Public Hearings:  #16-11 On Island Center MCD, 30 & 34 Sparks Avenue, action deadline 12-30-11 The applicant submitted updated traffic information from MDM Transportation and provided the site plan approved by the Fire Department. TetraTech Rizzo reviewed the information submittted by the applicant for traffic and site flow issues and evaluated concerns that were expressed by the Board. They have provided a positive review – see the report in your packet dated November 10, 2011.  #21-11 Arrowhead Nursery Amendment, 9, 11, 13 & 15 Wampanoag Way, action deadline 02-13-2012 The applicant is requesting modifications to the MCD special permit to allow the lots to be used as separate lots for building and zoning purposes, which will allow the lots to be conveyed and financed separately. The lots will still be subject to the MCD requirements and any alterations of the uses on the lots will require Planning Board approval. The applicant is also requesting to eliminate the requirement for NEHOD employee housing within the duplex structure. Please see the addendum attached to the application for more details.  #22-11 Wheldon Commercial Development Amendment (Sea Grille), 45 Sparks Avenue, action deadline 02-13-2012 The applicant is requesting to enclose the existing deck for year-round dining. The seating will not be increased. Staff recommends approval.  #23-11 Duane Jones MCD Amendment, 41 Nobadeer Farm Road, action deadline 02-13-2012 The applicant is requesting to add a garage to the existing MCD. The garage will be for the personal use of the applicant and will not be used as rental or commercial unit. The open space requirement for MCD’s will be met with 36.1% of the site being designated as open space. The applicant is requesting a parking waiver for the additional required spaces. Staff recommends approval of the application subject to the following conditions: 1. That the garage may only be used by the applicant/property owner for personal storage and use. The garage may not be leased to tenants or used commercially for business operations; 2. That the proposed parking waiver is granted based on the representation by the applicant that the garage will be used by the applicant/property owner for personal storage and use only; 3. That the garage must be located in substantially the same location as shown on the submitted site plan entitled “Plan of Land in Nantucket, MA” prepared by Blackwell and Associates, Inc. dated October 24, 2011. 2 ANR:  #7387 Le Select Properties, LLC, 5 South Mill Street & 5B South Mill Street (Map 55.4.1 parcels 22.3 & 21.3) The purpose of this plan to divide an existing lot into two (2) buildable lots. Both lots meet minimum frontage and area requirements. The lots have frontage on South Mill Street, which is a public way. Staff recommends endorsement.  #7388 John C. Sherman, Sr. & John C. Sherman, Jr., 6 Madaket Road (Map 41 Parcel 184.1) The purpose of this plan is to create a lot for conveyance purposes. Lot 4 is approximately twelve (12) square feet and is unbuildable. Staff recommends endorsement.  #7389 Cornelius B. & Ethel K. McCrudden, 2 Winn Street (Map 41 Parcel 183) The purpose of this plan is to divide an existing lot into three (3) buildable lots. The lots have frontage on Winn Street, which is a private way that pre-dates the Subdivision Control Law adoption on Nantucket in 1955. Winn Street meets the Planning Board requirements for width, grade, and construction. Staff recommends endorsement.  #7390 Linda L. Morgan, 15 King Street (Map 73.4.2 Parcel 62) This is a perimeter plan. Staff recommends endorsement.  #7391 Samuel C. Sichko, Trustee et al, 78 Madaket Road & 4 Daisy Field Way (Map 41 Parcels 462.6 & 462.9) This is a perimeter plan. Staff recommends endorsement.  #7392 Eric Frost, Trustee of Front Field Trust, 80 Madaket Road & 3 Front Field Way (Map 41 Parcels 464 & 802) This is a perimeter plan. Staff recommends endorsement.  #7393 Town of Nantucket, Laurel Street (Map 80) The purpose of this plan is to create unbuildable lots from unconstructed portions of Laurel Street. The acquisition and disposition of this land was authorized through the approval of Article 96 at the 2009 ATM. These lots will be conveyed to abutting property owners through the Yard Sales program. Staff recommends endorsement.  #7394 Town of Nantucket, Nobadeer Avenue, Dunham Street & Weweeder Avenue The purpose of this plan is to create unbuildable lots from unconstructed portions of Dunham Street. The acquisition and disposition of this land was authorized through the approval of Articles 98 and 99 at the 2011 ATM. These lots will be conveyed to abutting property owners through the Yard Sales program. Staff recommends endorsement.  #7395 Peter & Andrew Boynton, 46 Weweeder Avenue (Map 79 Parcel 74) This is a perimeter plan. Staff recommends endorsement. Second Dwellings:  1 Brocks Court, One Brocks Court, LLC (Map 42.3.4 Parcel 85)  10 King Street (Siasconset), (Map 73.4.2 Parcel 12), Hillary R. danforth & Eliz D. Hurst, Trustees of The Elizabeth W. Dahforth 2011 Trust  2 Marion Avenue, (Map 82 Parcel 402), William H. Jennings, III Please see the reports in your packet issued by John Brescher.  30 Sparks Avenue, (Map 55 Parcel 234.6), Pilgrim Locke Realty Trust The dwelling units proposed in connection with the MCD/MIPOD special permit require secondary dwelling approval since the buildings have been detached. Staff recommends that the discussion on this matter be conducted simultaneously with the public hearing. Previous Plans:  #1-81 Island Lumber Holding, Corp. MCD, 1 Polpis Road (Map 54 Parcel 121), rescission of the special permit The applicant is requesting rescission of this special permit. Island Lumber operations have been extended to this site and neither special permit relief nor a modification of special permit #1-81 is necessary. Staff recommends that the Board approve the requested rescission with a decision to be signed in the office.  #33-01 Nantucket Auto Body Modification (Tarpon Nominee Trust), drainage modification The Planning Board last reviewed this application in 2004. At that time a drainage plan was approved. Dan Mulloy of Site Design Engineering has since revised the drainage plan to incorporate better engineering practices. Staff recommends approval. 3  #24-10 Supply New England MCD Modification, review conditions with the request of some changes The 2010 decision provided a November 15, 2011 deadline to complete all site improvements. The applicant has not completed the site improvements and at least two (2) complaints have been made by an abutting property owner regarding noise, loading in the street, and other nuisance related issues. A letter from an abutter is included in your packet. The applicant is now proposing several modifications to the project, site design specific changes. See letter from Dan Mulloy dated November 7, 2011 with attached plans.  #7337 Keequinn Circle Subdivision (Canty), 50 Cato Lane, extension request The applicant is requesting an extension of the deadline to submit legal documents from November 9, 2011 to May 9, 2012. A letter from Canty Law Group dated November 1, 2011 is included in your packet. Staff recommends approval.  #6693 Daisy Field Way and #6694Front Field Way Subdivisions The applicant is requesting that the Board rescind their approval of these subdivisions.
