Call meeting to order – Everyone should be present: 5 regular members/1 alternate. II. Approval of the agenda – Any additions/deletions may be made at the meeting. III. Minutes: ƒ June 9, 2008 – Ready for approval. IV. ANR’s: ƒ #7140 Richard J. Glidden & Kathryn L. Glidden, 93 Somerset Road (Map 66 Parcel 135) – This ANR plan is what is commonly referred to as a "perimeter plan" and shows the boundaries of a lot as described in a deed. This ANR plan may be endorsed "Approval under the Subdivision Control Law not Required". ƒ #7141 Neil W. G. Paterson & Joanne E. Sullivan, 9 & 11 Burnt Swamp Lane (Map 56 Parcels 223 & 227) – This ANR plan application is labeled incorrectly. I spoke with the surveyor and verified that this is a "conveyance plan". The frontages are remaining unchanged. A portion of the vacant parcel will be transferred to the already built upon parcel. The dashed line will be the new lot line. This ANR plan will need to go to the Land Court Office and at that time the Land Court will determine the numbering of the lots and how it wants the dashed line shown. NO NEW LOTS are being created via this plan. This ANR plan may be endorsed "Approval under the Subdivision Control Law not Required". ƒ #7142 Euse Mita, Shimmo Pond Holdings, 19, 21, 23 & 25 Shimmo Pond Road (Map 43 Parcels 97, 144 & 166) – This ANR plan shows four (4) existing lots. The lot line between Lot A and B and the lot line between Lot B and C changes via this plan. No frontages are changing. This ANR plan may be endorsed "Approval under the Subdivision Control Law not Required". REMINDER: Both the ANR plans and the Second Dwellings can be endorsed/approved as bundles if you so choose. V. Second Dwellings: ƒ Jill Ferrantella, 28 Youngs Way (Map 68 Parcel 790) – No planning issues, please see staff report. ƒ James R. Crane, 5 Salt Marsh Road (Map 55 Parcel 297) – No planning issues, please see staff report. ƒ NHA Properties, Inc., 2 Clarendon Street (Map 76.1.4 Parcel 149) – No planning issues, please see Nantucket Planning Board-2 Fairgrounds Road-Nantucket,MA 02554 508-228-7233 staff report. VI. Previous Plans: ƒ #6700 Marilyn Lane Subdivision, Correia Lane & Marilyn Lane, extension request for one year – Condition #7 on the last page of the decision notes "That all required infrastructure improvements be completed within two-years from the date of definitive plan endorsement.", which was February 9, 2004. Obviously four (4) years have gone by, but the required improvements have not changed and so staff recommends approving this one year extension to June 23, 2009 without re-opening the public hearing. VII. Public Hearings: ƒ #7084 WB Nantucket Holdings, 3 Arrowhead Drive, action deadline 06-30-08 – As this is a continued public hearing, the Chairman should acknowledge such and allow for public comment. Regular members are sitting on this application. No new plans have been submitted. Gary Winn will be present to explain the delay and has promised that plans will be delivered on schedule to allow Ed Pesce review prior to the July 14th meeting. You will need to approve an "action deadline extension" to at least July 31st, 2008. Staff recommends the extension to allow this project to be finalized. ƒ #7133 Philip Minella, 72 North Liberty Street, action deadline 08-10-08 – As this is a continued public hearing, the Chairman should acknowledge such and allow for public comment. Regular members are sitting on this application. You may recall from the last meeting that Ed Pesce has reviewed the plans and delivered a report to the Board and applicant. The applicant is addressing Ed's concerns and would like to be able to revise plans prior to your next review. Attorney Glidden will be present to explain progress to date and ask for a continuance. Please see his email to me dated June 18, 2008. Staff recommends the continuance in order to provide full review prior to your next meeting on July 14th. ƒ ##38-08 Cliffside Beach Club Modification, 46 Jefferson Street, action deadline 09-21-08 – This is a new public hearing and the Chairman should first ask if any regular member has a conflict and if so, the alternate member should be activated. If not the Chairman should call for a motion to open the hearing and allow the applicant to present the application, let the Board members discuss it, allow the public to comment, and if ready to take action, do so: Approve, approve with conditions, or deny. Attorney Glidden will present the application. Please see the modification application form and the addendum to compare with page 4 of Modification #4 which lists conditions #4 thru #17. You may recall there was legal action taken by abutters and the Court directed the applicant and abutter to reach an agreement. That was accomplished but requires this modification to the fourth (4th) modification of the original special permit. Staff recommends approval. VIII. Decisions: ƒ #7131 Thomas & Karen Craddock, action deadline 09-04-08 (Note: Draft decision) – Please see draft Decision. Mr. Craddock is having final legal documents prepared. IX. Other Business: ƒ Road Takings MGL 41-81 I (Town of Nantucket) – staff will present the plans for these road takings. Please see email of June 10th, 2008 in your packet. 1. Old South Road - portion of Lot B-2 to become Miller Lane. 2. Surfside Area – misc areas. • #14-04 Westmoor Club, Cliff Road & Westmoor Lane, FYI – please see letter concerning the Westmoor Club; letter on 18 India Street parking; and the Order on Motion for Partial Stay, Remand and Retaining Jurisdiction regarding the Cliffside.
