HomeMy WebLinkAboutRight-of-Way Minutes - March 16, 2010 (Draft)_201402041507178549 TOWN AND COUNTY OF NANTUCKET ROADS AND RIGHTS OF WAY COMMITTEE DRAFT MINUTES March 16, 2010 ♣ CALL TO ORDER Chairman Allen Reinhard called the monthly meeting to order just after 4:00 PM on Tuesday, March 16, in the garage area of the Town Building at 2 Fairgrounds Road. In addition to Mr. Reinhard, the following Committee members were present: D. Anne Atherton, Annie Bissinger, Nat Lowell, Sylvie O’Donnell, Lee Saperstein, John Stackpole and Harvey Young. Also in attendance was Bert Ryder. APPROVAL OF MINUTES The DRAFT Minutes of the February 16 meeting were approved unanimously, with Mr. Stackpole making the motion and Mr. Young seconding it. ANNUAL TOWN MEETING 2010: ARTICLES OF INTEREST TO THE COMMITTEE Andrew Vorce, Planning Director, reviewed various articles of interest on the Warrant for ATM2010. He commented on the following: Article 67: Home Rule Petition – Conveyance of Land from County to Town becomes open space; changes from road to open space Articles 72 and 73: Real Estate Acquisition – Pine Street, Sconset corrective from last year; inadvertently left out; near sewer beds; possible spot for Public Way marker Articles 74 and 75: Real Estate Acquisition and Conveyance – Connections to Siasconset Bluff Walk intention of the BOS is to form a committee to advise it re which ways to acquire for public access, which ways to eliminate, if any, and to develop a management plan for the Bluff Walk; through the FinCom process, two ways have been removed: Way #4 and Callender Lane Articles 76 through 79: Real Estate Acquisition – Paper Streets, Surfside Surfside Work Group Area Plan; about 12 acres of non- taxed land in total; most of neighbors want to purchase property; Town can reserve paths through easements if there are any Article 83: Real Estate Conveyances: Miller Way; former Nonantum Avenue Parcel and West Tristram Avenue 83 Miller Lane: NOT be a through road; this will become a linear park; will be passable by bike and pedestrians; no vehicles Articles 84 and 85: Real Estate Acquisition and Disposition – Gardner Road intent is to leave dirt road where it is; convey abutting parcels to owners DRAFT ROW Committee Minutes, 3.16.10 2 UPDATE: PUBLIC WAY MONUMENT INSTALLATION PROJECT; CONSIDERATION OF NEXT LOCATIONS FOR PUBLIC WAY MONUMENTS; FURTHER DISCUSSION OF IDEAS FOR THE PLACEMENT OF THE NEXT TWELVE PUBLIC WAY MONUMENTS MOTION: Mr. Saperstein moved that the list of public ways attached to the January Minutes be adopted as THE list for Phase II of the Public Way Monument Installation Project. The motion was seconded by Mr. Stackpole. Discussion: The 12 items with descriptions are affixed to these Minutes as Attachment I. Chairman Reinhard said that we still have two markers to place. Mr. Saperstein has been in contact with Mr. Marcklinger who promised that they would be installed soon. Some of the ways in Surfside could be included. It was noted that the Land Bank should be informed if there are any located the committee thinks should have a Land Bank marker, such as Low Beach. The motion was adopted unanimously. DISCUSSION: OUTSTANDING PROJECTS AND ISSUES (21) PROJECT STATUS Public Way Marking Project, Phase II identify future locations; done Access to Sconset Bluff Foot Path ATM Articles 74 and 75; establishing a committee is a positive way to proceed Surfside Paper Roads/Abutter Way Takings ATM Articles 76 through 79 Miller Lane Foot Path ATM Article 83; property transfer to the Land Bank First Way Pedestrian/Bike Access and Road Improvement Project has not yet entered Capital Program Committee process; this is the next step; we do have two estimates; Mr. Gasbarro recommended we get a design first; the estimates do NOT include drainage Foot Path from Washington Street Extension to Orange Street Improvement Project way has been cut by DPW; looks great, opens view; boulders at one end; found bounds in the ground on the other side Surfside Roads to Airport Taking Project easements, surveys, plan needed for Monohansset, Boulevarde, etc.; next step is to get legal work done; survey, a plan, estimate, etc.; Surfside Association has agreed to go door-to-door to get voluntary easements, if they can; a “work in progress;” Ms. Bissinger: this could get complicated, especially if properties are sold Publication of “A History of Roads and Ways” self-publishing may be way to go; Books Surge; Chairman Reinhard will pursue Update Priority Takings List and Process Used to Evaluate Priority for Takings Ms. Bissinger is working on completing matrix; no urgency because there are no funds; when the time is right, we can apply the matrix to the map DRAFT ROW Committee Minutes, 3.16.10 3 PROJECT STATUS A Plan for the Establishment of a Nantucket Greenway and Foot Path System Chairman Reinhard has a set of maps; divided by parcels and all of the conservation lands identified by specific groups, Town-owned land, etc.; Mr. Reinhard will be working with Messers Savetsky and Perry from the Land Bank; figure out where corridors are; then print our 8 x 11 aerial views of the ways and see where the existing paths are and where there are gaps; get agreement on the markings: how? Mr. Reinhard hopes to have a proposal by the May meeting; at that time, we can take a look as a Committee, then prepare for the next step/s: funding? markers? Chapter 91 Public Access License Enforcement: Harbors Plan this work “unfolding;” Ms. Atherton and Mr. Young will meet with HPIC members, Dr. Oktay and Ms. Johnson to consider what has to be done; also meet with Jeff Carlson, the TON Beach Manager? Pedestrian/Bike Path Linking Prospect Street Path to Madaket Bike Route via Mill Hill a “work in progress;” Mr. Burns, Transportation Planner in charge; will take years; link existing path by Old Mill, go up over hill and connect to Mt. Vernon Street and Madaket Road; Mr. Ryder asked if path on Chicken Hill is public; Mr. Reinhard responded that this is being researched; problem is road goes close to Mr. Egan’s old house; goes to Joy Street from Chicken Hill; we need to determine the status of all of the roads in the Mill Hill area Mill Hill Project map of trails and public property; status of public use Squam Road Parking at Public Access Path ask River Light to move fence? where are the bounds? East Creek Road Layout public way, but never did layout for the road; does connect with Spruce Street; road directly to the north, or left, of OIH; Mr. Lowell asked if we should table this matter? some say it is private; confusion; Ms. Bissinger Poor will check Coal Alley and Other ROW Encroachment Enforcement and Follow-Up Issues Coal Alley is the poster child of encroachments; called the “perennial encroachment” by some (Mr. Richard Cooper); Mr. Young asked whether or not the TON should simply lease this area? (somewhat in jest); we will keep this matter on the list Public Cemetery Access and Maintenance Plan Cemetery Work Group; working on this project; **maintain public access;** will put sign on Quaise Asylum Burial Ground ROW Improvement Plan Follow-Up and Implementation **underground utilities;** Verizon is only remaining one; conduits are there; how to get their attention? Spruce Street Follow-Up viewing platform/boardwalk to East Creek Road; CPC funding has been secured; reduced by $30,000 at ATM?; some of that money is still there; remind Mr. Vorce or Mr. Burns to follow up Review of Area Plans to Seek Public Way Opportunities DRAFT ROW Committee Minutes, 3.16.10 4 INVENTORY OF INCOMPLETE TALKINGS OF WAYS LEADING TO THE WATER Ms. Atherton reminded the Committee that we had agreed to try to inventory incomplete takings of roads leading to water. It was agreed that this would be a major contribution to the whole issue of public access. The goal would be to ensure that there were no more “surprises,” such as Steps Beach. How to go about this task? Legal work would be necessary. Perhaps the Committee could apply for CPC funds through the TON or County. Ms. Bissinger said that the Town has a good inventory. We need to address this on an island-wide scale, perhaps through the County Commissioners with the professional assistance of Town Counsel. ADOURNMENT Having reached the end of the agenda, the Chairman adjourned the meeting at 6:00 PM. Ways Deserving of Markers Generic Description Map Parcel Comments ‘K’ Street, Madaket 32 59.4 999 87 ‘K’ Street is town owned but is only a footpath from Tennessee Avenue to the Harbor. Parcel 59.4 87 on Madaket Harbor is County owned. ‘Sconset Footpath Access between Baxter Road and the Footpath. 49, 73 Various The Town’s Planning Department, Andrew Vorce, Director, is preparing a Warrant Article for the 2010 Annual Town Meeting to take six abutters’ ways (Bayberry Lane, Ann’s Lane, Emily Street, Rosaly Lane, Nosegay Lane et al.), identify two for public access to the ‘Sconset Bluff footpath, and sell the remaining four back to the abutters by means of “Yard” sales. The two resulting public ways should be marked. Polpis Harbor Access at 18 Wauwinet Road. 20 14, 16 A Town-owned way to Polpis Harbor; Access to Nantucket Community Sailing boats. Polpis Harbor Road between 290 and 294 Polpis Road is not well marked. Squam Road beach access; opposite 50 Squam Road 13 019 Town-owned access to the beach; may have been acquired for emergency beach access; no dedicated parking lot on Squam Road. Quidnet: access to beach and Land Bank Property along Salti Way (unimproved way parallel to Quidnet Road) 21 10, 63, 64 The way comes onto the beach between parcels 21 10 and 21 63,64. The marker could go at several points but the end of Quidnet Road where it meets “unknown” (Town GIS) way or the intersection of “unknown” way with Salti Way are two possibilities. Access to North Shore beaches: 40th Pole, North Pond Road, between 151 and 159 Eel Point Road. 151 is Land Bank; North Pond Road appears to be Town although the narrow mapped way is 33 6, 7, 8, 10 The four parcels are owned by the Land Bank; 33 6 covers a narrow footpath within the boundaries of North Pond Road. This is presumed to be the access to 40th Pole Beach and is a higher priority for a marker than some of the other abutters’ ways that connect Eel Point Road to the beach. Is a road sign a better choice shown as Land Bank. Dionis Beach Road is already marked. than a “Public Way” marker? Hulbert Avenue: abutters’ ways to the Harbor 29 Various Between Bathing Beach Road (Jetties Beach) and Brant Point, only Charles Street is a Public Way and it is already marked. Brant Point, while open to the public, is Coast Guard (Federal) land. The many abutters’ ways, such as the extensions of Johnson, James, Henry, and Willard Streets and the other unnamed ways, that have been used for years by Nantucketers are private land. It is suggested that the ROW Committee maintain a watching brief on these ways in case easements can be created and donated to the Town. Surfside, Uncatena Street 87 48 87 48 is Town-owned land on the water east of the main Surfside Beach and should be marked. 87-40 at 45 Nonantum Avenue and 88 48 at Clifford Street are Land Bank properties. Surfside, Western Avenue at the southerly extension of Auriga Street 87 Between 76 and 77 The 2007 Aerial Photograph suggests that this is a well-used way deserving of being marked. South Shore Road and Hillside Avenue 87 2, 36, 85, 86, 90, et al. East of the Town’s DPW site, the Sewage Plant, and the sewer beds are a number of Town-owned properties that surround Hillside Avenue. A Public Way marker could go at the intersection of Hillside Avenue and South Shore Road. Miacomet Road, at the ocean 86 15 The Town owns land along the southeastern edge of Miacomet Pond to the ocean. This is a good place for a marker. 130 Tom Nevers Road: Town-owned park 91 109 The Town-owned park has an access road to the beach but it is un-marked. A Public Way marker would go nicely at the edge of the parking lot or entrance road.
