APPROVAL OF MINUTES Draft minutes of Dec. 21, 2022 Unanimously approved, 5-0. CHAIRMAN'S REPORT No report. MARINE DEPARTMENT REPORT: General Marine Department report— Sheila Lucey No report. Mr. Lowell reported that a fisherman had reached out to him that there during a recent storm event, there was no public notice of the Children's Beach tide gate being closed and that there is no other form of notification to commercial scallopers that fishing is closed due to inclement weather other than the red flag flown at the Town Pier. Mr. Szydlowski remarked that there was an announcement on social media that the tide gate would be closed. Mr. Brace and Mr. Pronk confirmed this. NATURAL RESOURCES REPORT General Natural Resources Department report— NRD staff No report. However, Mr. Lowell read a short email message from Town shellfish biologist Tara Riley into the record as follows, "As everyone is just returning from holiday break, unfortunately there are not many updates since our last meeting on 12/21. We are composing the letter for the DMF mooring issue, which I will submit for review prior to the next meeting. As for Ted [Lambrecht's] hearing, my main concern is more with the hearing process and that the damage has already been done to our policies and procedures for dealing with issues such as this. The fact that HSAB and NRD were undermined in this case and that the BOS has created a new precedent making it nearly impossible to deal with any other aquaculture issues on the water. Everyone else will be referencing the Ted's timeline, # of chances given, etc...I wish that the BOS would give more consideration and support to the elected boards and departmental staff providing recommendations. That's it for now!" Mr. Lowell said he supported Ms. Riley's comments on Mr. Lambrecht's situation. . Mr. Brace suggested that the HSAB reaffirmed its vote to revoke Mr. Lambrecht's oyster lease in the Head of the Harbor. Mr. Brace stated his concerns over Mr. Lambrecht not showing up to the Select Board's Dec. 8 continuation of his public hearing in time to speak for himself. Mr. Bossi noted that there were also two improper handling of oyster violations logged against Mr. Lambrecht. PUBLIC COMMENT ON MARINE DEPARTMENT / NATURAL RESOURCES REPORT OLD BUSINESS Preparations for the continuation of Ted Lambrecht's oyster lease revocation public hearing at the Jan. 5, 2022 Select Board meeting The HSAB voted 5-0 to reconfirm its vote recommending that the Select Board revoke Mr. Lambrecht's oyster lease with the Town Excessive sand in scallops/Dredging plan — Discussion No discussion. HEALTH OF THE HARBORS Excessive lawn fertilizer use: Update —Discussion — New information Mr. Lowell asked the board to review the information provide to it by Hillary Rayport at the Dec. 21, 2021 meeting so it could discuss this matter at the Jan. 18, 2022 meeting. FDA shellfish taking prohibition in mooring fields Mr. Lowell noted that Ms. Riley is working on this issue and that she mentioned it in her short email message earlier in the meeting. Water quality testing update and boat holding tank dye tablet distribution No discussion. NEW BUSINESS Joe Minella's fertilizer-ban article - discussion Mr. Brace noted that Mr. Minella did not appear to know his subject matter at all and did not appear to have any data or research to quote on the how and why of fertilizer causing algae blooms in the harbor. Mr. Lowell said he could work with Mr. Minella to help him more effectively get his message across to the public. Coastal Resilience Advisory Board — Update Mr. Brace reported that the Select Board is supposed to adopt the Coastal Resilience Plan at its Jan. 12, 2022 meeting. He added that the Coastal Resilience Advisory Committee (CRAC) was frustrated by the Select Board's decision to wait six weeks from delivery of the CRP to adopt it.
