Call to Order,Approval of the Agenda,Approval of Minutes, and Public Comments. w C') A. Because of a delay by the host, Lee Saperstein, in starting the meeting, Chair Allen Reinhard' ✓ - called the meeting to order at 4:20 pm. In attendance were Rick Atherton, Leslie Forbes (left at? - 5:17 pm), Ed Gillum, Bill Grieder,Nat Lowell, Allen Reinhard, and Lee Saperstein; there was i#-�? quorum at all votes. All responded to an attendance roll call. The meeting was recorded and can be viewed on You Tube. Absent: Nelson (Snookie) Eldridge. Guests: Ken Beaugrand, Real Estate Specialist, Art Gasbarro (4:58 pm), Chair, Traffic Safety Work Group, Phil Smith B. Approval of the Agenda. The agenda was approved unanimously by acclamation. C. Public Comments; Officers' Comments. Allen Reinhard introduced Phil Smith, a long-time acquaintance of his, who has put in an application for membership in the committee, which, if approved, would fill the current vacancy. D. Minutes. Approval of the minutes from October 20, 2020, was moved by Bill Grieder and seconded by Ed Gillum. Unanimous approval was given by roll-call vote. 2. Missing Sidewalks Project: Discussion and Approval of Select Board Recommendation. Allen Reinhard recalled the discussion from last month in which the committee approved a draft recommendation to the Select Board that the Town proceed apace to realize plans for multi-use paths and sidewalks along four specified ways. The committee had identified six ways that need secure pedestrian walkways; the four that are specified have surveys and plans connected to them. Phil Smith noted that the intersecting street along North Liberty Street is Derrymore Road not Delaney, as written in the memorandum(LWS: corrected). With this editorial correction noted, Nat Lowell moved that the recommendation be sent to the Town, Ed Gillum seconded it, and it passed unanimously by roll-call vote. Lee Saperstein suggested that it not be sent until the Traffic Safety Advisory Work Group could review it; inasmuch as they will meet on Thursday 1 the 19th, this will not create a major delay. Nat Lowell asked if the Bicycle and Pedestrian Advisory Committee had seen the memorandum. Allen Reinhard said,no, but that he would continue to try to reach its chair. [Action: Lee Saperstein to print copies of the approved version; Allen Reinhard to try to contact Jason Bridges and to convey the final recommendation to the Town Manager.] 3. Pine Grove Road for Possible Taking; Updated Potential Taking List Discussion. Allen Reinhard noted that a resident on Pine Grove Road, which is off Surfside Drive,had asked that the Committee review it for possible taking by the Town. He asked if we were familiar with the way and if anyone had an opinion on the matter. His own opinion was that this was a local road that may not fit the criteria for taking. Lee Saperstein said that he had close connections to two of the residents on the road and asked if this constituted a conflict of interest. Allen Reinhard thanked him and then said that he did not see a conflict. Lee Saperstein then said that he had driven along the road and agreed that it needed maintenance but that it was contained within the local development and did not appear to meet many of the criteria for taking. Rick Atherton asked if there was an estimate of the amount of work that would be needed should it become a public way. Allen Reinhard said that there was not. Ed Gillum asked Ken Beaugrand if he knew who had asked that we review it. A local owner was the answer. Ed Gillum commented that when the development was new there was resistance to making it a public way. Lee Saperstein added that the way does not meet several important criteria for taking: connection to two public ways, substantial public use, access to public lands, and inaccessibility to emergency vehicles. In that an abutter asked for our consideration of the taking,there is partial satisfaction of the criterion for abutters' requests . Rick Atherton noted that the GIS map shows a paper road from Pine Grove Road to the school playing fields and asked of its status. Lee Saperstein said that it may be a footpath but that there was no road along that route. Subsequent examination of the aerial photograph on the Town's web site confirmed that it is a poorly established footpath. Rick Atherton, stating that the way did not meet a sufficient number of takings criteria,moved that we take no action on the request; Leslie Forbes seconded the motion and it passed unanimously by roll-call vote. From the singular case of Pine Grove Road, Allen Reinhard took up the entire Potential Takings List,noting that it included Amelia Drive and Ticcoma Way, Winn Street, Somerset Road and Friendship Lane, Warrens Landing Road, Stone Alley, Franklin Street, and Independent Way (formerly Coon Street). He also noted that Amelia Drive had already been taken but that we are keeping it on the list until planned reconstruction is completed. Also, the Select Board is reviewing the recommendation on Stone Alley and has asked for further input from the DPW on its condition. The Select Board has moved to take Independent Way. 2 Winn Street brought forth a lot of discussion,particularly on the poor condition of the unpaved, public way and the better condition of the paved,private way. It was also noted that Winn Street would be an essential part of a link between the Hummock Pond Road and Madaket Road bike paths along Old Farm Lane, Mount Vernon Street, Saratoga Street, Vestal Street, and Winn Street. With respect to Warrens Landing Road, which had been proposed to the committee some years ago by the Fishers Landing Association, Bill Grieder asked if the association had ever produced written evidence of their claim that the Town had agreed to take the way once it was constructed. Allen Reinhard said, no, nothing had been received. Bill Grieder then suggested that we revise the spread sheet to reflect our request for written confirmation of the agreement with the Town and that we move the way to the bottom of the spread sheet. He also noted that, as a private way, they had no problem installing speed bumps but that they might become a problem if the way were public. He also provided the name of the current President of the Fishers Landing Association: Seth Gottlieb. Leslie Forbes reviewed the takings criteria and Lee Saperstein noted that it joins two public ways, that it has heavy use by the public, and that it provides emergency access to Eel Point Road. [Action: Allen Reinhard to confer with Rob McNeil on status of takings; Allen Reinhard to confer with Seth Gottlieb about confirmation of the Town's agreement; Lee Saperstein to bring spread sheet up to date—attached] 2. (resumed at 4:58 pm) Missing Sidewalks Project. At this time, Art Gasbarro, chair of the Traffic Safety Work Group,joined the meeting and related that his committee was favorably disposed to the recommendation on sidewalks proposed by our committee. He said that his work group would consider making a positive recommendation to endorse our recommendation. The committee then returned to its agenda. 4. Washington Avenue Update: October 28 Select Board Hearing re: No Parking Restriction. According to Ken Beaugrand, the Select Board deferred action on this request until all surveying could be completed and notifications sent to home owners with substantial encroachments. 5. Chapter 91 License Monitoring System: Update. Allen Reinhard asked Rick Atherton for a report. He replied that there has been no response from Jeff Carlson, Director, Department of Natural Resources, and he thought that it might be better to ask the Planning Department for assistance in gaining information about Chapter 91 licenses. He noted that this committee wants to assist the Town by providing information to the public about water access. 6. Member Comments, Old, New and Other Business: Outstanding Projects List; Historic Coloured Cemetery Access. 3 Art Gasbarro suggested that we ask the Nantucket Planning and Economic Development Commission,NPEDC, for their support of our sidewalk recommendations. [Action: Allen Reinhard to contact Nat Lowell, Chair,NPEDC, for their input.] 6. Adjourn, Adjourn: The meeting was adjourned at 5:32 pm by acclamation.
