'" WJ Dickson moving and Mrs. Ray seconding. ~ 0\ Beach Manager's Report: v The Town postponed the July 4th fireworks until the 5th. He counted 80 cars-at Nobadeer and 125 at 40th Pole mid-afternoon. Eric Frost, an abutter at 40th Pole, ~ eomplained that there was no signage posted to keep ears offhis property. Mr. Perry suggested that Mr. Frost enter into some sort of agreement regarding cars seeking public access. On the 3rd Mr. Quigley added that there were 50 cars in the new Nobadeer parking lot and 40 alongside its fence; 50 were on the beach but none at the bluff Mrs. Beck concurred. Those present agreed that the numbers were light and that the parking regulations were being observed. Fisherman's Beach parking lot is being graded and filled in. Mr. Quigley asked if the bit of private land there could be given to the Land Bank to extend the lot further. Mrs. Beck mentioned that she had been pressing the DPW for repairs to the steps there for some time. A neighbor reported to Mr. Dickson that cars were on the beach at Jetties from Charles Street. Mr. Quigley asked that the A TV patrols not drive between the newly planted grasses at the bluff at Nobadeer. Mr. Carlson will handle this with the Police Department. Mrs. Ray worried about some A TV driving in the dune grass. The members discussed with Mr. Perry the importance of a single entry and exit access at 40th Pole to keep traffic away from the dunes and the fenced areas on the beach. Mr. Perry noted that as the beach extends in the summer often drivers will pass around the barriers and he has to add more fencing in those spots. Mr. Dickson suggested that Mr. Perry check Polpis Harbor Road beach areas where he heard considerable party noise recently. The police did respond, and finally the partiers dispersed. Mrs. Ray moved we make a map indicating current and/or frequent party sites on island so that the Police Department could readily notify and direct officers to them. The Committee unanimously agreed and will submit sites at the next meeting. Mr. Quigley asked Mr. Perry if the Land Bank fencing at the corner of Lovers Lane and Nonantum Avenue could be repaired. Mr. Perry replied that it would require a $500+ fee permit from the ConCorn. He added that the new Farrell property at Surfside was provoking some problems with an abutter. Mr. Johnson asked about some beach nourishment going on in Madaket, which Mr. Carlson assured him was permitted and approved. BOS Request for BMAC Opinion on Commercial Use of Ponds: The Town Administrator has requested a reply by August 31. Discussion led to the development of a list of points to include in the submission, and members were assigned to research these items. Mrs. Beck offered Assistant Town Clerk Grieder's definition of island pond ownership: that because they are Great Ponds they were defined as such in the early 70's in a dispute over the opening of the ponds to the sea. Nantucket is the only municipality in Massachusetts where this is sanctioned. The state owns the rest. Mr. Carlson and Mr. Perry stated that no general easement around each pond is allowed but that certain ponds have special bits of access, like the Angers Club easement at Maxcy's Pond. In those cases Mr. Carlson believes aceess three rods wide is allowed, and he will check on this. Mr. Perry noted that the Land Bank has access to Miacomet Pond through its west side property. The only public access at Sesachacha Pond is the small parking area offPolpis Road. Mrs. Beck and Mr. Dickson agreed there was no need for a public hearing; that was for the BOS to decide, but that it would be good to advertise that our meeting on August 3 will be taking comment on this issue. Mrs. Ray will ask Peter Brace at the "Independent" for space and Mrs. Beck, "The I&M." Mrs. Beck will e-mail Mrs. Gibson to inform the BOS regarding this date. Mr. Dickson wondered ifpublic activities are allowed at ponds. Mrs. Ray will ask Environmental Officer Belanger. She also recommends that we include in the reply necessary maps, official acts, rules, and etc. for BOS information. Draft of the Annual Report: Mr. Leddy and Mr. Dickson thought it was succinct and pertinent as is; Mrs. Ray asked for one further review just to double check and call it complete next meeting. New Business: Mrs. Beck reminded the members about the Nantucket Beach Foundation's activities. While representing themselves as a non-profit organization offering help with beaeh erosion island-wide and welcoming contributions, it is really a group of Sheep's Pond residents interested in saving their own shoreline.
