WFIRREAS,many important functions of State and Local Government are executed by "public bodies,"as that term is defined in G;L.e.30A,§ 18,in meetings that are open to the public,consistent with the requirements of law and soundpubliepolicy and in order to ensure active public engagement with,contribution to,and oversight of the functions of government; and { I WHEREAS,both the Federal Centers for Disease Control and Prevention("CDC")and I the Massachusetts Department:of Public Health("DPH")have advised residents to take extra ; measures to put distance between themselves and other people to further reduce the risk of being exposed to COVID-19. Additionally,the CDC and DPH have advised high-risk individuals, including people over the age of 60,anyone with underlying health conditions or a weakened immune system,and pregnant women,to avoid large gatherings. ► { WHEREAS,sections 7,8,and 8A of Chapter 639 of the Acts of 1950 authorize the Governor,during the effective period of a declared emergency,to exercise authority over public assemblages as necessary to protect,the health and safety of persona;and WHEREAS,low-cost telephone,social media,and other Internet-based technologies are currently available that will permit the convening of a public body through virtual means and allow real-time public access to the activities of the public body;and WHEREAS section 20 of chapter 30A and implementing regulations issued by the Attorney General currently authorize remote participation by members of a public body,subject to certain limitations; �,}.o of l4acuo O.vxt { i i NOW TJrdtEFORF,I hereby order the following: 1 { ' (1) A.public body,as defined in section 18 of chapter 30A of the General Laws,is hereby relieved from the requirement of section 20 of chapter 30A that it conduct its meetings in accessible the publicrovided that the public body s a public place that is open and physically access to p ,p makes provision to ensure public access to the deliberations of the public body for interested l members of the public through adequate,alternative means. I Adequate,alternative means of public access shall mean measures that provide transparency and permit timely and effective public access to the deliberations of the public t body. Such means may include,without limitation,providing public access through telephone, I internet,or satellite enabled audio or video conferencing or any other technology that enables the public to clearly follow the proceedings of the public body while those activities are occurring. Where allowance for active,real-time participation by members of the public is a specific 1 requirement of a general or special law or regulation,or a local ordinance or by-law,pursuant to which the proceeding is conducted,any alternative means of public access must provide for such I participation. 1 A municipal public body that for reasons of economic hardship and despite best efforts is I unable to provide alternative means of public access that will enable the public to follow the ; proceedings of the municipal public body as those activities are occurring in real time may 3 instead post on its mmnicipal website a full and complete transcript,recording,or other comprehensive record of the proceedings as soon as practicable upon conclusion of the proceedings. This paragraph shall not apply to proceedings that are conducted pursuant to a , general or special law or regulation,or a local ordinance or by-law,that requires allowance for 1 active participation by members of the public. A public body must offer its selected alterative means of access to its proceedings without subscription,toll,or similar charge to the public. (2) Publics bodies are hereby authorized to allow remote participation by all members in any meeting of the public body. The requirement that a quorum of the body and the chair be i physically present at a specified meeting location,as provided in G.L.'c.30A,§20(d)and in 940 CMR 29.10(4)(b),is hereby suspended. CALL TO ORDER: 4:00 p.m. PRESENT: Mark Donato, Kristina Jelleme,Neil Paterson,Allen Reinhard, John Stackpole. STAFF PRESENT: Eric Savetsky, Executive Director; Jesse Bell, Assistant Director; Susan Campese, Administrator/Finance Manager; Marian Wilson, Assistant Administrator; Rachael Freeman, Environmental Coordinator. Inquirer and Mirror Reporter, Brian Bushard was also present at the call to order. I. CONVENE IN OPEN SESSION: A. CITIZEN BUSINESS/ANNOUNCEMENTS: None. B. PROPERTY MANAGEMENT: 1. Cross-Island Hike—Update/Cancellation: Ms. Campese reported that the staff recommendation was to cancel the cross-island hike this year primarily due to COVID-19 safety concerns. The Commission agreed this was the best course of action. Ms. Campese stated that she would update the website and a press release would be sent out. Further,the planned route for this year would be used for the 2021 hike. 2. Hays—Property Planning Discussion: Mr. Savetsky presented a photograph of a concrete pathway that was finished with a stone surface as a longer lasting and more aesthetically pleasing alternative to asphalt for the accessible pathways on the property. The consensus of the Commission was favorable for this surface and they asked Mr. Savetsky to investigate pricing. Commissioner Donato asked if there was any lighting planned for the property,particularly the parking lot. Commissioner Stackpole suggested laying conduit during construction so lighting could be added later. Mr. Savetsky said he would talk to the landscape architects about adding it to the plan. A motion was made by Commissioner Reinhard and duly seconded by Commissioner Stackpole to submit an application to the Historic District Commission with the paths changed to concrete. TRANSFER BUSINESS: 1. August 2020 Transfers—Record Nos. 41862 through 41966: The Commission reviewed transfers for the period of August 1, 2020 through August 31, 2020. a. Current"M"Exemption and Lien: The Commission authorized the placing of a lien against the following property as a result of the purchasers claiming the "M" exemption as first-time buyers of real property: No. 41719 Patricia A. Dew, Sean Dew and Kameron Dew b. Current"0" Exemption and Lien: The Commission authorized the placing of a lien against the following property as a result of the purchaser claiming the "0" exemption as part of a deed-restricted affordable housing program: No. 41942 Erin E. Kopecki D. APPROVAL OF MINUTES: A motion was made by Commissioner Reinhard and duly seconded by Commissioner Stackpole to accept, approve, and release the regular session minutes of August 25, 2020 and the special session minutes of August 24, 2020, as written. A roll call vote was taken on the motion: Mark Donato-Aye; Kristina Jelleme-Aye;Neil Paterson-Aye; Allen Reinhard— Aye; John Stackpole-Aye. E. FINANCIAL BUSINESS: 1. Monthly Transfer Statistics: Monthly transfer statistics reports comparing calendar years 2019 and 2020 through August 2020 were presented to the Commission. 2. Warrant Authorization—Cash Disbursements: A motion was made by Commissioner Reinhard and duly seconded by Commissioner Jelleme to execute the September 9, 2020 warrant document in the amount of$194,056.27 to be provided to the county treasurer. A roll call vote was taken on the motion: Mark Donato-Aye; Kristina Jelleme-Aye;Neil Paterson-Aye; Allen Reinhard-Aye; John Stackpole-Aye. 3. Warrant Authorization — Miacomet Golf Course Employee Housing Facility: A motion was made by Commissioner Stackpole and duly seconded by Commissioner Reinhard to execute the September 9, 2020 warrant document in the amount of$11,729.65 to be provided to the county treasurer. A roll call vote was taken on the motion: Mark Donato-Aye; Kristina Jelleme-Aye; Neil Paterson-Aye; Allen Reinhard-Aye; John Stackpole-Aye. F. REGULAR BUSINESS: 1. Action Items—Review: Ms. Campese asked if the Commission had any questions on the action items list. Commissioner Reinhard expressed interest in being involved in the planning of the island wide map project. Ms. Freeman welcomed Commissioner Reinhard's participation and Land Bank Commission Page 3 September 8, 2020 indicated this work would begin after the trailheads and West-End Map projects were complete. G. PERSONNEL MATTERS: 1. Executive Director—Annual Review: A motion was made by Commissioner Stackpole and duly seconded by Commissioner Reinhard to approve a 5% raise and $10,000 longevity payment for Mr. Savetsky as recommended by the Review Committee. A roll call vote was taken on the motion: Mark Donato-Aye; Kristina Jelleme-Aye;Neil Paterson-Aye; Allen Reinhard-Aye; John Stackpole-Aye. II. EXECUTIVE SESSION: A motion was made by Commissioner Stackpole and duly seconded by Commissioner Reinhard to go into executive session in order to discuss the purchase, exchange, lease or value of real property and review and approve executive session minutes. A roll call vote was taken on the motion: Mark Donato-Aye; Kristina Jelleme-Aye;Neil Paterson-Aye; Allen Reinhard-Aye; John Stackpole-Aye. The Chairman declared under Purpose 6 [G.L. c. 30A, 21(a)(6)] that discussion of these matters in open session may be detrimental to the Land Bank's negotiating position. The Chairman further announced that the Commission would not reconvene in regular session at the conclusion of executive session. ADJOURNMENT: Upon a motion made by Commissioner Reinhard and duly seconded by Commissioner Donato, it was VOTED to adjourn at 5:2 .m.
