HomeMy WebLinkAbout1991-11-12 ,. , BEACH VEHICLE COMMITTEE TOWN AND COUNTY BUILDING NANTUCKET MA 02554 MINUTES OF MEETING NOVEMBER 12, 1991 IN SELECTMEN'S MEETING ROOM Present: Kevin Dale, Debbie Deeley, Chris Lewis, Roland Picard, Bill Sherman, Wendy Watts. Absent: Dave Fronzuto, Ron Glidden, Henry Wasierski. Interim Chairman Kevin Dale opened ~he meeting at 4:30 p.m., noting that the Board of Selectmen had voted Special Municipal Employee status for all committee members. The minutes of the 11/1/91 meeting were approved as distributed. Kevin Dale noted a shift in policy on police response to citizen cumplaints concerning beacQ'vehicle trespasses upon private property. Instead of going forward with a citizen's criminal complaint, Nantucket police will issue the complaint upon a citizen's request. The citizen is still expected to appear at the magistrate's show-cause hearing along with police. The clerk magistrate, in determining whether to issue a citation, will consider the citizen's report of driver identity, when, where and what happened. What is hoped for is a 'level playing field' as between complainant and beach vehicle driver. with a summer-resident complainant, for example, a November show-cause would be prejudicial. An owner's representative, by noting the i.d.'s of beach vehicles entering the 40th pole beach, a trespass, caused a drop in vehicles to 5% of what customarily enter. While large stickers would assist vehicle i.d., the committee now thinks small stickers would be more acceptable and any large ones deferred for a year or so. Small stickers might encourage responsible beach vehicle driving without resort to criminal proceedings. Chris Lewis urged the committee toward an educational program rather than encouraging tickets and lawsuits. Rules for beach vehicles could appear on the proposed map, also on tide charts and other printed material for wider distribution on Island. Upon motion made by Wendy Watts, seconded and passed, the committee voted unanimously to keep the Nantucket area associations currently informed, sending them copies of minutes and inviting their input on beach vehicle questions. Kevin Dale will send a letter encouraging continued exchanges and may be assisted by Wendy Watts in drafting it. Anticipating questions in developing a map to guide beach users, the committee considered access ways in the Eel Point area () ...t :ltl/ , i I 4..- t ! ! ~ 20 - C(( /Cil" A,sf! ftnUL CftL , ~ appropriate for vehicles and for pedestrians-only. Annual map updates are thought necessary to reflect area changes. A Planning staff map, if available at the next meeting, could be marked up by the committee, then checked with area representatives. When the committee is agreed that the draft article is ready for wide public discussion, a large public forum, e.g., in the high school in early January, is envisioned. The hope is to have a broadly accepted bylaw ready for presentation as an article in the Annual Town Meeting warrant and for the FinCom's hearings.
