Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of January 22, 1987 The public hearings of January 22, 1987 were called to order at 7:30 p.m. Members present were: Carl Borchert, William Willet, Lucy Leske, Peter Dunwiddie, Maryjane Williams and Lee Dunn. Members absent were Donald Visco. A. Public Hearings 1. Winn, Low and Everett - Michael Bachman was present as the agent with Robert Daylor present as a consultant. Cross section plans were submitted. The location of the septic and well were reversed and raised. Mr. Daylor stated that all grading for sewer is in the upland area above the 100 year flood line. The system is located 150' from the marsh and 155' from the edge of the wetlands. All activity will be away from the dune except the house which will be on pilings. Dr. Dunwiddie noted the value of the marsh for wildlife including the short eared owl seen during the site viewing. There was discussiQD~. about the impact that a house will have on the scenic views of the area. The Commission suggested that the applicant limit the total square footage of the footprint of the house including decks to 1500 sq. ft. and limit the height of the house to 25' maximum average. Mr. Bachman requested that the hearing be continued to meet with the applicant for a footprint and house design. Lucy Leske moved to continue. So voted. The Commission noted to bring up the lawn at the next hearing. 2. Town of Nantucket - Madaket Bike Path - SE48-388. Mr. Greg Bakus of Vanesse/Hangen was present as the agent. Carl moved to close the hearing. So voted. 3. Richards, Everett and Jackson - Bill Willet moved to continue the hearing as no representative was present and a file number had not been issued. Wauwinett Trust - At the request of the applicant, Maryjane Williams moved to continue the hearing. So voted. 5. Wannacomet Water Company - SE48-391. Lucy Leske moved to continue the hearing as no representative was present. So voted. 6. Richard Lane - John Shugrue was present as the agent. The field inspection report was read. There was discussion on the impact the house will views in the area. The Commission asked that the house that sprawls rather than having it go up in keep the house at least 50' from the bank. have on the scenic applicant design a the air and to Lucy Leske moved to continue the hearing for sketch plans of the house and a file number from DEQE. SO voted. 7. Frances Perelman - SE48-394. Richard Earle was present as the agent. Lee asked that the house be moved a few feet away from the wetland. Carl moved to have plans showing the 20 feet buffer in relhtion to shrubs. So voted. 8. Beverly ~all - Richard Earle was present as the agent. The Commission question&the septic systems ability to accomodate the new building. Mr. Earle stated that the system is fairly new and will handle the addition. Lee Dunn moved to continue the hearing for the following information: 1. sewer system plan 2. side elevation of addition 3. location of 100 year storm mark 4. information on drainage facility coming out of the house into the marsh. B. Regular Meeting 1. Lucy Leske moved to approve the minutes of January 8, 1987. So voted. Longview Realty Trust - The field inspection report was read. Lucy Leske moved to issue a negative determination checking number one, the area in your request is not an area subject to protection under the act. John Shugrue stated that a Notice of Intent is being completed for the other lot they own in Madaket where a ditch had been filled without a Notice of Intent. Peter stated that the Enforcement order stated that the ditch was to be returned to its original condition. Peter will contact Mr. Glidden regarding this. b. Warren W. Hill - Lucy Leske moved to issue a positive determination checking number one. Sesachacha Pond and the three wetlands located on the property is an area subject to protection under the act, therefore any removing, filling, dredging or altering of that area requires the filing of a Notice of Intent. 3. Orders of Conditions a. Nantucket Commons Trust - SE48-365. Richard Glidden was present as the representative. Lucy Leske moved to use the findings in the denial and the proposed Orders that were submitted and reviewed and revised by the Commission. All were in favor. b. Town of Nantucket - Madaket Bike Path SE48-388. Lucy Leske moved to issue Orders of Conditions adding that the applicant shall move the Madaket Road to the west betweencenter line station 98.50 and Station 101. The bike path shall be constructed on the existing road pavement. No fill shall be used in the wetlands on the east side of the road between these stations to construct the bike path. Before construction of the bike path begins, the applicant shall submit the above changes to the Commission. As built plans will be required before a Certificate of Compliance will be issued. So voted. 4. Planning Board Referral a. Folger Lane - Carl Borchert moved to send a letter to the Board advising them that the Folger Lane subdivision is subject to protection under the act within 100 feet of the ditch. So voted. Gwen Gaillard - Bill Willet moved to give the Gaillards sixty days to remove the fill recently put on her property to create a driveway. The Commission voted to allocate funds to place a split rail fence between Conservation Commission property and Gaillard's;property. Lucy Leske is to write the DPW about the runoff into the storm drain near the Gaillard property. b. Carl Jelleme - SE48-338. John Shugrue was present as the agent. Mr. Shugrue in his letter of January 5, 1987 requested permission to make minor changes in the approved plans without filing a new Notice of Intent. Lucy Leske moved that the changes penciled on the plans and referencedin the letter do not constitue a major change and therefore does not require the filing of a Notice of Intent. As built plans shall be submitted before a Certificate of Compliance will be issued. c. Robert Kaye - SE48-305. Leo Asadorian was present as the agent. Carl Borchert moved that proposed changes submitted were not significant enough to warrant filing of a new Notice of Intent. The applicant may alter location of pipe under driveway to straighten ditch and avoid construction under the tennis court. d. Ron Bamber - Eel Point Road. John Shugrue was present as the agent. Mr. Bamber filled a wetland to construct a road without a valid Order of Condition. The Commission voted that before further work may take place, staked hay bales hall be installed between the road and wetlands to prevent further erosion of road embankments to occur. The filing of a Notice of Intent is required before any further work takes place. The Notice of Intent shall include complete road plans including retaining walls adjacent to wetlands and erosion control measures. e. Carl Borchert moved to submit three articles to the Town Warrent. So voted. f. Warren's Landing - Bill Willet is to look into the acceptance of stumps to the landfill. Lucy Leske moved to require a complete set of revised plans, including access, erosion/siltation control measures, new house plans including decks, and side elevations (cross sections from the pond, through the house, to the top of the bank), by February 5, 1987. At the next meeting of the Commission the members will determine wheter the project requires filing of a new Notice of Intent. So voted. h. Hither Creek Boat Yard - John Shugrue will bring in a copy of the Department of Army Permit showing the location of the disposal area. 6. Correspondence a. Mr. John Greenleafs letter of January 10, 1987 was read. b. Mr. Robert Balling, Jr's letter of January 14, 1987 regarding Mr. John Greenleafs project was read. c. Mr. James F. Lentowski's letter of January 19, 1987 regarding scrap metal dumping and Pond openings was read. There being no further business the meeting was adjourned at 11:00 p.m.
