Land Bank Commission October 9, 2007 Page 2 C. TRANSFER BUSINESS: 1. Transfer Hearing Request - No. 28033 Keith P. Brown: Ms. Hunter informed the Commission that Keith P. Brown has requested a hearing on the matter of Land Bank Notice of Assessment dated September 28, 2007. The Commission agreed to schedule a hearing at a meeting to be held on October 23,2007. 2. Transfer Record Nos. 28365 through 28468: The Commission reviewed transfers for the period of September 1,2007, through September 30,2007. a. Transfer Discussion - No. 28445 Murat Aslansan and Kaan Aslansan: Ms. Hunter summarized Record No. 28445 which was a transfer from Murat Aslansan to Murat Aslansan and Kaan Aslansan (brother of Murat) with a claim to the "C" exemption. Ms. Hunter explained that at the time of transfer she had informed the purchasers' representative and the seller, Murat Aslansan, that the transaction was not exempt from the Land Bank fee if the property was conveyed to Kaan Aslansan subject to outstanding mortgages. Nevertheless, the transfer was submitted for processing on September 25,2007. Upon a motion made and duly seconded, it was VOTED that there has been a failure to discharge the Land Bank fee due, to send a Notice of Assessment at 2% of one-half of the outstanding mortgages in place at the time of the transfer, together with accrued interest and penalty. b. Additional Information Required - No. 28380 Moscarillo Family Limited Partnership: The Commission asked staff to request additional information from the purchaser. c. Current "M" Exemptions and Liens: The Commission authorized placing liens against the following properties as a result of the purchasers claiming the "M" exemption as first time buyers of real property: No. 28368 Michael B. Land Bank Commission October 9, 2007 Page 4 G. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was VOTED to go into Executive Session. Each member was polled individually. All members voted yes. The Chairman noted that the Commission would reconvene into regular session and that the purpose of going into executive session was to discuss matters related to land acquisition. RETURN TO OPEN SESSION H. PROPERTY MANAGEMENT (continued): 1. Miacomet Golf Course - Administration Building Discussion: The Commission discussed ideas for the relocation of the golf shop to the newly renovated administration building and asked staff to talk to Mr. Passios about starting the process for obtaining concept plans and estimates for the project. PRESENT: Bartlett, Gardner, Johnson, Reinhard, Stackpole. Minutes of the regular meeting held September 25, 2007: Upon a motion made and duly seconded, it was VOTED to accept, approve, and release the minutes of September 25,2007, as written. A. CITIZEN BUSINESS/ANNOUNCEMENTS: 1. Egan Maritime Foundation: The Director presented correspondence from Jean Grimmer, Executive Director of the Egan Maritime Foundation, thanking the Commission for use of the Land Bank's flatbed truck for moving an historic lifesaving boat. 2. Correspondence: The Director reported that anonymous correspondence had been received commenting on the recent dismissal of Linda Williams as Administrator of the Zoning Board of Appeals. B. PROPERTY MANAGEMENT: I. Miacomet Golf Course: a. Restaurant Update: Mr. Passios provided an update on restaurant activity including winter scheduling and ideas for hosting promotional dinners. b. Instructor Program Update - Year End Review: Mr. Passios reported on a recent meeting with Phillip Truono of Agility Golf to review the 2007 season of Nantucket Golf Academy at Miacomet and to discuss goals and proposed changes for the 2008 season. c. Golf Car Lease Discussion: Mr. Passios provided an estimate for a golf car fleet lease for forty-five, 2006 pre-owned golf cars, with updated technology, at the cost of$32,591.70 annually for six years with an option to include a one-point battery fill system for an additional $1,810.20. The Commission asked Mr. Passios to provide cost comparisons of the proposed lease, the lease of forty- five new golf cars with similar options and the purchase of new golf cars. d. Golf Course Renovations Update: Mr. Passios provided an update on the 9-hole renovation project and summarized Change Order #00 I which if allowed authorizes a cost adjustment for the drainage system on holes #1 and #2. Upon a motion made and duly seconded, it was VOTED to authorize the Director to execute Change Order #001 in the amount of$19,168.20 which will be paid to NMP Golf Construction from Land Bank funds. e. Golf Course Use Request: Mr. Passios presented a request from Maurice Daniel to use Miacomet Golf Course on Sunday, October 21,2007, for a fundraising event for the benefit of the MacLellan family. Upon a motion made and duly seconded, it was VOTED to approve the request as a one-time event for the cost of the greens fees. Land Bank Commission October 9, 2007 Page 3 3. Transfer Update: a. Form B and/or Additional Information Provided: Based upon the additional information provided by the purchasers' representatives, the Commission found the following transfers to be in order: No. 28351 Walter 1. Lee and Karen S. Lee, Trustees of 13 Midland Avenue Realty Trust No. 27990 James W. Klimas, Jr. and James W. Klimas, Sr., Trustees of 6 First Way Realty Trust D. FINANCIAL BUSINESS: 1. Monthly Transfer Statistics: The September 2007 transfer statistics were presented. 2. Warrant Authorization - Cash Disbursements: Upon a motion made and duly seconded, it was VOTED to approve and execute the October 9,2007, warrant document in the amount of $61,207.95 to be provided to the county treasurer. E. REGULAR BUSINESS: 1. Public Notice Review: The Director reviewed public notices received since the last review. No action was taken. F. PROPERTY MANAGEMENT (continued): 1. Cisco Beach Property - Use Request: The Director presented a request from Todor Todorov asking for permission to use the Land Bank's Cisco Beach property as a location for a chair and umbrella rental service. Upon a motion made and duly seconded, it was VOTED to deny the request. 2. Pout Pond Road - Road Maintenance: Resource Planner/Ecologist, Bruce Perry presented the following estimates for filling and grading a portion of Pout Pond Road which travels across the Land Bank's North Pasture property: Holdgate and Colletti Construction, Inc. P&M Reis Trucking, Inc. Island Tool, Rental and Supply $13,000 $ 9,186 $ 7,000 Upon a motion made and duly seconded, it was VOTED to contract for services with P&M Reis Trucking, Inc. as the lowest, responsive bidder. 3. Gaillard Property - Planning Discussion: The Director reported that the lease extension for the residence at the Land Bank's Gaillard property terminates on October 31,2007. The Commission discussed various ideas for the property and the historic building and determined to conduct individual site visits for further discussion.
