Porter Cliff Realty Trust Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of February 19, 1987 The public hearings of February 19, 1987 were called to order at 7:30 p.m. Members present were: Lucy Leske, Peter Dunwiddie, Lee Dunn, Carl Borchert, William Willet and Donald Visco. Members absent were: Maryjane Williams. A. Continued Meeting of February 12, 1987 1. Lee Dunn moved to approve the minutes of January 22, 1987 . So voted. 2. Other Business a. Hempleman - Stuart Steele - SE48-273. The dune that was located in front of the house is gone and the owners are using under the house as a driveway. Lee Dunn moved to write Mr. Hempleman notifying him that he may be in violation to Orders of Conditions and request him to replenish and repair the dune, supply existing elevations of the house and surrounding dune area. B. Public Hearings of February 19, 1987 1. Wannacomet Water Company - SE48-391. David Worth was present as the agent. Mr. White's letter and plans regarding how he intends to cross Long Pond were submitted. Construction method will be a box trench installation. Rip-rap retaining measures along the bank will be temporary. The Commission asked to reserve the right to inspect the rip-rap at a later date and replace it with a more suitable material. No work in the stream or on the banks will be allowed to take place between March 15, 1987 and May 30, 1987, during the Herring and other fish runs. Carl Borchert moved to close the hearing. So voted. 2. Frances Perelman - SE48-394. Glenn Wills was present as the agent. The house has been moved 10 feet closer to Wauwinet Road. The haybRle line has been moved. No brush is to be cut past 30 to 35 feet. Lucy Leske moved to close the hearing. So voted. 3. John & Lewis Greenleaf - SE48-395. Bob Emack presented contours of the dune. The dune will be returned to original grade. The Commission was Town of Nantucket Conservation Commission (/Jiln Town and County Building Nantucket, Massachusetts 02554 concerned with the 11 foot elevation. Lucy Leske moved to close the hearing. So voted. 4. Thomas Taylor - SE48-397. John Stackpole, president of SHABB along with other members of SHABB were present. Mr. Stackpole stated that weather conditions did not allow for a viewing of the shellfish conditions in the area. He requested that the Commission continue the hearing for another two weeks so that SHABB would be able to look into the area. Lucy Leske moved to continue the hearing for further information. So voted. 5. Winn, Low, Everett - SE48-383. At the applicants request Lucy Leske moved to continue the hearing. So voted. 6. Richards, Everett & Jackson - Lucy Leske moved to continue the hearing for a file number. So voted. 7. Jeanne Berrian - Glenn Wills was present as the agent. The applicant is replacing a bulkhead. Revegetation is to be done with indiginous species plus grass. The backhoe will come in from a public way next to Chuckrow's property. Lucy Leske moved to continue the hearing for a file number from DEQE. SO voted. C. Regular Meeting 1. Carl Borchertmoved to accept the minutes of February 12, 1987. So voted. 2. Request for Determination a. Harvey Pastan - The field inspection report was read. Lucy Leske moved to issue a negative determination. The work is located in a buffer zone but will not alter an area subject to protection. So voted. b. Brent Young - The applicant proposed a parking lot within 20 feet of a wetland. The field inspection report was read. Lee Dunn moved to issue a positive determination. The work is in a buffer zone and will alter an area subject to protection, therefore any work requires filing a Notice of Intent. c. Pleasant Street - Carl Borchert read the field inspection report done Town of Nantucket Conservation Commission Town and County Building '7 _ \ Ci\ -1;1- Nantucket, Massachusetts 02554 C- at the request of Phil Shea of the DPW. The Commission made an informal determination that there are no wetlands in the area across from the Davis Building. 3. Certificate of Compliance a. Robert Elliott - SE48-361. Glenn Wills was present as the agent. Mr. Elliott feels that his plantings have fullfilled the requirements of the Orders of Conditions. The Commission feels that shruby vegetation of indigenous species was asked for when revegetating the bank. Lee Dunn is to view the site again. 4. Orders of Conditions a. S/J Wauwinet Trust - SE48-392. Melissa Philbrick and Tina Coughanowr were present as the agents. Carl Borchert removed himself from the meeting,~stating that he had a conflict of interest. Lucy Leske reviewed her notes on the proposed Orders of Conditions bring up a few points that had not been addressed at the last hearing concerning alternative plan II. Lee Dunn and Donald Visco expressed concern with opening and closing the hearing in one evening without giving them a chance to be involved in the hearing process. Donald Visco questioned the use of leaching catch basins in Wauwinet and the adequacy of existing septic systems to the small buildings located on the site. Lucy Leske requested that Orders of Conditions be issued at the next meeting at which time she will have a draft Orders of Conditons pre- pared. So voted. b. Beverly Hall - SE48-393. Members of the Commission voiced their concerns with 1) building in the 100 year flood zone and 2) The scale of the project and the impact it will have on wildlife and scenic views. Richard Lane - SE48-396. John Shugrue was present as the agent. Donald Visco moved to issue Orders of Conditions adding: 1) Maximum height of the house shall be 22 feet above existing grade at the grade's lowest elevation. 2) Total footprint of the house and attached buildings, garages, decks, steps, patios, etc., shall not exceed 4000 square feet. 3) No lawns shall be constructed between the house and the coastal bank. Revegetation of disturbed areas between house and bank shall consist of native and indigenous shrub and grass species. 4) Construction line shall be limited to the line of snowfencing as delineated on submitted plans. No construction activity shall take place beyond this line. 5) No coastal revetment clause. 6) The applicant shall submit written certification by a registered engineer as to the height of the house as soon as the ridge pole or its equivalent has been installed. d. Wannacomet Water Company - SE48-391. Lucy Leske moved to issue Orders of Conditions adding: 1) Construction and installation of the pipe under the stream shall proceed immediately. No work in the stream or on the banks will be allowed to take place between March 15, 1987, and May 30, 1987, during the herring and other fish runs. 2) Rip-rap retaining measures along the bank will be temporary only. The Conservation Commission reserves the right to have rip-rap removed at a later date and replaced with a more suitable material at the applicant's expense. 3) Any dewatering that occurs during construction shall not adversely affect water quality of the stream and pond. Excess water and excavated material shall not be pumped back into the stream or pond but disposed of or stored off-site. 4) Construction method used shall be a box-trench installation as show on Section A-A, submitted 19 February 1987. Mike Lamb - $24,000 2). ARC Corp. - $9,500 3). Frank Powers - $12,960 4). Toscana Corp. - $9,400 Lee Dunn moved to accept Toscana's bid and to require a Certificate of Insurance. So voted. There being no further business the meeting was adjourned at 11:15 p.m.
