The particular transactions and parcels of real estate are not identified since disclosure of the property information may have a detrimental impact on the Land Bank's negotiating position with one or more third parties; and for Purpose 3 [G.L. c. 30A, 21(a)(3)], discussions concerning strategy with respect to ongoing litigation. The Commission will not reconvene in open session at the conclusion of executive session. 1. Approval of Executive Session Minutes 2. ADJOURNMENT MINUTES jI Nantucket Land Bank Commission 1 j Regular Meeting of September 13, 2022 Land Bank Conference Room,22 Broad Street Nantucket, Massachusetts CALL TO ORDER: 4:00 p.m. PRESENT: Mark Donato,Kristina Jelleme,'Neil Paterson,Allen Reinhard, John Stackpole. STAFF PRESENT: Jesse Bell,Executive Director; Eleanor Antonietti,Executive Assistant; _ Susan Campese,Administrator/Finance Manager; Marian Wilson, Assistant Administrator; Rachael Freeman,Director of Environmental and Agricultural Resources; John Kuszpa,Director of Property Management. A. CONVENE IN OPEN SESSION: 1. PUBLIC COMMENT/ STAFF ANNOUNCEMENTS: a.Nantucket Preservation Trust—Landscape and Gardens Award: Ms. Bell announced that the Land Bank and Lucile Hays were receiving an award from the Nantucket Preservation Trust recognizing the park design for the Creeks Preserve,the corresponding preservation of the i Orange Street streetscape and views of the downtown waterfront from the'park, increased . 1 i accessibility,reuse of the guest house for year-round housing, and retention of the 'tea house' on the site. The award will be presented on October 22, 2022 at a reception at 34 West Chester Street which the Commission and staff are invited to. 2. PROPERTY MANAGEMENT: a. 32 Western Avenue—Permitting Update: Ms. Freeman presented a design to improve the property by adding a disabled parking space with an accessible wooden boardwalk leading to a deck area with bench seating and connecting to the existing beach stairs. If approved, she would permit the plan with the Conservation Commission along with a request to remove the invasive Love Grass and some of the Japanese Pine trees below the bluff. She pointed out that the boardwalk was designed to be flush with the ground similar to the accessible boardwalk at Settler's Landing. Upon a motion made by Commission Reinhard and duly seconded by Commissioner Stackpole, it was unanimously VOTED to approve the design and move forward with permitting. b. 174 Orange Street/Creeks Preserve—Wedding Ceremony Request(9/17/22): Ms. Antonietti presented a request for a wedding ceremony on September 17, 2022 from 4:30 to 5:00 p.m. for 35-40 people with a flower arch. Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Donato, it was unanimously VOTED approve the request. ! c. 181 Hummock Pond Rd/Gardner Farm—Nantucket High School Cross Country Meets: Ms. Antonietti presented a request from the High School Cross Country Team to hold i • Land Bank Commission Page 2 September 13, 2022 four meets on the property from 3:30 to 5:30 p.m. on September 27th, 301, and October 4th. There will be a small table at the finish line, arrow signs to mark the course, a small tent for shade and a port-a-potty in the parking lot. Ms. Bell said she had already approved the first meet that was taking place today and she had no concerns as the meets went well last year. Upon a motion made by Commissioner.Donato, and duly seconded by Commissioner Stackpole it was unanimously VOTED to approve the request as presented.. , d.Various Properties—Request to Place Cameras on Properties for Climate Change Study: Ms: Freeman explained that a professor from the University of Kentucky through her work with the Nantucket Biodiversity Initiative had received a grant to study the role of phenology in shaping plant invasion under climate change in Nantucket. Ms. Freeman said the cameras were timelapse and not triggered by motion. They would be in place for two years in ten • locations, including six Land Bank properties. She recommended approving the request was the requirement that Ms. Diamond approved the placement of each camera, so it was not visible or facing any trails or walkway. Upon a motion made by Commissioner Jelleme and duly seconded by Commissioner Reinhard,it was unanimously VOTED to approve the as recommended by Ms. Freeman. e. Employee Housing Inventory=Review and Discussion:Ms. Bell presented an inventory of Land Bank housing, including those occupied by golf employees and temporary rentals for seasonal employees. The list also included future housing that was leased back to the seller. Ms. Bell reminded the Commission that staff recommended constructing an apartment in the farmhouse (125 Somerset Rd)basement and adding two additional bedrooms and a bathroom in the attic space of the cottage at Eat Fire Farm(19 Wauwinet Rd). Commissioner Jelleme said she was in favor of adding the apartment and additional bedrooms to the cottage. She felt strongly that if additional workforce,housing was needed the Land Bank should maximize its use of existing buildings before building (or buying) something new. Ms. Bell indicated that an architect recommended certain improvements were necessary to upgrade the house at Burchell, Farm occupied by Ryan Scotto, and beyond that there were several levels of improvements that could make the house more accommodating for a family. The consensus was that the necessary upgrades to the building should be done,but it should not be customized to an individual renter's needs. The Commission asked Ms. Belt and the Golf Capital Committee to review employee housing needs and rents charged with golf management. Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Donato, it was unanimously VOTED to proceed with design and planning for a basement apartment in the Somerset Farmhouse and the addition of two bedrooms and bath on the second floor of the cottage at Eat Fire Spring Farm. 3. TRANSFER BUSINESS: a. August 2022 Transfers—Record Nos. 44814 through 44895: The Commission reviewed transfers for the period of August 1, 2022,through August 31, 2022. (1. Current"M":Exemption and Lien: The Commission authorized the placing of lien against the following property as a result of the purchasers claiming the "M"exemption as first- timeL buyers of real property: Land Bank Commission Page 3 September 13, 2022 No. 44827 Jose E. Rivera Umana, Irma Aguilar Umana, Guadalupe Jasmin Vasquez Tejada and Oscar Alexander Vasquez Merlos 2.'Current"0"Exemption and Lien: The Commission authorized the placing of a lien against the following property as a result of the purchaser claiming the"0" exemption as part of a deed-restricted affordable housing program: No. 44869 Josiah C.Newman Upon a motion made by Commissioner Jelleme and duly seconded by Commissioner Donato,-it was unanimously VOTED to execute and authorize the issuance of Notices of Lien on the above- referenced property. 4. APPROVAL OF MINUTES: Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Reinhard, it was unanimously VOTED to accept, approve, and release the regular session minutes of August 23,2022, as written. 5. FINANCIAL BUSINESS: a. Monthly Transfer Statistics: Monthly transfer statistics reports comparing calendar years 2021 and 2022 through August 2022 were presented to the Commission. b. Warrant Authorization—Cash Disbursements: Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Reinhard, it was VOTED to execute the September 13, 2022, warrant document in the amount of$251,514.41 to be provided. to the County Treasurer. Commissioner Jelleme recused. c. Fiscal Year 2023 Draft Budget—Discussion: Ms. Campese presented the draft budget that had been previously sent to the Commission with a narrative that explained variances from the previous year as well as personnel changes. Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Reinhard, it was unanimously VOTED to approve the budget as presented. { 6. COMMISSIONERS ADDITIONAL QUESTIONS AND CONCERNS: a. Chairman Paterson asked staff to remove the stone pillar with the name Beal at 76 Millbrook Road because it gave the appearance that the public way was a private driveway. II. EXECUTIVE SESSION: A motion was made by Commissioner Stackpole and duly seconded by Commissioner Reinhard to go into executive session in order to discuss litigation,the purchase, exchange, lease or value of real property and review and approve executive session j minutes. A roll call vote was taken on the motion: Mark Donato-Aye;Neil Paterson-Aye; Allen Reinhard-Aye; John Stackpole-Aye. The Chairman declared under Purpose 3 {G.L. c. 30A, Land Bank Commission Page 4 September 13, 2022 7.1 21(a)(3)] and Purpose 6 [G.L. c. 30A, 21(a)(6)] that discussion of these matters in open session may be detrimental to the Land Bank's negotiating position.
