HomeMy WebLinkAboutRight-of-Way Minutes - June 15, 2010 (Draft)_201402041507139174 TOWN AND COUNTY OF NANTUCKET ROADS AND RIGHTS OF WAY COMMITTEE DRAFT MINUTES June 15, 2010 CALL TO ORDER Chairman Allen Reinhard called the monthly meeting to order at 4:00 PM on Tuesday, June 15, in the Garage Area of the Town Building at 2 Fairgrounds Road. In addition to Mr. Reinhard, the following Committee members were present: D. Anne Atherton, Sylvie O’Donnell, Lee Saperstein and Harvey Young. Members of the public in attendance were Art Gasbarro, Bert Ryder and Carl Sjolund, representative to the Committee from the Harbors Plan Implementation Committee (HPIC). APPROVAL OF MINUTES The DRAFT Minutes of May 18 were approved as corrected, with Mr. Saperstein making the motion and Ms. O’Donnell seconding it. The May Minutes should reflect that it was Richard Cooper in attendance, NOT Jim Cooper, with thanks to Ms. O’Donnell for the correction. UPDATE: SCONSET BLUFF WALK PUBLIC ACCESS SUBCOMMITEE The members of the Subcommittee walked the foot path together on June 1. [Notes of On-Site Walkabout are posted on the Town’s website at http://www.nantucket- ma.gov/pages/NantucketMA_BluffMin/] Frank Holdgate, a member of the Subcommittee, suggested that there is a way to get an accurate GIS positioning of on-the-ground conditions. This process would cost about $3200 and would be fairly accurate within a foot or two, as opposed to doing a full survey. Without some professional work, the Subcommittee will be unable to determine where there are any encroachments, either on the lateral ways or on the path, itself. A representative from the Conservation Commission has not yet been named to the Subcommittee: Once this happens, it is hoped that information regarding the permitting of the stairs can be gathered. LOCATION OF PUBLIC WAY MARKERS: PHASE II Phase I: Mr. Saperstein reported that Phase I of the project is nearing completion. Cathcart has been officially marked. The last monument will be installed at Madequecham Valley, off of New South Road (actually Madequecham Valley Road). The Subcommittee will make sure that this monument is on Town land. Phase II: Extensive discussion took place regarding the location of monuments for the second phase of the project. DRAFT ROW Committee Minutes, 6.15.10 2 LOCATION COMMENTS K Street in Madaket; by Beverly Hall’s YES Sconset Foot Path YES - underway Polpis Harbor Access (where NCS keeps their boats) needs checking as to whether or not this is public or private property; road access from MISDA is public; width varies; abuts NCF property; narrow parcel; might not be a road Squam Road YES Quidnet access to beach? public way at end of Sesachacha Road? open? there are other access points on Land Bank property; another access next to last house next to Denby’s; **needs checking** North Shore – 40th Pole popular spot; should be something to indicate that it is open to the public; perhaps Land Bank should install a marker; research needs to be done; either a PUBLIC WAY marker or LB marker needed Hulbert Avenue three existing ways; Charles Street (is marked); Henry Street; and Willard Street; they are all about 30 feet wide; however, at the beach, there is no where to go; some inland people have deeded access; they complain about overgrowth; only one that is public is Charles; the others are abutters ways; 55 (Lilly), 33, 51 (Davis) have Chapter 91 Licenses: public shall be allowed to pass: DEFER UNTIL SCONSET IS FINISHED Surfside close to completion according to Mr. Vorce; once all paper work is done, we should mark the paths; Fishermen’s Beach could be marked, as the parking lot could be expanded because the Town owns additional half acre contiguous to the parking lot; apparently there are three more paths in Surfside east Western Avenue Town owns Auriga Street chain across it; closed off so people could not drive onto beach to fish South Shore Road and Hillside Avenue YES; sewer plant; well-used way to beach; perfect for a marker Miacomet Road at ocean YES; on west side of pond; parcel 86 15 is Town land Tom Nevers Road (130) parcel on edge of park/ball field; at end of road leading down to beach; parcel is public land CONSENSUS REACHED: There will be approximately **eleven markers in total** for Phase II: K Street in Madaket; Polpis access; Squam; Dionis; Surfside/Uncatena; South Shore Road; Miacomet; Tom Nevers; and three in Surfside. Quidnet would be #12. DRAFT ROW Committee Minutes, 6.15.10 3 Mr. Ryder raised the question of Folger Avenue. There is a PRIVATE sign at the end. This needs to be checked. ACTION  Mr. Reinhard will follow up. Next steps for Phase II: ACTION  A letter needs to be sent to the Town requesting funds. Mr. Saperstein will prepare an HDC application. CAPITAL PROJECTS PROPOSALS FOR SURFSIDE ROAD AREA TAKINGS AND FIRST WAY IMPROVEMENTS TO PROVIDE SAFER ACCESS TO THE SCHOOLS: NEXT STEPS. Mr. Reinhard reported that the next step is to get the Surfside-area road takings onto the Capital Program list so that this project will be in a position to be reviewed. Members of the Surfside Association are prepared to go door-to-door seeking easements from the property owners. DISCUSSION: PUBLIC ACCESS IMPROVEMENT PLAN Coastal Zone Management (CZM) Preserving Historic Rights of Way to the Sea: Mr. Reinhard reported that there is a fair amount of grant money available through CZM for access to the water. The monies for grants are generated through salt-water fishing licenses. These licenses are State licenses. The advantage is that the monies generated will stay with the State, whereas Federal fees will not. The funds will be used to improve fishing facilities: anything that enhances public access to water. Mr. Reinhard suggested that we could develop a Public Access Improvement Plan, as a project for the coming year. What types of grants would we be seeking? We need the projects first. (Example: harbor walkways.) This is an opportunity to do some creative thinking. Mr. Saperstein commented that it might be helpful to find out if the funds available are for capital improvements only: Is there any maintenance money available, as this is needed to keep brush cut back, maintain access to cemeteries, etc. Mr. Gasbarro mentioned that the monthly CZM newsletter is very helpful. He will send further information to Ms. Atherton about how to subscribe. Public access points in Monomoy: Mr. Young raised the question about public access points in Monomoy. Is there one at the end of Berkeley Street given by Mr. Lovelace. Perhaps we should be negotiating an easement at the end of the road. Is drainage an issue here? ADOURNMENT Having reached the end of the agenda, the Chairman adjourned the meeting at 5:48 PM.
