HomeMy WebLinkAboutRight-of-Way Minutes - January 18, 2011 (Draft)_201402041507022767 TOWN AND COUNTY OF NANTUCKET ROADS AND RIGHT OF WAY COMMITTEE DRAFT MINUTES January 18, 2011 CALL TO ORDER Chairman Allen Reinhard called the monthly meeting to order at 4:05 PM on Tuesday, January 18 in the garage area of the Town Building at 2 Fairgrounds Road. In addition to Mr. Reinhard, the following Committee members were present: D. Anne Atherton, Nat Lowell, Lee Saperstein, John Stackpole and Harvey Young. Bert Ryder, a member of the public was also present. APPROVAL OF MINUTES The DRAFT Minutes of the October 19 and November 16 meetings were unanimously approved, with Mr. Stackpole making the motion and Mr. Saperstein seconding to approve the October 19 Minutes, and Mr. Stackpole moving to adopt the November 16 Minutes, with Mr. Lowell making the second. UPDATES Sconset Foot-Path Access Subcommittee. The “Next Steps” recommended by the R&ROW Committee to the BOS were unanimously adopted on November 16, following the presentation of the Subcommittee. [See Attachment.] Andrew Vorce, the Director of Planning is preparing the Anne’s Lane taking article for the Warrant for ATM2011. The status of the easement at 67 Baxter Road is still unclear. The **key** to implementing the recommended Management Plan for the Foot-path is follow-up. MOTION  Mr. Stackpole moved that the Subcommittee Co Chairs, Ms. Atherton and Mr. Young, be designated with coordinating the follow-up. Mr. Lowell seconded the motion which was adopted unanimously. Mr. Lowell pointed out that the path is now “on the map.” People who live there are concerned, and he cautioned against “ratcheting” up the possible opposition of the abutters. ACTION ITEM: It was also agreed that Chairman Reinhard would write thank you notes to the members of the Subcommittee. PUBLIC WAY MONUMENT PROJECT: PHASE II LOCATIONS ACTION ITEM: Ms. Atherton will contact the Quidnet Squam Association to alert them about the location of a marker at the intersection of Salti Way and Squam Road, as well as at “Squam Landing” across from 50 Squam Road. A discussion ensued about whether or not a gratuity payment should be made to David Visco whose volunteer services have been so necessary to this project. A sum of $100 was mentioned. It was agreed that this would be a good idea. DRAFT ROW Committee Minutes, 1.18.11 2 The suggestion was made that a Chart of the Phase I locations, complete with photos, be developed, similar to the one for Phase II. ACTION ITEM: Ms. Atherton will format such a chart, with photos from Mr. Reinhard. DISCUSSION: PROJECTS, PRIORITIES AND FOLLOW UP FOR THE COMING YEAR R&ROW Committee Outstanding Projects and Issues (As Revised in August, 2010) PROJECT STATUS COMMENTS Access to Sconset Foot-Path Subcommittee in progress D. First Way Pedestrian/Bike Access and Road Improvement Foot-path from Washing Street Extension to Orange Street Improvement Project Surfside Roads to Airport Takings Project in progress easements, surveys and plans needed Publication of “A History of Roads and Ways” Update Priority Takings List and Process Used to Evaluate Priority for Takings Plan for Establishment of a Nantucket Greenway and Foot-Path System Nathan maps; Land Bank already has a system of trails; turns out some of these properties make logical trail heads; connection into Town property or NCF property; also Mass Audubon; next step is to develop a map that shows potential trail systems; go to organizations and get “buy in” from them; Lee: need formal consent from them; John: take LB map and put trails on them; Allen: has walked all of the potential trails; ultimately we are going to want to mark them; ACTION: Allen will meet with Eric and Bruce Chapter 91 Public Access License Enforcement Lee is liaison with HPIC Pedestrian/Bike Path Linking Prospect Street Path to Madaket Bike Route Via Mill Hill Mill Hill Project: Map of Trails and Public Property, Status of Public Use East Creek Road Layout DRAFT ROW Committee Minutes, 1.18.11 3 PROJECT STATUS COMMENTS Public Cemetery Access and Maintenance Oversight of Maintenance West Chester Extension, Crooked Land and Cathcart road R&ROW Improvement Plan Follow-Up and Implementation underground utilities Spruce Street Viewing Platform/Boardwalk to East Creek Road Miller Lane Foot-path property transfer to land Bank on hold by the Town; another article on Warrant for ATM2011; Glowackis trying to get strip for access Discussion of projects ensued. Chairman Reinhard reminded the Committee of the warrant article in 1975 that attempted to correct incomplete takings that had happened prior to 1955. He suggested that with the CPC grant in hand for public access, the Committee might move to establish a group to look at any remaining ways to “tie up loose ends” relating to private roads, “ghost” private roads, etc. Mr. Reinhard has spoken with Attorney Arthur Reade who is willing to share his knowledge and insight with the Committee. We do know that there are over 300 acres of paper roads that are note on the tax rolls. Developing an **inventory** would work nicely in conjunction with the Greenways Project. Mr. Stackpole asked if we are taking “too many bites from the apple?” Mr. Reinhard reminded the Committee that our role is oversight. Comment was also made about the fact that the BOS would not approve the recent bike-path recommendation, given the vocal opposition of some neighbors at the hearing. Can the process be modified to provide for public input **prior** to a recommendation being made to the BOS? NEW BUSINESS Request From Marsh Hawk Lane Residents Regarding Somerset Road Drainage. The issue is Friendship Lane, a 1980s-era subdivision. All of the roads in this area are private. A request has been made to the R&ROW Committee to see if there is anything that could be done in regard to drainage. Apparently someone at the top of Friendship has installed a berm, causing a large puddle to form that now goes down Somerset and around the corner. The Town has a policy in regard to private roads: The bottom line is that such a request is not within the purview of the Committee. Citizen Request re Sidewalk on Pleasant Street. Mr. Stackpole said that he had been asked why the sidewalk along Pleasant Street to the Post Office doesn’t go all the way through? Apparently it is blocked in front of Sfoglia. Mr. Lowell suggested that this might have something to do with the Mid-Area Plan and that we should check with Mr. Vorce. Mr. Saperstein pointed out that there is another section of missing sidewalk, in front of the barbershop. ACTION ITEM: Chairman Reinhard will speak with Mr. Vorce to check the layout of the sidewalk and take appropriate action. DRAFT ROW Committee Minutes, 1.18.11 4 Coal Alley. This continues to be an encroachment issue. ADJOURNMENT Having reached the end of the agenda, the Chairman adjourned the meeting at 5:40 PM. The next regular monthly meeting of the Committee is scheduled for 4:00 PM on Tuesday, February 15, 2010 at 2 Fairgrounds Road. Mr. Saperstein indicated that he may be off-island and unable to attend this session. Respectfully submitted, D. Anne R. Atherton Secretary 2.12.11 ATTACHMENT: “Next Steps,” Adopted by the BOS, December 8, 2010 NEXT STEPS By way of follow up, the R&ROW Committee respectfully requests that the BOS take five (5) specific steps as soon as possible: one, formally accept the Report of the Subcommittee as adopted by the R&ROW Committee; two, direct the Town Administration to prepare an article for the Warrant for ATM2011 for the taking of Anne’s (Ann’s) Lane way; three, direct the Town Administration to begin negotiations with the abutters of the five (5) ways recommended by the Subcommittee to be included in the first phase of negotiations to secure pedestrian access easements to the Foot-path in perpetuity; four, commit to the implementation of the Management Plan with the recognition that the R&ROW Committee and the Sconset Civic Association are prepared to provide support for and assistance with this task, including enforcement of TON ordinances as they relate to the Foot- path; and five, direct the R&ROW Committee to report back to the BOS on progress made to-date in six months (June, 2011).
