ANR’s: ƒ #7254 Fargo Thompson, 3 Crows Nest The purpose of this plan is to divide one (1) existing lot into two (2) buildable lots. Both lots meet minimum frontage and area requirements. Crows Nest Way is a private way that was in existence prior to 1955. It meets minimum width, grade, and construction for the additional lot being created. Staff recommends endorsement. Second Dwellings: ƒ 4 Westmoor Lane, Francis X. Farrell, (Map 41.1.2 Parcel 12) ƒ 14 N. Water Street, Luke Thornwell, (Map 42.4.2 Parcel 83) ƒ 34 Somerset Lane, Twig Perkins, Inc., (Map 66 Parcel 73) Please see the reports included in your packet and issued by Venessa Moore. Preliminary Plans: ƒ Madaket Marine, 20 North Cambridge Street (Maps 59.4, 38 & 60 Parcels 2, 14, 15 & 17), draft approval letter Please see the draft approval letter dated October 15, 2009. Previous Plans: ƒ #7084 Arrowhead Subdivision, endorse plans Ed Pesce reviewed the final plans. There are some minor adjustments that the applicants engineer will need to address. Staff recommends that the Board vote to endorse the plans in the office subject to final revisions. ƒ #47-08 Old South Road, LLC, bike path construction Included in your packet is a letter from the Traffic Safety Workgroup requesting the Board to direct the applicant to construct the bike path as required in the 124, 126, and 128 Old South Road MCD decision(s). The portion of the path that is not installed is between Macy Lane and Hanabea Lane. Although construction of this path is required and the original decision stated that it must be in place prior to the issuance of a Certificate of Occupancy for any structure, the Planning Board subsequently voted to allow the issuance of all Certificates of Occupancy for the completed buildings without the path being completed. The Board did not waive the requirement, but the deadline for completion was removed. There are three (3) lots that remain vacant and when the applicant proposes structures on those lots, the Board will have an opportunity to address the bike path issue again. The applicant has publicly represented to the Board and staff that completing the construction of this bike path is a priority, however, it is not possible at this time. If the Board is inclined to send a letter, perhaps it should be more of a friendly reminder, since the Board waived the deadline. The representation in the letter from the Traffic Safety Work Group that I stated that the project is in violation of the special permit is not accurate. In fact, I was surprised to see my name mentioned in the letter since the work group had not asked my opinion. I will be issuing a response memo to the work group. ƒ #12-09 Butnell Corporation, 129, 131 & 133 Orange Street, endorse plans The revised plans have been reviewed by Ed Pesce and there are no outstanding issues. Staff recommends endorsement. Public Hearings: ƒ #15-09 Harbor Terrace MRD, 12 & 14 East Creek Road, action deadline 11-8-09, continued to 10-26-09 ƒ #17-09 5 & 7 West Creek MIPOD, 5 & 7 West Creek Road, action deadline 12-27-2009 The applicant submitted additional documentation regarding the ZBA permits that were previously issued for the site as suggested at the last meeting. Please see the letter included in your packet dated October 5 from Marianne Hanley. The applicant met with the Traffic Safety Advisory Work-Group on October 6 to discuss the location of the loading zone. Although we have not received a formal recommendation letter, it is my understanding through speaking with Mike Burns, who is a member of the work-group, that they are recommending approval of the loading zone as shown on the plan subject to the condition that the applicant grant to the Town/County a five (5) foot easement for roadway and loading purposes. 2 ƒ #18-09 Nantucket Golf Club Modification, 250 Milestone Road, action deadline 01-13-2010 The applicant is seeking a modification of the Nantucket Golf Club MCD to allow the surface of the employee and member parking lots to be changed from gravel to pavement. The applicant is also requesting to relocate and pave a cart path in the vicinity of Clubhouse and practice fairway. The change in impervious surface area for the site is within the 2.6% allowed by the MCD special permit. Staff recommends approval as submitted. ƒ #19-09 James R. Giffin, 15 Roberts Lane, action deadline 01-13-2010 The applicant is requesting a special permit to validate an existing second driveway access. The site is located at the corner of Roberts Lane and an un-named Way. One (1) existing driveway access is located off of Roberts Lane and the second driveway is located off of the un-named Way, which is constructed of dirt. The proposed second driveway would provide access to an existing garage. The un-named Way only services a few houses, and the traffic volume is extremely low. It is the opinion of staff that approval of the second driveway would not be contrary to traffic or safety considerations and would not adversely impact the scenic or historic integrity of the area. Staff recommends approval with the following conditions: 1. That pursuant to Zoning Bylaw section 139-20.1 an apron shall be constructed at the driveways intersection with Roberts Lane. The apron shall be a minimum depth of ten (10) feet and a maximum width of fifteen (15) feet, flared to a width not to exceed nineteen (19) feet; 2. That an apron shall be constructed at the intersection of the un-named Way and Roberts Lane. The apron shall be a minimum depth of twenty (20) feet and shall span the entire width of the Way; 3. That both aprons shall be installed within six (6) months from the date of the decision.
