Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 '? \ Minutes of February 12, 1987 The public hearings of February 12, 1987 were called to order at 7:30 p.m. Members present were: Carl Borchert, Lucy Leske, Peter Dunwiddie and William Willet. Members absent were: Lee Dunn, Donald Visco and Maryjane Williams. A. Public Hearings 1. Wannacomet Water Company - SE48-391. Carl Borchert moved to continue the hearing as no representative was present. So voted. 2. Thomas Taylor - SE48-397. Mr Joseph Forns was present as the agent. The project calls for a 130' pier. No dredging? is required for the project and the pier is designed to allow access underneath for shell- fish fisheries. The pier is 130 feet long to get the depth for a boat. At low tide the depth is now three feet. The deck is above grade to allow sand movement. The Commission discussed the blowout area behind the bulkhead. Lucy Leske moved to continue the hearing for a statement from the Shell- fish Advisory Board on any affect this project might have on shellfish fisheries. So voted. 3. Richards, Everett & Jackson. Mr. Joseph Forns was present as the agent. Plans showing existing shorefront conditions revised on January 8, 1987 were submitted. Mr. Forns stated that the emergency repairs allowed by the Commission are almost complete. The return is about to be completed and the gabion mats are there ready to go in. Mr. Forns stated that the groins are needed for structural soundness and will protect the stability of the dune. Lucy Leske moved to continue the hearing for plans requested by DEQE and for a file number to be issued by DEQE. SO voted. 4. S/J Wauwinet Trust - SE48-392. - Melissa D. Philbrick, attorney for the applicant was present. She introduced David Stein, the project manager, Tina Coughanowr of IEP and John Sullivan of Geotechnical Group. Ms. Philbrick explained that two plans have been submitted for the Commission to review. The applicnat wishes to use Plan B but has approval Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of 2/12/87 ~L from the Zoning Board of Appeals for Plan A. Plan B is to be presented in late February to the Zoning Board of Appeals. The applicant requests that the Commission approve both plans so that a building permit may be obtained. Tina Coughanowr reviewed Exhibits C1 and C2 describing the site and proposed activity. A twenty-five feet buffer zone with a five feet wide vegetated buffer zone is proposed to protect the wildlife interests. Mr. John Sullivan of Geotechnical Group stated that under fifty cubic yards of fill will be used in the vegetated buffer zone to even center grade. The maximum slope is 2 to 1, with most being a 3 to 1 slope. There was discussion about the pipe that was unpluged on Marion Morton's property which leads from the swamp area. When the ice and snow that plugged the pipe were removed the water in the swamp lowered. The Commission was concerned that if the pipe was opened or enlarged, the make up of the wetland would change drastically. Mr. David Stein noted that the pipe is not located on Wauwinet Trust property and they have no plans to do anything to the pipe. Dr. Dunwiddie was concern with the easy access from the parking lot to the pipe and the potential benefit that abbutters would have if the ditch was opened. Mr. Nelson Jones an abbutter of Wauwinet Trust stated that the culvert was put in by the DPW in 1972 and had been maintained up until five years ago. The Commission decided to write Marion Morton and the DPW stating that any activity regarding this culvert requires filing of a Notice of Intent with the Conservation Commission. Tina Coughanowr discussed the use of SPC Oil Sorbent instead of oil separators. Information on the Oil Sorbent and a piece of the sorbent were presented to the Commission. Ms. Coughanowr stated that in order to preclude direct runoff and siltation from the parking area into the wetland curbing, haybales and a perveous surface consisting of three inches of crushed stone overlying twelve inches of gravel are proposed. Mr. Theodore Tillotson, attorney for the abbutters questioned Mr. Borchert's inconsistency of concern about pollution caused by oil runoff from parking lots for this project compared to the Nantucket Commons Trust project. Mr. Tillotson also questioned the ethics of a colleague of Mr. Vaughan's representing a client before a Town Board. Mr. Borchert stated that he felt he was being consistent in that S/J Wauwinet Trust's pervious parking lot and the measures outlined in the Notice of Intent adequately protect the interests. Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of 2/12/87 page 3 Ms. Filbrick stated that the Legal Division of the State Ethics Commission has determined that the representation of private clients before Town Boards by Edward Foley Vaughan, his Partener, or Associates does not constitue a conflict of interest under Massachusetts law. Mr. John Sullivan stated that a copy of the results from the oil or hazardous waste water quality test done for Title Insurance would be sent to the Co~~ission. Lucy Leske moved to close the hearing with the understanding that Plan A would be approved by the Commission and a letter would be sent to the applicant stating that Plan B is not a significant change and does not require the filing of a Notice of Intent. All were in favor. So voted. 5. Beverly Hall - SE48-393. Glenn Wills was present as the agent. Mr. Sasha Illich, the architect for the applicant was also present. Mr. Wills submitted modifications to the plan. The dwelling and siltation fence have been moved further from the edge of the wetland. The siltation fence is located 26 feet from the edge of the marsh, the closest corner is a porch located 31 feet from the edge with the closest corner of the house located 34 feet from the edge. The sewer system was rebuilt in 1983 to accomodate a three bedroom house. The new addition is 1800 square feet. Plans now show the relation of the six to seven feet high woody vegetation to the wetland and the house. Mr. Wills stated that none of the shrubs will be removed and this provides protection to the wildlife interests of area. Lucy Leske moved to close the hearing. Foundation plans are to be in the Orders of Conditions. William Willet seconded the motion. Carl Borchert abstained from voting. So voted. 6. Frances Perleman - SE48-394. Glenn Wills was present as the agent. Revised plans were submitted showing the high bush line. Mr. Wills stated that the applicant does not propose a lawn in front of the house. So voted. 7. John & Lewis Greenleaf - Bob Emack was present as the agent. Mr. Green- leaf has requested a fourty foot extention to his bulkhead. Carl Borchert moved to continue the hearing for contour maps of the dunes and a file number from DEQE. Mr. Robert Bolling, an abbutter is to be notified that repairs to existing bulkheads are allowed by the law. So voted. 8. Richard Lane - SE48-396. John Shugrue was present as the agent. The footprint of the house is to be 4000 square feet. The maximum height of the saltbox will be twenty-five feet from the existing ground elevation. No vegetation on the water side of the house will be disturbed and no lawn will be allowed in the front of the house. Snow fencing will be the limit of construction. Lucy Leske moved to close the hearing. So voted. 9. Winn, Low and Everett - SE48-383. Mrs. Collie an abbutter was present to voice her opposition to this project. Lucy Leske moved to continue the hearing at the request of the applicant. So voted. B. Regular Meeting 1. Other Business a. Daneille DeBenedictus - SE48-340. Peter Dunwiddie read Glenn Wills letter of February 5, 1987. The Commission expressed their dis- appointment in not having a chance to condition the foundation to be a piling foundation as would have been required if they had been notified that a substantial change in plans had come up. Mr. Richard Glidden, attorney for the applicant stated that his client is building a smaller house, further away from the wetland and did not understand at the time that they needed to come before the Commission again after approval from the Building Department to make the changes.
