Public Hearings:  #16-11 On Island Center MCD, 30 & 34 Sparks Avenue, action deadline 12-30-11 A draft decision is included in your packet. ANR:  #7396 Robert David Bewkes, Trustee of Bewkes Lots 153 & 155 Nominee Trust, 100 R & 102 Wauwinet Road, (Map 11 Parcels 24.2 & 24.3) The purpose of this plan is to create four (4) lots for conveyance purposes. Lots B and D will be combined with Lot 171 and Lots A and C will be combined with Lot 153 to create a buildable lot. Staff recommends endorsement.  #7397 Bernadette Maglione , 26 Appleton Road, (Map 66 Parcels 30A & 31.A) The purpose of this plan is to alter the lot line between two (2) buildable lots. Both lots will continue to meet minimum frontage and area requirements for the RC-2 district. Staff recommends endorsement.  #7398 Brian Fogarty, 58 Nobadeer Avenue, (Map 88 Parcel 9) This is a perimeter plan to combine Lot 1 and Parcel “F” and Lot 2 and Parcel “E”. Parcels F and E were established and sold through the “Yard Sales Program”. Staff recommends endorsement.  #7399 Austen H. Winters, 147 Main Street, (Map 41 Parcel 170) This plan was submitted pursuant to MGL Chapter 41-81L, which allows substandard lots to be created if a significant structure on each lot was in existence prior to the local adoption of the Subdivison Control Law (1955). Local Tax Assessor records establish that both structures pre-date the adoption of the Subdivision Control Law and both lots have a minimum frontage of twenty (20) feet, therefore, staff recommends endorsement.  #7400 Michael P. Brennan, 1 Spring Street, (Map 55.1.4 Parcel 42) 2 This plan was submitted pursuant to MGL Chapter 41-81L, which allows substandard lots to be created if a significant structure on each lot was in existence prior to the local adoption of the Subdivison Control Law (1955). Frontage averaging will be utilized for lots F and E, with the other buildable lots being encumbered with the frontage averaging. Staff will provide a verbal recommendation on this application at the meeting.  #7402 Massachusetts Society for the Prevention of Cruelty to Animals, 11R Crooked Lane (Map 41 Parcel 72) The purpose of this plan is to create two (2) unbuildable parcels to be combined with adjacent parcels. Staff recommends endorsement. Second Dwellings:  30 Sparks Avenue, Pilgrim Locke Realty Trust, (Map 55 Parcel 234.6) The dwelling units proposed in connection with the MCD/MIPOD special permit for this property require secondary dwelling approval. Staff recommends that the discussion on this matter be conducted simultaneously with the public hearing for the special permit.  43 Main Street (Siasconset), Jim & Kathleen Poole, (Map 73 Parcel 8)  43 Polpis Road, Wannacomet Water Co., (Map 54 Parcel 94.1) Please see the reports in your packet issued by John Brescher. Previous Plans: ▪ #6968 Bluefin, extension request (June 15, 2012) The applicant is requesting an extension from the deadlines established in the decision. Since the approval was appealed, the deadlines were automatically extended and the applicant is now requesting additional time until December 14, 2012 to submit the required legal documents. At, the last ZBA meeting, staff commented on two (2) applications that had not yet been discussed by the Planning Board. Those applications (ZBA Files 070-11 and 076-11) involved the Town of Nantucket application for a wind turbine at the land fill and the Sachem’s Path housing development. A copy of the staff memo is included in your packet. Other Business:  Warrant Article Discussion for 2012 ATM Three (3) new articles are included in your packet for your consideration. These articles are proposed by citizens and they are requesting that the Board sponsor them for inclusion in the Warrant. Please see the information provided in your packet for Don Allen Ford, Surfside South/East, and Cisco. In addition, we received two (2) citizen articles that received the required signatures for inclusion on the Warrant. Those articles will be discussed at the public hearing on January 23, 2012. A copy of the Warrant Article “triage” from Town Counsel is included in your packet for your reference.  2012 Planning Board Meeting Schedule Please review the meeting scheduled included in your packet. Note the special meeting to discuss Warrant Articles on January 23, 2012.
