(617) 725-4000 11110, • CHARLES D.BAKER KARYN E.POLITO GOVERNOR LIEUTENANT GOVERNOR ORDER SUSPENDING CERTAIN PROVISIONS OF THE OPEN MEETING LAW,G.L. c.30A,§20 WHEREAS,on March 10,2020,I, Charles D.Baker,Governor of the Commonwealth of Massachusetts,acting pursuant to the powers provided by Chapter 639 of the Acts of 1950 and Section 2A of Chapter 17 of the General Laws,declared that there now exists in the Commonwealth of Massachusetts a state of emergency due to the outbreak of the 2019 novel Coronavirus("COVID-19"); and WHEREAS,many important functions of State and Local Government are executed by "public bodies,"as that term is defined in G. L. c. 30A, § 18,in meetings that are open to the public, consistent with the requirements of law and sound public policy and in order to ensure active public engagement with,contribution to,and oversight of the functions of government; and WHEREAS,both the Federal Centers for Disease Control and Prevention("CDC")and the Massachusetts Department of Public Health("DPH")have advised residents to take extra measures to put distance between themselves and other people to further reduce the risk of being exposed to COVID-19. Additionally,the CDC and DPH have advised high-risk individuals, including people over the age of 60,anyone with underlying health conditions or a weakened immune system, and pregnant women,to avoid large gatherings. WHEREAS,sections 7,8,and 8A of Chapter 639 of the Acts of 1950 authorize the Governor,during the effective period of a declared emergency,to exercise authority over public assemblages as necessary to protect the health and safety of persons;and WHEREAS,low-cost telephone,social media,and other internet-based technologies are currently available that will permit the convening of a public body through virtual means and allow real-time public access to the activities of the public body;and WHEREAS section 20 of chapter 30A and implementing regulations issued by the I Attorney General currently authorize remote participation by members of a public body,subject to certain limitations; i Poor=ox Rmco:o PAM • , NOW THEREFORE,I hereby order the following: `• i (1) A public body,as defined in section 18 of chapter 30A of the General Laws,is hereby relieved from the requirement of section 20 of chapter 30A that it conduct its meetings in } a public place that is open and physically accessible to the public,provided that the public body i makes provision to ensure public access to the deliberations of the public body for interested 1 t members of the public through adequate,alternative means. Adequate,alternative means of public access shall mean measures that provide transparency and permit timely and effective public access to the deliberations of the public 1 body, Such means may include,without limitation,providing public access through telephone, internet,or satellite enabled audio or video conferencing or any other technology that enables the public to clearly follow the proceedings of the public body while those activities are occurring. Where allowance for active,real-time participation by members of the public is a specific ; requirement of a general or special law or regulation,or a local ordinance or by-law,pursuant to { which the proceeding is conducted,any alternative means of public access must provide for such r participation. : A municipal public body that for reasons of economic hardship and despite best efforts is unable to provide alternative means of public access that will enable the public to follow the proceedings of the municipal public body as those activities are occurring in real time may , instead post on its municipal website a full and complete transcript,recording,or other comprehensive record of the proceedings as soon as practicable upon conclusion of the proceedings. This paragraph shall not apply to proceedings that are conducted pursuant to a 1 general or special law or regulation, or a local ordinance or by-law,that requires allowance for active participation by members of the public. i l 3 - A public body must offer its selected alternative means of access to its proceedings 1 without subscription,toll,or similar charge to the public, 1 t (2) Public bodies are hereby authorized to allow remote participation by all members in any meeting of the public body. The requirement that a quorum of the body and the chair be t physically present at a specified meeting location, as provided in G.L. c. 30A, §20(d)and in 940 CMR 29.10(4)(b),is hereby suspended. CHARLES D.BAKER GOVERNOR • Commonwealth of Massachusetts • • • • • is {Ep 2 ' } MINUTES Nantucket Land Bank Commission Regular Meeting of May 19, 2020 Remote Meeting Via Zoom The meeting took place via remote participation via Zoom pursuant to Governor Baker's March 12, 2020 Order regarding the Open Meeting Law(attached). CALL TO ORDER: 4:00 p.m. PRESENT: Richard Glidden, Kristina Jelleme,Neil Paterson, Allen Reinhard, John Stackpole. STAFF PRESENT: Eric Savetsky, Executive Director; Jesse Bell, Assistant Director; Susan Campese, Administrator/Finance Manager; Marian Wilson, Assistant Administrator; Rachael Freeman, Environmental Coordinator; Guthrie Diamond, Field Ecologist. Miacomet Golf Course ("MGC") General Manager, Alan Costa, and MGC Director of Agronomy, Sean Oberly, were also present at call to order. I. CONVENE IN OPEN SESSION: A. CITIZEN BUSINESS/ANNOUNCEMENTS: None. B. GOLF BUSINESS: 1. Sconset Golf Course—Manager's Monthly Review: The Commission reviewed the balance sheet and profit and loss comparisons from January through April 30, 2020, as well as the check registers and profit and loss statements by department. Mr. Costa noted that opening day for the season had been delayed until May 29, 2020 and lower revenues were anticipated due to COVID-19 guidelines, as they were instituting fifteen minutes between starting times to facilitate social distancing. Further, pursuant to the Commission's vote on March 10, 2020, Mr. Costa indicated that NGM, Inc. was going to transfer$149,885 to the Land Bank to fund the newly opened SGC Capital Reserve fund which would leave a balance of$50,000 in the operating account. 2. Miacomet Golf Course—Manager's Monthly Review: The Commission reviewed the balance sheet and profit and loss comparisons from January through April 30, 2020, as well as the check register and profit and loss statements by department. Mr. Costa stated that the golf course resumed golf operations on May 11th in accordance with the state guidelines set forth by Governor Baker. Mr. Costa anticipated that all revenues would be down due to implementation of the guidelines, as taking measures to ensure social distancing would negatively affect business volume, particularly with regard to tee times and food and beverage service. 3. Miacomet Golf Clubhouse—Warrant Authorization: A motion was made by Land Bank Commission Page 2 May 19, 2020 Commissioner Stackpole and duly seconded by Commissioner Reinhard to execute the May 19, 2020 warrant document in the amount of$146,376.73 to be provided to the county treasurer. A roll call vote was taken on the motion: Richard Glidden-Aye; Kristina Jelleme-Aye;Neil Paterson-Aye; Allen Reinhard-Aye; John Stackpole-Aye. 4. Miacomet Golf Course Summer Employee Administration, Housing and Storage Facility Project("MGC SEAHSF")—Rental Discussion: Mr. Costa reviewed the rental payment plans for Miacomet Golf Clubhouse and the MGC SEAHSF as previously discussed. He suggested budgeting for a lower annual flat rate payment in perpetuity rather than the one based on a thirty- year payback. Further due to COVID-19 he was only planning to have one person per room(rather than double occupancy) which would reduce rental income by $30,000. Mr. Savetsky recommended Mr. Costa propose an amount for this year as well as a proposal for payments in future years with anticipated full occupancy. 5. Miacomet Golf and Sconset Golf—Updated Logos Presentation: Ms. Bell presented new logos for MGC and SGC designed by Tony Leone. Mr. Costa stated he supported the new logos for both courses and was looking forward to ordering new merchandise with them. On the question of whether the Commission preferred"Sconset Golf Course" or"Siasconset Golf Course,"all Commissioners preferred the former. A motion was made by Commissioner Glidden and duly seconded by Commissioner Jelleme to approve the new logos for MGC and SGC, and to have the official name of SGC be the"Sconset Golf Course."A roll call vote was taken on the motion: Richard Glidden-Aye; Kristina Jelleme-Aye;Neil Paterson-Aye; Allen Reinhard-Aye; John Stackpole-Aye. Mr. Costa and Mr. Oberly departed the meeting at 4:32 p.m. C. PROPERTY MANAGEMENT: 1. Larrabee Farm—2020 Farm Plan Presentation: Ms. Bell reviewed the 2020 Farm plan submitted by Nick and Tom Larrabee indicating that the priority was to build the house and develop the farm plan based on input and grant funds from the Natural Resource Conservation Service of Massachusetts in 2021. Commissioner Jelleme stated concerns regarding the pace of farming was not what she expected and suggested the Land Bank help guide the farmers regarding the Land Bank's expectations for next year. Inquirer and Mirror Reporter, Brian Bushard entered the meeting at 4:42 p.m. 2. Cisco Beach—Commercial Use Policy Discussion: Mr. Savetsky asked the Commission for feedback on how they would like to approach commercial beach operations at Cisco beach this summer in light of COVID-19. Ms. Bell stated that while vendors would be required to adhere to state and local guidelines, the Land Bank was not planning to have an employee stationed at Cisco all day to ensure they were being followed. The consensus of the Commission was that mobile food vending and surf lessons should continue,provided they adjust their operations as needed to be in conformance with the guidelines. Ladies Beach—Wedding Ceremony Request for September 26, 2020: Ms. Bell presented a wedding ceremony request for 40 people on September 26, 2020 with the reception to follow at Bartlett's Farm. A motion was made by Commissioner Glidden and duly seconded by Commissioner Jelleme to approve the request,provided the event conforms to applicable state and local guidelines in effect at the time. Nobadeer Farm Road Ballfields—Use Request: Ms. Bell presented a request for the Nantucket Dreamland Theater to set up a 20' x 40' screen in the parking lot of the ballfields this summer for a drive-in movie theatre. She explained that the Town of Nantucket operates, maintains, and manages use of the facility under the terms of a license with the Land Bank as the underlying property owner. Although the details of the decision would need to be evaluated, considered, and ultimately determined by the Town, since the proposed use fell outside the scope of the license (which is limited to the use of the fields for athletic purposes),the question was whether the Land Bank would support the Town's consideration of the request in light of COVID-19. A motion was made by Commissioner Glidden and duly seconded by Commissioner Stackpole to support the concept and allow the use for 2020 provided it meets with Town approval. Vernon Farm—Sustainable Nantucket Farm Stand Approval: Ms. Freeman reviewed plans submitted by Posie Constable,the new Managing Director of Sustainable Nantucket, who requested approval to erect a farm stand on Hummock Pond Road at the entrance to the farm to supply local produce grown on the farm throughout the season. A motion was made by Commissioner Stackpole and duly seconded by Commissioner Jelleme to approve the request. A roll call vote was taken on the motion: Richard Glidden-Aye; Kristina Jelleme-Aye;Neil Paterson- Aye; Allen Reinhard-Aye; John Stackpole-Aye. 6. 73 Washington St(NISDA)—Landscape Plan Approval: Mr. Savetsky reviewed an aerial map of the property and the plan designed by Ahern Landscaping that included a new fence, open grass area with 4 benches, brick walkway and a refillable water station. Ms. Freeman indicated that once approved by the Commission,the permitting process would be initiated with the Conservation Commission and subsequently the Historic District Commission. A motion was made by Commissioner Stackpole and duly seconded by Commissioner Reinhard to approve the design, initiate permitting, and move forward with installing the fence.
