Transfer Record Record Nos. 27126 through 27191: The Commission reviewed transfers for the period of July 1, 2006, through July 31, 2006. a. Current "M" Exemptions and Liens: The Commission authorized placing liens against the following properties as a result of the purchasers claiming the "M" exemption as first time buyers of real property: No. 27126 Carlos W. Phillips and Bridgett Bloise-Phillips No. 27139 Bonnie L. Brooks and Jeffrey Lema No. 27143 Christine D. Carpenter No. 27147 Ryan H. Conway No. 27152 Volney O. Sinclair, Donna M. Sinclair, Carmen R. Davis and Julian Robinson No. 27191 Kai Hodge and Aisha Hodge b. Additional Review and Request for Information - No. 27187 John C. Merson and Carol S. Bunevich: Staff was asked staff to seek additional information and/or documentation regarding the above referenced transfer in order to determine compliance with the Land Bank Act. D. PROPERTY MANAGEMENT: 1. Miacomet Golf Update: a. Operations Update: Mr. Passios reported of received anonymous patrons' comments (secret shoppers) regarding the appearance, customer service and scheduling services of the golf club pro shop, restaurant and course. The comments were favorable. Commissioner Bartlett joined the meeting at this time. b. Private Functions Request Discussion: The Commission discussed requests for private functions at the Miacomet Golf Club and determined not to consider requests for functions between Memorial Day weekend and Columbus Day weekend. c. FacIlities Update - Course anOBTIildings Improvements: Mr:-PasslOs provided an update on the status of the renovation to the men's bathroom, the development of improvement plans for the administration building and presented copies of the letter and map filed with the Secretary of Environmental Affairs seeking approval for the renovation of the course. d. Operations Equipment Request - Telephone System: Mr. Passios presented a request to purchase a new telephone system at an approximate cost of$11,550 not including the labor and installation costs. Upon a motion made and duly seconded, it was VOTED to approve the request at a cost not to exceed $13,000. .. Land Bank Commission August 8, 2006 Page 4 H. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was VOTED to go into Executive Session. Each member was polled individually. All members voted yes. The Chairman noted that the Commission would reconvene into regular session and that the purpose of going into executive session was to discuss matters related to approval of the minutes and land acquisition. RETURN TO OPEN SESSION ADJOURNMENT: Upon a motion ma nd duly seconded, it was VOTED to adjourn at 5:35 P.M. Attested to: Allen B. Bunevich MINUTES Nantucket Land Bank Commission Regular Meeting of August 8, 2006 Land Bank Meeting Room, 22 Broad Street Nantucket, Massachusetts CALL TO ORDER: 4:03 P.M. PRESENT: Holdgate, Johnson, Reinhard, Stackpole, Bartlett. Commissioner Bartlett joined the meeting during Property Management. Minutes of the regular meeting held July 25, 2006: Upon a motion made and duly seconded, it was VOTED to accept, approve, and release the minutes of July 25, 2006, as written. A. CITIZEN BUSINESS/ANNOUNCEMENTS: None. B. PUBLIC HEARING: 1. Proposed Rules and Regulations Amendments: Pursuant to Section 14 of the Land Bank Act, the Commission held a public hearing for the purpose of receiving comment on proposed amendments to the Nantucket Land Bank Commission Rules and Regulations. No members of the public were present. The Chairman opened the hearing. Commissioner Stackpole waived a reading of the proposed amendments. There being no comment or discussion, upon a motion made and duly seconded, it was VOTED to close the hearing. Upon a motion made and duly seconded, it was VOTED to adopt the amendments to the Nantucket Islands Land Bank Rules and Regulations as presented and noticed in the July 13th edition of The Inquirer & Mirror to take effect September 1, 2006. 2. Resolution Regarding "M" Exemption: Pursuant to Section 12 (-m-) of Chapter 669 of the Acts and Resolves of 1983, as amended, after a discussion and upon a motion made and duly seconded, it was VOTED to adopt the following: WHEREAS, the Massachusetts legislature passed Chapter 130 of the Acts of 2006, effective July 28, 2006, empowering this Commission to set the value of the "M" Exemption (first time home buyer) on an annual basis; and - ------------WHEREAS;-this-meeting is the-ftrst-r-egtllar-ly-sehedulcd Land~eting- subsequent to the effective date of said Chapter 130. NOW, THEREFORE, be it resolved that commencing on July 28, 2006, the value of the "M" exemption shall be $400,000. We determine that said sum is reasonable in light of the current prices for residential real property in the Town and County of Nantucket. Land Bank Commission August 8, 2006 Page 3 2. Somerset Road Sidewalk Project Discussion: The Director reported that two bids have been received in response to the Commission's request for proposals as follows: Victor-Brandon Corp. $139,999 Glowacki Paving $132,000 Upon a motion made and duly seconded, it was VOTED to accept Glowacki Paving as the lowest responsive and responsible bidder. E. FINANCIAL BUSINESS: 1. Monthly Transfer Statistics: The July 2006 transfer statistics were presented to the Commission. 2. Warrant Authorization - Cash Disbursements: Upon a motion made and duly seconded, it was VOTED to execute the August 8, 2006, warrant document in the amount of $96,313.09 to be provided to the county treasurer. F. REGULAR BUSINESS: 1. Public Notice Review: The Director reviewed public notices received since the last review. No action was taken. 2. Housing Bank Article Update: The Director provided an update on Senate Bill No. 2555, a bill to establish the Martha's Vineyard and Nantucket housing banks, and reported that based on its defeat in the House of Representatives, town counsel has drafted a separate article to establish The Nantucket Community Housing Bank including amendments to the language of both the housing bank article and the Land Bank Act regarding the transfer of real property interest in a corporation or partnership. G. PROPERTY MANAGEMENT: 1. Beach Use Requests Discussion: The Director asked if the Commission felt comfortable with his approval of beach use requests that are scheduled prior to a meeting review. The Commission determined to allow the Director to approve requests similar in nature to previously approved requests based on his discretion. 2. Dias / Pilot Whale Drive Property - Encroachment Issue: Mr. Perry reported that he had engaged legal council to take action to prevent future encroachment activity by the abutter Richard Travaglione and to recover the costs associated with the restoration of the property. 2. Surfside Beach Naming Proposal: The Director presented a request from an abutter, Tom Quigley, asking the Commission to assign names to the Land Bank beach properties along Nonantum Road in Surfside. The matter was taken under advisement.
