STAFF PRESENT: Jesse Bell, Executive Director; Eleanor Antonietti, Executive Assistant; Susan Campese,Administrator/Finance Manager; Marian Wilson,Assistant Administrator; Guthrie Diamond,Field Ecologist; John Kuszpa,Director of Property Management. My Grandfather's Farm Owners, Nicholas and Thomas Larrabee were also present at call to order. Days Edge Productions, Film Producer, David Hutchinson; Coastal Resiliency Advisory Committee Chair, Mary Longacre; Sustainable Nantucket("SN") Managing Director, Posie Constable were also present at call to order via zoom. A. CONVENE IN OPEN SESSION: 1.PUBLIC COMMENT/STAFF ANNOUNCEMENTS: Chairman Paterson commended staff on their hard work to adapt and work through almost two years of remote meetings. 2. AGRICULTURAL PROPERTY MANAGEMENT: a. 101 Hummock Pond Road/My Grandfather's Farm—Annual Farm Plan: Chairman Paterson thanked the Larrabees for their well-written and comprehensive farm plan that was in the meeting packet. All Commissioners agreed and were looking forward to seeing the farm progress.Nick Larrabee thanked the Commission and staff for their patience and pointed out that the National Resource Conservation Service ("NRCS")who they were working with was requiring their own wetland delineation which would be completed in April. Unfortunately,the results of that delineation could change the farm plan. He explained that to stay in good standing and be eligible for grants this was required. He said he would apprise the Commission of any changes to the farm plan. Inquirer and Mirror Reporter, Dean Geddes and SN Farmer, Dylan Wallace entered the meeting 4:04 p.m. Nicholas and Thomas Larrabee departed the meeting at 4:06 p.m. Land Bank Commission Page 2 March 16, 2022 3. PROPERTY MANAGEMENT: a. Ladies Beach—Town Lifeguards: Ms.Bell presented a request from the Town of Nantucket for permission to station lifeguards at Ladies Beach for the upcoming summer season. Upon a motion made by Commissioner Reinhard and duly seconded by Commissioner Stackpole, it was unanimously VOTED to approve the request. b. 22 Cathcart Road/Andrews—Signage Proposal: Ms. Bell explained that when she, Chairman Paterson and Commissioner Reinhard had met with the Monomoy Civic Association over issues of parking and beach driving they had all agreed that installing signs that prohibiting unattended vehicles on the beach would be a good idea. This would still allow people who were utilizing the beach to drive and park on the beach, but it would stop people from parking on the beach for the day while they were out on their boats. Commissioner Stackpole recommended the signs be seasonal from June 15th through September 15th. Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Reinhard, it was unanimously VOTED to add signage prohibiting unattended vehicles on the beach between June 15th and September 15th c. 55 Warrens Landing Road/Warrens Landing—Trail Proposal: Ms. Diamond presented an aerial with proposed trails that crisscross the property with scenic viewing areas highlighted. The proposed trail also allowed walkers bypass a portion of the busy road. She said the plan needed to be reviewed by Natural Heritage. Commissioner Stackpole suggested adding a connection from one of the trails down to the water at the northern end of the property as well as expanding the parking area as it was a destination for people to watch the sunset from their cars. Ms. Bell pointed out that both expanding the parking and adding the trail to the water would additionally require Conservation Commission approval and therefore would take more time but could be explored as a second phase in improving the property. Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Reinhard, it was unanimously VOTED to approve the plan and install the trails once approved by Natural Heritage and to further to develop concept plans for expanding the parking and providing an additional northerly trail to the water. d. 48 S. Cambridge Street/Long Pond Landing—Accessible Walkway and Pier Contract Award. Ms. Antonietti presented the following two bids received for the walkway and pier construction at 48 S. Cambridge Street: Robert B. Our Co,Inc. $696,683.00 ACKMarine and General Contracting $804,900.00 Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Reinhard, it was unanimously VOTED to award the work to the lowest responsible and eligible bidder, Robert B. Our Co, Inc., authorizing Ms. Bell to execute the contract on the Commission's 1 behalf. e. Washington Street Corridor—Coastal Resiliency Landscape Planning Proposal: Land Bank Commission Page 3 March 16, 2022 Ms. Bell explained that the proposal was for conceptual landscaping plans for both Land Bank and Town properties and that ReMain Nantucket was paying for one half of the proposal on behalf of the town. She said a committee would be regularly meeting that included herself and Ms. Freeman, Town Coastal Resilience Coordinator, Vincent Murphy, and representatives from ReMain, Scape and the Woods Hole Group. After the work was done there would be a presentation of options for the Commission and Town to consider as they move forward with coastal resiliency measures. Ms. Bell said this is a great example of what will be required as sea levels rise,which is collaboration among stakeholders. Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Reinhard, it was unanimously VOTED to approve the proposal. f. Cisco Beach Concession Process—Discussion: Ms. Antonietti explained that there was no requirement for the beach concessions to be put out to bid as they did not meet the minimum threshold of the procurement laws. Therefore, she would be running a legal notice in the paper for two weeks and she would inform past vendors that letters of interest and applications were due April 8th. She recommended the three licenses' agreements be awarded at the April 12th meeting. This would allow the vendors time to complete all required permits with the Town. She asked if any of the commissioners wanted to be on a committee to review the applications of if they wanted them reviewed at the meeting. After some discussion it was the consensus of the Commission to have Ms. Antonietti email the applications to them prior to the meeting with her notes and comments for their review and discussion at the April 12th meeting. Nantucket Current Editor in Chief Jason Graziadei entered the meeting at 4:32 p.m. g. 8 Wesco Place/Lily Pond—Wedding Ceremony Request(6/11/22): Ms. Antonietti presented the request from Audrey Sterk to hold her wedding ceremony on June 1 1th at 3:00 pm, with minimal set up, and twenty chairs. Ms. Bell said staff had no concerns with the request. Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Reinhard, it was unanimously VOTED to approve the request. h. Land Art Project—Request: This item was tabled to a future meeting when the requestor could be present. i. Cathcart Beach—Filming Request: Ms. Antonietti presented a request from David Hutchinson of Days Edge Productions to film some footage for a documentary about the Mice Against Ticks project on Nantucket. It would be two members of staff with cameras filming Dr. Lepore on Cathcart Beach on April 3rd from 4:30 p.m. to 7:30 p.m. Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Jelleme, it was unanimously VOTED to approve the request upon payment of the $250 administration fee. Mr. Hutchinson departed the meeting at 4:30 p.m. j. 158 Orange Street—Memorial Bench Request: Ms. Wilson presented a request from Charles Graeber to donate a bench with a plaque in memory of Diann Graeber,who was a homeowner for 40 years on the island and died before she realized her dream of retiring on Land Bank Commission Page 4 March 16, 2022 Nantucket. Staff recommended installing a bench by the willow tree at 158 Orange Street. Upon a motion made by Commissioner Reinhard and duly seconded by Commissioner Stackpole, it was unanimously VOTED to accept the donation of the bench in memory of Dian Graeber with exact location and plaque language to be approved by staff. k.Nobadeer Farm Road/Pickle &Tennis Courts—Update: Ms. Bell informed the Commission that the building permits were in hand and site prep work would be starting soon. 1. Equipment Request—Mower of 63 Madaket Road: Mr. Kuszpa requested the purchase of a new John Deere mower that was one foot narrower than the other mowers to be used on the trails at the Peter Folger Homestead property. The boardwalks on the property are too narrow to accommodate the current Land Bank mowers. Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Reinhard, it was unanimously VOTED to approve the request to purchase the mower for the state contract price of$7,432.62. 4. TRANSFER BUSINESS: a. February 2022 Transfers—Record Nos. 44313 through 44362: The Commission reviewed transfers for the period of February 1,2022,through February 28, 2022. 1. Current"M"Exemptions and Liens: The Commission authorized the placing of liens against the following properties as a result of the purchasers claiming the"M" exemption as a first-time buyer of real property: No. 44319 William D. Maines and Meagan L. Malloy No. 44337 Alexandra Moskovitz No. 44342 Joseph Townsend and Johanna Townsend 2. "M"Exemption Update: a. Five-Year Domicile and Ownership Compliance—Release of Liens: A motion was made by Commissioner Reinhard and duly seconded by Commissioner Jelleme to authorize the issuance of Releases of Liens for the following transfers as a result of the purchasers fulfilling all of the requirements of Section 12, subsection(-m-): No. 38264 Carl C. Lindvall and Sarah F. Lindvall No. 38277 William Joseph Sherry, IV and Sherry K. Orr b. Five-Year Ownership Non-Compliance—Payment/Release of Lien: No.39862 Shawn McPoland: Ms. Campese explained that Mr. McPoland was selling his property prior to the completion of his five-year ownership requirement and therefore was going to pay back the fee of$10,000,penalty of$2,500 and accrued interest of$5,183.89. Ms. Campese asked that a i I Release of Lien be authorized to be presented to Mr. McPoland or his representative upon payment of the fee. Land Bank Commission Page 5 March 16, 2022 Upon a motion was made by Commissioner Jelleme and duly seconded by Commissioner Donato, it was unanimously VOTED to execute and authorize the issuance of Notices of Liens and Release of Liens on the above-referenced properties. Ms. Diamond and Mr. Kuszpa departed the meeting at 4:46 p.m. 5. APPROVAL OF MINUTES: A motion was made by Commissioner Stackpole and duly seconded by Commissioner Jelleme, it was unanimously VOTED to accept, approve, and release the regular session minutes of February 8, 2022, as written. 6. FINANCIAL BUSINESS: a. Monthly Transfer Statistics: Monthly transfer statistics reports comparing fiscal years 2021 and 2022 through February 2022 were presented to the Commission. b. Monthly Financial Report: The Commission accepted the January 31, 2022, financial report including the balance sheet and income statement previously provided by email. c. Warrant Authorization—Cash Disbursements: Upon a motion was made by Commissioner Stackpole and duly seconded by Commissioner Reinhard, it was unanimously VOTED to execute the March 16, 2022 warrant document in the amount of$205,336.95 to be 1 I provided to the county treasurer. d. Warrant Authorization—Cash Disbursement 2/25/22 Ratify and Confirm: A motion was made by Commissioner Reinhard and duly seconded by Commissioner Jelleme to ratify and confirm the prior action of executing warrant document in the amount of$104,201.97 to be provided to the county treasurer: Ms. Constable, Ms. Longacre, Mr. Geddes and Mr. Grazaidei departed the meeting at 4:52 p.m. II. EXECUTIVE SESSION: A motion was made by Commissioner Stackpole and duly seconded by Commissioner Jelleme to go into executive session in order to discuss the purchase, exchange, lease or value of real property and review and approve executive session minutes. A roll call vote was taken on the motion: Mark Donato-Aye; Kristina Jelleme-Aye;Neil Paterson- Aye; Allen Reinhard-Aye; John Stackpole-Aye. The Chairman declared under Purpose 6 [G.L. c. 30A, 21(a)(6)] that discussion of these matters in open session may be detrimental to the Land Bank's negotiating position. The Chairman further announced that the Commission would not reconvene in regular session at the conclusion of executive session. ADJOURNMENT: Upon a motion made by Commissioner Reinhard and duly seconded by Commissioner Donato, it was VOTED to adjourn at 5:53 p.m. Attested to: 1...111 John J.
