HomeMy WebLinkAboutRight-of-Way Minutes - March 15, 2011 (Draft)_201402041507165893 TOWN AND COUNTY OF NANTUCKET ROADS AND RIGHT OF WAY COMMITTEE DRAFT MINUTES ♣ February 15, 2011 CALL TO ORDER Chairman Allen Reinhard called the monthly meeting to order at 4:00 PM on Tuesday, March 15 in the conference room of the Town Building at 2 Fairgrounds Road. In addition to Mr. Reinhard, the following Committee members were present: D. Anne Atherton, Nat Lowell, Sylvie O’Donnell, Lee Saperstein, John Stackpole and Harvey Young. Also in attendance were Andrew Vorce, Director of Planning and Mike Burns, Transportation Planner. APPROVAL OF MINUTES There were two corrections to the DRAFT February Minutes: The motion to approve the February Minutes was made by Mr. Saperstein and seconded by Mr. Stackpole. Also, there was a misspelling in the name of Eric Savetsky in the chart at the bottom of page 1 that was duly noted and corrected. The DRAFT Minutes of the February meeting were unanimously approved as corrected, with Mr. Saperstein making the motion and Mr. Stackpole seconding it. Ms. Atherton asked that the Committee recognize the passing of Jeff Willett, Director of the Department of Public Works and an Ex Officio member of the R&ROW Committee. She noted the many excellent contributions he had made to the work of the Committee over the years, as well as more recently to the Sconset Foot-Path Public Access Subcommittee. Jeff was always professional, polite, helpful and affable, with a twinkle in his eye and touched all who were privileged to work with him. DISCUSSION OF R&ROW ISSUES AND RELATED ATM2011 WARRANT ARTICLES Director of Planning, Mr. Vorce reviewed the articles he thought the Committee would be interested in. ARTICLE COMMENTS Article #35 Appropriation: Construction and Roadway Taking costs for Surfside Area Roads The Boulevarde, etc.: FinCom motion is to take no action; complicated; will go on ballot vote; essentially table motion; schedule special election for this and some other items; funds were approved but not borrowed; $150,000 for creation of plan, legal work, etc.; Allen: process takes **time;** has to be a plan in place, etc.; then move on to the bids, etc.; important thing is that the BOS has made a commitment to do something; Sylvie: are abutters willing to be assessed? they have agreed to a formula, c. 30% to be paid by betterments; that could change on way or the other; new Town Counsel had advised that TON money cannot be used to repair private articles; Harvey: this is heading in the right direction DRAFT ROW Committee Minutes, 3.15.11 2 ARTICLE COMMENTS Article #36: Appropriation and Authorization for Road Layouts and Takings take no action; because of #35, not ready; expect this will come back provided engineering work done Article #37: Layout of Miller Land Miller Lane; BOS must vote first; #37 would be moot if BOS does not vote to lay it out; they will vote before Town Meeting; citizen article: PB recommends to move forward with layout; County Commissioners can jump and do it Article #38: Appropriation Plan and construction of Tom Nevers Bike Path negative recommendation Article #49: Zoning Map Change Miacomet Avenue rezoning of pond-side lots on Miacomet Avenue; work with LB for transfer of property; new open space; trail system; some day there will be a bridge across; rest of land around it will come out of commercial and go into residential; 4 years Article #90: Authorization for Real Estate Conveyance Hulbert Avenue Extension paper street; Hubert Avenue extension; motion to take no action; refer to BOS #107 and #108 Article #92: Real Estate Acquisition corner of Francis and 50 Union; positive motion; does not appropriate money; other groups have to work together to take action Articles #98 and #99: Real Estate Acquisition last of Surfside lots; Woodbine has been advertised; we are retaining path; full support of neighbors Articles #100 and #101: “Paper” Streets in Surfside also paper streets in Surfside; un-extinguished easements from the road; permissive authorizes Town to acquire easements; Jack Warner’s TN Ghosts; kept narrowing down lots Articles #102 and #103: Land and “Paper” Streets in Surfside near fishermen’s beach, last in beach grouping; Surfside Six process; Mrs. Yates passed away, heirs more cooperative; long time in coming Articles #105 and #106: Land and “Paper” Street Opposite Anne’s Lane in Sconset acquisition (105) and disposition (106); follows model; advertised for meeting on 30th; 67 Baxter; authorization is permissive; 65 and 67 involves both property owners; Mr. Tuttle: path has been adjusted Articles #107 and #108: Various “Paper” Streets Hulbert Avenue extension; majority of paper street, including beach frontage turns into road and abuts Jetties property; own gets some extra property; land all comes together at end of pond; complete greenway: several parcels Articles #109 and #110: Miscellaneous Land orphan parcels brought to Andrew’s attention by surveyors; three conditions, including conservation restriction; original value being preserved Article #114: Easement Madequecham Valley Road way that runs south of airport; called South Way; in process of being abandoned; eclipsed by Madequecham Valley Road; NCF wants rights; in Nantucket tradition nothing matches layout; cleans up a lot of right-of-way issues DRAFT ROW Committee Minutes, 3.15.11 3 NOTE: On Westchester, beyond Public Way marker are trees and brush; ACTION ITEM  Mr. Reinhard will contact DPW. SIDEWALKS FOR PROSPECT STREET AND PLEASANT STREET Transportation Planner, Mike Burns updated the Committee on the sequencing of bike paths, also as they relate to sidewalks. State funding comes in sections. The Prospect Street connection: The idea is NOT to abandon proposed route over Mill Hill, but try to install sidewalk because it should be done anyway. The sidewalk is **high** priority, especially with the Glidden house up on pilings. What is the best way to bring this back to the BOS? The Please Street sidewalk is being constructed intermittently: This is how it is going to have to happen until additional resources become available. Mr. Reinhard pointed out that the property in front of Sfoglia’s [soon to be new restaurant] involves a road-layout problem. The sidewalk in this area is a work in progress. Where should the road be? A legal question. Mr. Young mentioned Williams Lane: More and more people walking. The sidewalk needs brush cutting. CLIFF ROAD BIKE PATH EXTENSION AND UNDERGROUND WIRES, A LOST OPPORTUNITY With the Cliff Road Bike Path under construction there was a movement to place the wires underground. Unfortunately, it is too late. Such a recommendation must be made **early** on in the process. Mr. Reinhard noted that this is a lesson learned. Perhaps if wind turbines are installed at the landfill, this will be an opportunity to put the wires underground. Mr. Stackpole asked about the accountability from Verizon for the funds collected to date. (Verizon is the only utility company using overhead wires in the core district.) The Town Manager, apparently, is now asking specifically for such an accounting from Verizon. NEW BUSINESSES AND STATUS OF ITEMS ON ATTACHED PROJECTS & ISSUES LIST. The listing of Projects has been revised to reflect last month’s discussion. She pointed out that if Cato Lane were made a through street, it would take pressure off of Surfside. Apparently there are 23 acres in this immediate area. Mr. Reinhard said that when the Committee addresses the Priority Takings List, this matter could be revisited. There is no urgency, as the Boulevarde and First Way, etc., are priorities. ADJOURNMENT Having reached the end of the agenda, the Chairman adjourned the meeting at 5:40 PM.
