Code of Massachusetts Regulations ~ ...._- Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of January 8, 1987 The public hearings of January 8, 1987 were called to order at 7:30 p.m. Members present were: Peter Dunwiddie, Carl Borchert, Lee Dunn, Lucy Leske, Donald Visco, Maryjane Williams, and William Willett. A. Public Hearings 1. Winn, Low and Everett - SE48-383. Michael Bachman was present as the agent, with Robert Daylor as a consultant. Mr. Daylor reviewed Arlene Wilson's assesment of the site and plant inventory. 1) road side out - Marsh & grasses 2) transition zone - dune 3) septic and well - upland 4) house site - land subject to flooding The storm of January 2, 1987 Mr. Daylor estimated to be a five to ten year storm. The water on site was at elevation five during high tide and the road was under water. The proposed house will be at elevation eight. Mr. Daylor suggested that the septic system plan be revised. The system should be raised above the 100 year storm. The bottom of the septic should be at seven. The well should be at elevation eight or above. No fill will be required to achieve this height. The septic system is now located 85ft. from the wetland. The proximity of the house to the dune was discussed. The house will be on pilings and no activity will occur to disturb the dune. Peter Dunwiddie questioned the affect this house will have on the scenic view presumption of the Town By-law. Mr. Daylor realizes this is an interest and this house will change the look of things in the area. Peter feels that the public will be shocked when the house goes up. The house is going to be thirty feet high. Michael Bachman requested that the hearing be continued for revised well and septic plan so that maximum distance can be acheived for the septic from the marsh and for a cross section from the wetland to the parking lot. The scenic views presumption is also to be addressed. Lee Dunn moved to continue the hearing. So voted. Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of January 8, 1987 page 2 2. Cochran - ET AL - SE48-385. John Shugrue was present as the agent. He requested that the application be withdrawn. William Willett moved to accept the withdrawl. So voted. 3. Perkins - LaFrance - SE48-386. Robert Em~k WE present as the agent. Mr. Emack presented revised septic and site plans (N764 revised 1/5/87) The revised plans show a split raii fence eight feet out from the building and 25 feet away from the wetland. The new plans take in consideration the expansion area so the house has been moved but is the same distance from the wetland. Lucy Leske moved to close the hearing with the following suggested Orders of Conditions. 1) Parking area to be gravel. 2) Fence located eight feet from the building on the southeast side. 3) Haybales positioned on the fence line. 4) As built plans shall be submitted before a Certificate of Compliance will be issued. So voted. 4. Robert Greenhill - SE48-389. Lucy Leske moved to close the hearing. So voted. 5. Nantucket Commons Trust - SE48-365. Mr. Philip Notopoulos was present and submitted revised plans showing (1) enlarged storm water detention basins that have an average depth of 1~ feet at a five to ten year storm and three feet during a 100 year storm. (2) leaching fields near the buffer zones have been deleted from plans with one exception which is located 90 feet from the wetland. There are dry wells to catch roof runoff which do not leach located in the buffer zone. Enlarged plans Qn-,- how water goes from catch basins to oil separators to detention basins were submitted. Mr. Sarvis explained that berming the basins would cause two problems 1) it would cause an intrusion into the wetland and 2) if water backs into the sides it will not go to the organic base to be filtered. A concrete wall will be used to push water down to the organic base to be f i1 tered . Mr. Notopoulos discussed suggested Orders of Conditions, stating that Mr. Buzanoski's construction procedures and Mr. Marcus's replication report which were submitted at previous hearings should be used along with a sample Order of Condition he will submit tonight. He also requeste that the $100,000 bond proposed during a previous hearing be reduced to $50,000 as the amount of work to be done within 100 feet of the wetland Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of January 8, 1987 page 3 had been reduced significantly in the new plans. Mr. Borchert asked Mr. Buzanoski to go through what happens to a drop of water starting on the parking lot. Mr. Buzanoski stated that as the plans show now 50 percent goes to the detention basin and 50 percent goes to the catch basins. Mr. Buzanoski suggests that in the Orders of Conditions it should be stated that either the invert should be raised at the junction or make an adverse slope pipe raised to 9.2 feet at the detention basin so that water is directed to the leaching facility rather than the detention basin. The bottom of the detention basin was discussed and Mr. Sarvis stated that a minimum of 12 inches and no more than 24 inches of peat will be at the bottom. The bottom of the leaching facility has been set at 9 at the request of the Commission and Arlene Wilson, to have it one foot above the high ground water mark. Mr. Borchert asked how much of a storm the leaching facility can hold. Mr. Buzanoski stated that the leaching faci1ity alone can handle a five year storm and the leaching and the detention basin combined can hold a 100 year storm. The bottom of the leaching facility has two feet of stone but can be replace with soil. The Commission discussed the replication area and agreed to eliminate the replication area and the silt fence in the north corner of the property. Mr. Daylor recommended that the bottom of basins should not be sealed as you would get and added protection of filtration from the bottom during high ground water levels from heavy rain periods or snow runoff. The bottom of the detention basins will be planted with a conservation Mix. Lee Dunn moved to close the hearing. So voted. 6. Town of Nantucket - Madaket Bike Path - Joseph Magni of Vanesse/Hangen was present as the agent. The legality of easments was discussed with Mr. DeRensis and found to be acceptable. Plans showing the impact area and the Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of January 8, 1987 page 4 square feet of fill to be used were submitted. The area near the second bridge is the only area to be affected. Replication will be done with existing plants. Lucy Leske moved to continue the hearing for a file number to be issued. No further information is required. So voted. B. Regular Meeting 1. Minutes of November 20, 1986. Carl Borchert moved to approve as written. So voted. 2. Minutes of November 25, 1986. Carl Borchert moved to approve the minutes with the following corrections: 1) Page two paragraph one - add after too complicated to do; and would lead to a major change of the plans. 2) Page two paragraph two change: He also stated that enough separation between the bottom of the leach facility to filter heavy metals... 3) Page three paragraph three take out; Flood control was not adequately addressed as no report was done on the velocity of water. Ground water supply is not an issue but .... 4) Page three paragraph five add change the plans drastically and that 5) Page three paragraph six a..<_; Nantucket Land Council Inc. 6) Page three paragraph six b. add enforce; and would be a major change in there is not and ground water ; Orders of Conditions for the applicant should... given by BSC and abbutters and would and after too complicated to write and the plans submitted by the applicant. 3. Minutes of December 4, 1986. Lucy Leske moved to approve the minutes with the following corrections. 1) Page one paragraph four should read; Peter Dunwiddie asked the applicant or his representatives to address the Nantucket By-laws scenic views and wildlife interests. The agent stated that they could not address these interests. 2) Page one paragraph five should read; The agents agreed that viruses and nitrates are known to travel more that 100 feet in sandy soils. Lucy Leske moved to approve the minutes with the following correction on page five paragraph two should read. The applicants own engineers admitted last week that pathogens and viruses are known to travel more than 100 feet in sandy soils. 5. Request for Determination a. Longview Realty Trust - The Commission requested that Glidden and Glidden be contacted to have the lot line staked. 6. Certificate of Compliance a. J. Daniel Lugosch - SE48-378. Lucy Leske moved to issue a Certificate of Compliance. Carl Borchert abstained. All others in favor. 7. Orders of Conditions a. Perkins-LaFrance - SE48-386. Lucy Leske moved to issue Orders adding 1) Parking lot surface will consist of pervious material, such as gravel or shells. 2) Split rail fence will be eight feet from the building as specified on the plans. 3) Hay bales and siltation fence will be constructed to coincide with the split rail fence line up to the parking lot as specified on the plans. 4) As built plans will be required before the Commission will issue a Certificate of Compliance. b. Robert Greenhill - SE48-389. Lucy Leske moved to issue Orders adding 1) a no coastal revetment clause 2) no machinery shall be used during construction of the steps and platform access to Sesacacha Pond. 3) Any disturbed areas shall be revegitated with indigenous species (beach grass, Rosa rugosa, bayberry, etc.) No lawns will be permitted between the deck and the coastal bank. 8. Other Business Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of January 8, 1987 page 6 a. Mary S. Huffman - SE48-384. The Commission voted to approve the change in certificate number on the Orders of Conditions b. John Manning - Hither Creek Boatyard - SE48-296. The Commission voted to approve the change of certificate number on the Orders of Conditions. c. John Greenleaf - The Commission voted to declare a state of emergency on his property on Hulbert Ave. and allow him to (1) tie back recently built return to old bulkhead with creosoled lumber and (2) to fill the old groin with large uneven rocks. The Commission requires a filing of a Notice of Intent by January 22, 1987 for any further work. d. Danielle DeBenedictus - SE48-340. The Commission found that the project which called for renovation and addition to an existing building had been demolished and new construction had been started. The Commission also found that siltation fencing required in the Orders of Conditions had not been used. The Commission requested that a representative for Mr. DeBenedictus address these questions. e. Gwen Gaillard - The Commission voted to issue an enforcement order requireing her to remove thefill on the east side of the house and to remove the refuse on the south side. f. Richards, Everett and Jackson - Glenn Wills was present as the agent. A Notice of Intent has been filed and will be on the agenda for January 22, 1987. Peter Dunwiddie questioned thefour feet wider cut in the dune and the possibility of a blowout being caused by it. Mr. Wills stated that the applicant is considering moving the house back 30 feet to do repairs on the bulkhead. g. Jean Berrian - Glenn Wills was present as the agent and requested that the site be declard an emergency so that repairs could be made to the existing bulkhead. Donald Visco moved to declare this an emergency allowing the applicant to repair the damaged bulkhead by replacing old concrete and stone fill with timbers. The Commission required a filing of a Notice of Intent by February 6, 1987 for any further work. So voted. Peter is to look up the map and parcel number and question the owner of its purpose. i. Woodbury Lane - SE48-312. The Commission is to review the Orders of Conditions regarding requirements during construction as work is about to begin. There being no further business the meeting was adjourned at 11:15 p.m.
