Operations Update: Mr. Passios provided an update on matters related to professional services provided by Phillip Truono of Agility Golf, the formation of a member advisory group, golf shop staffing and management, and kitchen equipment needs (venting). C. TRANSFER BUSINESS: I. Transfer Record Nos. 27878 through 27980: The Commission reviewed transfers for the period of April 1, 2007, through April 30, 2007. a. The Commission authorized placing liens against the following properties as a result of the purchasers claiming the "M" exemption as first time buyers of real property: No. 27917 Cara Stein No. 27979 Ryan Chadwick No. 27945 Peter F. Psaradelis and Jennifer E. Dubois No. 27957 Michael Gregory Mehringer No. 27979 Napolean E. Landaverde and Kristen M. Landaverde b. Transfer Review Request for Refund - No. 27969 Voyvoda LLC: The Commission reviewed written correspondence from Ken Gullicksen, representative for the purchaser, seeking a refund of a portion of the Land Bank fee paid at the time of transfer. Upon a motion made and duly seconded, it was VOTED to find that the fee was correctly paid on the purchase price stated on the recorded deed and to deny the request for a refund. 2. "M" Exemption Update: a. Five Year Ownership Compliance and Releases of Lien: Upon a motion made and duly seconded, it was VOTED to authorize the issuance of Releases of Lien for the following as a result of the purchasers fulfilling all of the requirements of Section 12, subsection (-m-) of the Act: No. 21785 Timothy J. Davis and Suzanne M. Dyment No. 21831 Karlton A. Phillips and Suzanne L. Riddle No. 21856 Deanna Kaschuluk b. Adjustment Pending - Release of Lien - No. 26005 Wedidit Nominee Trust: The Commission executed a Release of Lien to be provided to the purchaser subject to receipt of the outstanding fee, penalty and accrued interest. 3. Transfer Update: a. Notice of Assessment - Compliance Discussion - No. 25400 Bernadette Maglione: Based upon the purchaser's having provided the requested documentation on April 26, 2007, upon a motion made and duly seconded, it was VOTED to rescind the Commission's vote on April 24, 2007, to send a Notice of Assessment of fee due and to place a lien against the property. Land Bank Commission May 8, 2007 Page 4 G. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was VOTED to go into Executive Session. Each member was polled individually. All members voted yes. The Chairman noted that the Commission would reconvene into regular session and that the purpose of going into executive session was to discuss matters related minutes and land acquisition. RETURN TO OPEN SESSION ADJOURNMENT: Upon a motion made and duly seconded, it was VOTED to adjourn at 6:35 P.M. PRESENT: Bartlett, Johnson, Reinhard. ABSENT: Gardner, Stackpole. AGENDA: Upon a motion made and duly seconded, it was VOTED to accept the agenda of May 8, 2007, as written. MINUTES: Upon a motion made and duly seconded, it was VOTED to accept, approve, and release the minutes of April 24, 2007, as written. A. CITIZEN BUSINESS: None B. PROPERTY MANAGEMENT: 1. Miacomet Golf Update: a. Financial Report: Mr. Passios stated that the monthly financial reports would be sent to the Commissioners in advance to their review and discussion at the Land Bank's second meeting of each month. b. Capital Expenses Payment Clarification: Mr. Passios provided clarification regarding payment of capital expenses and reported that the Commission would be provided with a year-end report detailing capital expenses and fund transfer activity. c. Membership Update: The Commission received a membership update. d. Member Request - Leave of Absence: The Commission considered a written request from Miacomet Golf Club member Chip LaBonte seeking a one year membership leave of absence. The Commission determined that the circumstances prompting the request were not a result of a medical or financial hardship and, upon a motion made and duly seconded, it was VOTED to deny the request. e. Membership Offering: The Commission received an update which included a detailed discussion of the number of persons contacted, declined, and applications pending. f. Facilities Renovation Update: Mr. Passios provided an update on the status of the administration building renovation. g. Course Renovation Update: Mr. Passios reported that the draft contract has been received and is currently under review by NMP Golf Construction Corp. and Moors, Inc. Land Bank Commission May 8, 2007 Page 3 D. FINANCIAL BUSINESS: 1. Monthly Transfer Statistics: The April 2007 transfer statistics were presented. 2. Warrant Authorization - Cash Disbursements: Upon a motion made and duly seconded, it was VOTED to approve and execute the May 8, 2007, warrant document in the amount of$88,91O.21 to be provided to the county treasurer. E. REGULAR BUSINESS: 1. Public Notice Review: The Director presented public notices received since the last meeting. No action was taken. 2. Land Bank Website Discussion: The Director initiated discussion and suggested preliminary ideas and cost estimates to upgrade the Land Bank website. 3. Town of Nantucket Open Space and Recreation Plan: The Director reported that he has been invited to participate in the development of an update to the Town of Nantucket's Open Space and Recreation Plan and that a planning consultant will be gathering public feedback from an open space survey. F. PROPERTY MANAGEMENT: I. Cisco Beach/Miacomet Beach- Use Request: Ben Shelton was present to request permission to sell pre-packaged ice cream from his mobile "ice cream truck" at Cisco Beach and Miacomet Beach throughout the summer season. Upon a motion made and duly seconded, it was VOTED to approve the request and to ask staff to send an approval letter to Mr. Shelton with a copy to the Nantucket Board of Selectmen. 2. Cisco Beach Property - Use Request: After a discussion, upon a motion made and duly seconded, it was VOTED to approve a written request from Gary Kohner, Nantucket Island Surf School, to renew his lease of a portion of the Land Bank's Cisco Beach Property to rent surfboards and provide surfing lessons subject to Mr. Kohner's continuing to provide stewardship of the property, carrying insurance protection for the Land Bank and requiring students and board renters to sign hold-harmless agreements. The lease term shall be one year; the lease amount shall be $3,500. 3. Craig Property - Use Request: The Commission considered a request from Barbara Gookin and Rick Porteus seeking permission for a non-profit community rowing program to use designated areas of the Craig property for the storage of equipment and as a launch site for two 57' rowing shells as part of a high school rowing program scheduled to run from now until the end of June on weekday afternoons between 3: 15 p.m. and 6:00 p.m. Upon a motion made and duly seconded, it was VOTED to approve the request on a temporary basis and to ask the organizers to consider the feasibility of conducting the program at other Land Bank properties which may be more suitable for their use. 4. Sconset Beach Preservation Update:: The Director provided an update on the permitting process and stated that he will be attending the public hearings and will report back to the Commission.
