the Nantucket
Wetlands Bylaw for the following reasons:
a. No mitigating measures are outlined in plans
to reduce destruction of wildlife habitat.
b. No mitigating measures are outlined in plans
to reduce destruction of the wetlands scenic
views. Views are taken to be from Tennessee
Avenue and Hither Creek.

2) Denial of this Notice of Intent does not prevent
the applicant from filing new plans at any time
in the future.
Donald Visco opposed. So voted.
b. Frances Perelman - SE48-394. Lee Dunn moved to issue Orders
of Conditions adding:
1) The silt fence on the plans shall consist of
continuous staked haybales installed prior to
excavation and maintained in good condition
throughout construction and until vigorous
ground cover has been established sufficient to
prevent erosion.
2) There shall be no cutting of vegetation east of
the silt fence location during or after construc-
tion. An undisturbed vegetated buffer as shown
on the plans shall be maintained to perpetuity,
as the Commission feels such a border is necessary
and sufficient to adequately protect the interests
of both the Nantucket Wetlands Bylaw and the
Massachusetts Wetland Protection Act.
c. John & LewisGreenleaf - SE48-395. Donald Visco moved to issue
Orders of Conditions adding:
1) The recontructed bulkhead return will be no
higher or longer than the existing return. Length
will not exceed 35 feet, the length of the exist-
ing structure.
2) Snowfencing will be in place as shown on plans
prior to beginning work, and will be maintained
in good repair until completion.
3) Revegetation with native beachgrass will be per-
formed as described on the plans. Unsuccessful
plantings will be replaced.

d. S/J Wauwinet Trust - William Willet moved to issue Orders
of Conditions showing the adaptations to Lucy Leske's orders
submitted by Melissa Philbrick and marked as Holly's copy in the file.
There being no other business the meeting was adjourned at 11:15 PM.
