Equipment Needs Request - Security Cameras: Upon a motion made and duly seconded, it was VOTED to approve the purchase of a security camera system which will include surveillance of the exterior building grounds, the restaurant and pro-shop at a cost of$8,800. i. Member Request - Nantucket Four Ball Team Tournament: Mr. Passios presented a proposal from Miacomet Golf Course member Michael Humphrey to host a team tournament between the three Nantucket golf clubs. The Commission was generally in favor of the proposal. j. Golf Course Maintenance Facility - Abutter Concerns: Mr. Passios notified the Commission of a possible concern from Miacomet Golf Club abutters, Robert and Karen Swenson regarding the visibility of the golf maintenance facility across from their property at 130 Somerset Road and suggested that the purchase and installation of a fence screening the facility from the road might be an appropriate action. 2. Management Contract Extension: Pursuant to a vote on October 25,2005, the Commission executed a contract between the Nantucket Islands Land Bank and Moors Inc. for management services at the Miacomet Gold Club for a period of three years at $100,000 per year. C. TRANSFER BUSINESS: 1. Transfer Record Nos. 26873 through 26950: The Commission reviewed transfers for the period of April 1, 2006, through April 30, 2006. a. The Commission authorized placing liens against the following properties as a result of the purchasers claiming the "M" exemption as first time buyers of real property: No. 26882 Joan K. Skar No.26886 David J. Angelastro No.26898 Matthew G. Wolf and Beverly K. Phillips No. 26916 Elliot S. Sylvia and Sarah Sylvia No.26934 Jose M. Cisneros No. 26948 Lillian Papley b. "M" Exemption Request for Additional Information - No. 26882 Joan K. Skar: The Commission asked staff to send a letter to the purchaser requesting further information regarding the purchaser's fulfillment of the requirement of Section 12, subsection (-m-) to have "at no time prior to said transfer owned or possessed any real property interest." c. Satisfactorily Completed Form B and/or Documentation Not Provided - No. 26947 Bruce H. Poor: Staff was asked to seek a satisfactorily completed Form B. 2. Transfer Update: a. Execution of Release of Lien - No. 25156 Robert Driscoll and Laina C. Driscoll: Based upon the Commission's April 25, 2006, vote to accept the exemptions claimed by the purchasers and to rescind prior determinations of assessment of fee due, upon a motion made and duly seconded, it was VOTED to execute of a Release of Lien to be provided to the purchasers. Land Bank Commission May 9, 2006 Page 4 6. Smooth Hummocks Share 13 - House Move: The Director presented a letter from building contractor Kent J. Murphy seeking permission from the Commission to move a house across the Land Bank's Smooth Hummocks Share 13 property at 1 Heller Way on May 30, 2006. Upon a motion made and duly seconded, it was VOTED to approve the request subject to Mr. Murphy's providing an indemnification letter freeing the Land Bank from any and all liability and agreeing to restore the property to its original condition. G. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was VOTED to go into Executive Session. Each member was polled individually. All members voted yes. The Chairman noted that the Commission would reconvene into regular session and that the purpose of going into executive session was to discuss matters related minutes and land acquisition. RETURN TO OPEN SESSION ADJOURNMENT: Upon a motion made and duly seconded, it was VOTED to adjourn at 6:29 P.M. Driscoll MINUTES Nantucket Land Bank Commission Regular Meeting of May 9,2006 Land Bank Meeting Room, 22 Broad Street Nantucket, Massachusetts CALL TO ORDER: 4:02 P.M. PRESENT: Bartlett, Holdgate, Johnson, Reinhard. ABSENT: Stackpole. Minutes of the regular meeting held April 25, 2006: Upon a motion made and duly seconded, it was VOTED to accept, approve, and release the minutes of April 25, 2006, as written. A. CITIZEN BUSINESS: None B. PROPERTY MANAGEMENT: 1. Miacomet Golf Update: a. Instructor Program Introduction: Mr. Phillip Truono of Agility Golf was present to introduce himself to the Commission, express his excitement to be a part of Mia comet Golf Club and make himself available for any questions the Commission might have. b. Membership Extension Request: Charlies Passios presented a request from Brian Pluff to extend his leave of absence and to suspend his 2006 membership due to medical reasons. Upon a motion made and duly seconded, it was VOTED to approve the request based upon circumstances of extraordinary hardship. c. Membership Offering Discussion: The Commission received an update on the number of member resignations and terminations to date as well as the number of waitlisted parties for memberships. After a discussion, upon a motion made and duly seconded, it was VOTED to offer memberships to all of the seventeen waitlisted parties at a yearly rate $3,600 in addition to a one-time $3,000 initiation fee. d. Operations Equipment Request- Point of Sale Station: Mr. Passios presented a request to purchase a point of sale station and a printer at a total cost of $2,309 to be located at the "snack shack". Upon a motion made and duly seconded, it was VOTED to approve the request. e. Operations Update: Mr. Passios provided an update on matters related to pro-shop activity, storage fencing completion, ground water monitoring and golf course seasonal readiness. f. Building Renovations: Mr. Passios provided an update on bathroom renovations and zoning issues affecting proposed renovations to the front of the clubhouse. g. Course Renovations: Mr. Passios provided an update on the renovation of the original nine holes and plans to move forward with the bidding process. Land Bank Commission May 9, 2006 Page 3 D. FINANCIAL BUSINESS: 1. Monthly Transfer Statistics: The April 2006 transfer statistics were presented. 2. Warrant Authorization - Cash Disbursements: Upon a motion made and duly seconded, it was VOTED to approve and execute the May 9, 2006, warrant document in the amount of $94,922.72 to be provided to the county treasurer. E. REGULAR BUSINESS: 1. Public Notice Review: The Director presented public notices received since the last meeting. No action was taken. F. PROPERTY MANAGEMENT: 1. Smooth Hummock Advisory Committee (SHAC) Update: Mr. Perry provided an update on mitigation activities as required by the Miacomet Golf Course Conservation Permit including the collection and reporting of data from monitoring plots by Nantucket Conservation Foundation's scientist Rachael Freeman and an intern. Mr. Perry asked the Land Bank to consider funding the intern's cost as part of its 2006 required SHAC expenditures. Upon a motion made and duly seconded, it was VOTED to approve the request. 2. Nobadeer Farm Road Property - Ballfield Design Proposal Review: The Director reported that Gale Associates has submitted a proposal to provide planning and design services for the construction of ball fields at the Land Bank's Nobadeer Farm Road property at a cost of $54,770 plus travel expenses. Upon a motion made and duly seconded, it was VOTED to approve the request. 3. Norwood Farm Trust Property - Barrett Farm Road Abutter: The Director summarized past events and recent incidents involving the property abutter to the Commission's Norwood Farm Trust property, Robert Cirillo. Mr. Savetsky stated that Mr. Cirillo has removed Land Bank fencing and brush cut Land Bank property without authorization. The Commission asked staff to have the property surveyed and the utility lines located and asked the Director to send a certified letter to Mr. Cirillo and his attorney requesting that Mr. Cirillo make arrangements to reinstall the fence, to replace the mowed vegetation and to relocate the utility lines on his property. 4.22 Broad Street Property - Landscaping Proposal: Assistant Property Manager, Rob Earley was in attendance to present two proposals prepared by Sconset Gardener for the redesign and installation of landscaping at the 22 Broad Street garden. The Commission reviewed the proposals and upon a motion made and duly seconded, it was VOTED to approve "Plan B" at a cost not to exceed $6,000. 5. Cisco Beach Property - Nantucket Island Surf School: The Director presented a letter from Nantucket Island Surf School owner Gary Kohner asking the Commission to reconsider its prior decision to increase his lease of a portion of the Land Bank's Cisco Beach property for the 2006 season from $2,500 to $4,500. Upon a motion made and duly seconded, it was VOTED to amend the lease amount to $3,500.
