COMMISSIONERS ADDITIONAL QUESTIONS AND CONCERNS B. EXECUTIVE SESSION: The Executive Session is for Purpose 6 [G.L. c. 30A, 21(a)(6)J. The particular transactions and parcels of real estate are not identified since disclosure of the property information may have a detrimental impact on the Land Bank's negotiating position with one or more third parties; and for Purpose 3 [G.L. c. 30A, 21(a) (3)], discussions concerning strategy with respect to potential and ongoing litigation. The Commission will convene in open session at the conclusion of executive session. 1. Approval of Executive Session Minutes 2. Ongoing Litigation Matters: a. Massachusetts Department of Environmental Protection, Nantucket Islands Land bank, and Nantucket Conservation Commission. MINUTES Nantucket Land Bank Commission Regular Meeting of July 11, 2023 Land Bank Conference Room, 22 Broad Street Nantucket, Massachusetts CALL TO ORDER: 4:00 p.m. PRESENT: Mark Donato, Kristina Jelleme, Neil Paterson, Allen Reinhard, John Stackpole. STAFF PRESENT: Jesse Bell, Executive Director; Susan Campese, Administrator/Finance Manager; Marian Wilson, Assistant Administrator; Rachael Freeman, Director of Environmental and Agricultural Resources; Eleanor Antonietti, Special Projects Coordinator. Hospital Thrift Shop, Executive Director, Mary Casey was also present at call to order. I. CONVENE IN OPEN SESSION: A. PUBLIC COMMENT/ STAFF ANNOUNCEMENTS: 1. Ms. Bell told the Commission there was a high demand to see the Ottison film and she recommended holding a moderated viewing event with a question -and -answer session with the Ottisons at the Dreamland Theatre prior to making the film widely available. The consensus of the Commission was this was a good idea to hold such an event this summer. 2. Ms. Bell confirmed with the Commission that she was setting up a joint meeting with the Select Board to discuss joint projects on August 7, 2023, at the Land Bank conference room. B. AGRICULTURAL BUSINESS: 1.60 Millbrook Road/Apple Orchard — Educational Workshop Proposal: Ms. Freeman presented a request from Orchard Manager, Jordan McHugh to hold a free workshop to teach people about the various trees and the history of the orchard. It would be held sometime in August. The Commission was in favor of the idea. The Inquirer & Mirror, Reporter, Dean Geddes entered the meeting at 4:11 p.m. C. PROPERTY MANAGEMENT: 1. 8 Wesco Place/Lily Pond — Wedding Request (10/14/23): Ms. Antonietti presented a request from Communications/Outreach Coordinator, Emma Kantola to hold her wedding ceremony at the Lily Pond on October 14, 2023, from 2:30 to 4:30 p.m. The ceremony would take about 20 minutes with pictures on the boardwalk after. There will be a non -amplified acoustic guitar I and about 20 chairs and no food or drink served. They expected up to 90 guests who would walk or take ubers to the park and to Lemon Press on Main Street for the reception. Upon a motion made by Land Bank Commission Page 3 July 11, 2023 going on at once and it was time to pause on some of them. Commissioner Jelleme suggested that an overall budget be set to include the design, permitting and construction. She said a designer should be able to design to the budget. Commissioner Stackpole recommended a special meeting in the fall with a pause on all projects. Ms. Bell said that some of the projects that were underway had signed contracts for certain phases which were currently in the process of being completed, such as 19 E. Creek, Washington Street, Easton Street and Lily Pond. Ms. Campese stressed the importance of continuing with at least two of the housing projects for employees. Ms. Bell said the bid package for building improvements she expected to be ready for September. Commissioner Donato said he wanted the housing projects to continue, but thought it was okay to pause projects, even those with contracts so the Commission can reassess priorities and goals. Mr. Freeman recommended sending out a biweekly or monthly update on each project. Commissioner Jelleme suggested that staff put together a paragraph on each project that included the status and timeline to be sent to the Commission the week before a meeting and they would review it and ask for updates on the agenda as needed. Commissioner Stackpole said the message to planning should be to keep it simple and Nantucket in style. Ms. Bell in reference to the Consue Spring project explained that after meeting with David Gray from the Sewer Department, she found out that the Town would not have accurate stormwater data until 2025 for Consue Spring. Ms. Bell recommended getting a proposal from the engineering firm the town uses to expedite the process. Commissioner Jelleme said that Consue Spring would take years to permit, so some of the permitting work could continue while we awaited the town data. Additionally, she recommended reviewing the capital project list to give the staff direction on which projects should be put on hold for now. In reviewing the projects, the Commission said to move forward now with planning for Mill Hill Park; Maxcy Pond; Codfish Park Playground improvements; greenhouse replacement at the community gardens; merging 158 & 160 Orange Street; Aurora Way boardwalk; parking repairs at Holly Farm; dog park lighting; and bathroom renovation at the Munson house. Commission instructed staff to proceed with schematic design for existing contracts including Washington/Francis Street & 19 East Creek Road; to hold off on the Miacomet Bridge and 18t' hole relocation at Miacomet Golf; to move forward with the RFP for designer services for the pickle/paddle/tennis courts; to put Easton Street rain garden out to bid; and to continue with selection of a designer for the bike park project. Commissioner Donato volunteered to sit on the bike park committee. D. TRANSFER BUSINESS: 1. June 2023 Transfers — Record Nos. 45622 through 45681: The Commission reviewed transfers for the period of June 1, 2023, through June 30, 2023. 1. Current "M" Exemptions and Liens: Upon a motion made by Commissioner Jelleme and duly seconded by Commissioner Donato, it was unanimously VOTED to authorize the placing of a lien against the following properties as a result of the purchasers claiming the "M" exemption as first- time buyer of real property: No. 45636 Liliana Kovacevik and Dalibor Kovacevic No. 45650 Ezequiel Portillo Sandoval and Maria I. Pineda De Portillo i 2. Current "O" Exemptions and Liens: Upon a motion made by Commissioner Jelleme and duly seconded by Commissioner Donato, it was unanimously VOTED to authorize the placing of liens Land Bank Commission July 11, 2023 Page 5 suggested using shrubs rather than a fence. Ms. Freeman recommended the Commission view the area for continued discussion at a future meeting. Mr. Geddes departed the meeting at 5: 47 p.m. II. EXECUTIVE SESSION: Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Donato, it was unanimously VOTED to go into executive session in order to discuss the purchase, exchange, lease or value of real property, discuss pending litigation and review and approve executive session minutes. A roll call vote was taken: Donato -Aye; Jelleme- Aye; Paterson -Aye; Reinhard -Aye; Stackpole-Aye. The Chairman under Purpose 6 [G.L. c. 30A, 21(a)(6)] declared that discussion of these matters in open session may be detrimental to the Land Bank's negotiating position; and under Purpose 3 [G.L. c. 30A, 21(a)(3)] for discussions concerning strategy with respect to ongoing litigation. The Chairman further announced that the Commission would reconvene in regular session at the conclusion of executive session. III. RECONVENE IN OPEN SESSION: A. PERSONNEL MANAGEMENT: 1. Executive Director — Annual Review: Chairman Paterson said it was time for Ms. Bell's Annual review. It was the consensus of the Commission for Chairman Paterson and Commissioner Jelleme to meet with Ms. Bell for the review. i Ms. Bell, Ms. Campese, Ms. Freeman, Ms. Antonietti and Ms. Wilson voluntarily departed the meeting at 6:18 p.m. Chairman Paterson and Commissioner Jelleme collected comments from the other Commissioners regarding Ms. Bell and would meet with her to review them. Salary changes would be discussed and voted at a future meeting.
