2. Transfer Update:
a. Form B and Additional Information Provided - Earle T. Craig and James E. Craig: Based
upon the information submitted, the Commission found the transfer to be in order.
b. Litigation Closed - No. 24457 and 24458 Bahig F. Bishay and Mary T. Costello; and
Bahig F. Bishay, Trustee of Monohansett Realty Trust: Ms. Hunter informed the Commission that
despite Mr. Bishay's threat to appeal the court's decision on the matter, he never actually appealed, so
the litigation is closed due to his inaction.
3. "M" Exemption Update:
a. Two-Year Domicile Noncompliance Fee Paid - No. 26013 Caroline Reilly and
Aisling L. Glynn: Ms. Hunter summarized the transfer and the circumstances which prevented the
purchasers from becoming domiciled at the property. Based upon Ms. Glynn's explanation, prompt
response to the matter and timely payment of the Land Bank fee which became due as a result of events
which she could not have foreseen at the time of purchase, it was VOTED to accept payment of the fee,
to accept future payment of the accrued interest through September 11, 2007, and to waive the penalty.
D. FINANCIAL BUSINESS:
1. Monthly Transfer Statistics: The August 2007 transfer statistics were presented to the
Commission.
2. Warrant Authorization - Cash Disbursements: Upon a motion made and duly seconded, it
was VOTED to execute the September 11,2007, warrant document in the amount of $63,807.71 to be
provided to the county treasurer.
E. REGULAR BUSINESS:
1. Public Notice Review: The Director reviewed public notices received since the last review.
No action was taken.
F. PROPERTY MANAGEMENT:
1. Greene/Codfish Park Property Request: The Director informed the Commission that the
septic system for the house owned by the abutter, Wade Greene, is actually located on Land Bank
property and that Mr. Greene's attorney, Melissa Philbrick, has asked the Commission to allow the
continued use of the existing system. Discussion followed. The Commission was generally in favor
of granting the request for as long as the house is in existence (no future expansion) subject to the
parties entering into a non-recorded licensing agreement satisfactory to Land Bank counsel and the
Commission.
2. Dias/Pilot Whale Drive Property - Encroachment Matter: Mr. Perry reported that Mr.
Travaglione's attorney has suggested that his client may be amicable to settling the matter prior to the
pre-trial hearing scheduled for next week. Based upon a review of total costs associated with the lawsuit

CALL TO ORDER: 4:00 P.M.
PRESENT: Bartlett, Johnson, Reinhard, Stackpole, Gardner.
Commissioner Gardner arrived duringfinancial business.
Minutes of the regular meeting held August 28,2007: Upon a motion made and duly seconded, it was
VOTED to accept, approve, and release the minutes of August 28, 2007, as written.
A. CITIZEN BUSINESS/ANNOUNCEMENTS: None.
B. PROPERTY MANAGEMENT:
1. Miacomet Golf Course:
a. Golf Operations: Charlie Passios provided an update on operations including
course activity, Member Advisory Committee meeting discussions and planning for the 2008
tournament schedule.
b. Golf Course Renovation Update: Mr. Passios reported that construction IS
underway and on schedule.
C. TRANSFER BUSINESS:
1. Transfer Record Record Nos. 28171 through 28244: The Commission reviewed transfers for the
period of August 1, 2007, through August 31, 2007.
a. Form B Not Provided or Incomplete: The Commission asked staffto request a completed
Form B from the following purchaser:
No. 28351 Walter J. Lee and Karen S. Lee, Trustees, 13 Midland Avenue Realty Trust
b. Additional Information Required: The Commission asked staff to request additional
information from the following seller:
Nos. 28334 - 28346 Calm Waters Trust
c. Current "M" Exemptions: The Commission authorized placing liens against the
following properties as a result of the purchasers claiming the "M" exemption as first time buyers of real
property:

and proposed property restoration the Commission determined to settle the matter subject to Mr.
Travaglione's paying restitution to the Land Bank in the amount of$15,000.
3. Bartlett Road Property - Use Request: The Director reported that the Town, by its Board
of Selectmen, has asked the Land Bank to enter into a licensing agreement documenting the
Commission's assent to allowing mitigation for the Town's bike-path project at the Land Bank's
Bartlett Road property. Upon a motion made and duly seconded, it was VOTED to authorize the
Director to sign the agreement.
4. Nobadeer Farm Road - Ballfield Project Discussion: Bruce Perry provided an update on
recent discussions with project consultant Kelly Cardoza regarding the permitting process and
several ideas for mitigation for the project which includes ball fields, paddle courts, bike path, access
road and designation of a "future use" area.
5. Lily Pond Property - Blair House Move: Based upon a recommendation by Mr. Perry,
upon motion made and duly seconded, it was VOTED to hire a structural engineer to design the
foundation plan and move/relocation plan for the Blair house at the Land Bank's Lily Pond property
at an estimated cost of$5,600 for design plans and up to $3,200 for permitting and travel.
G. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was VOTED to go into
Executive Session. Each member was polled individually. All members voted yes. The Chairman
noted that the Commission would reconvene into regular session and that the purpose of going into
executive session was to discuss matters related to land acquisition.
