Call to order – No Board member absences have been reported however I will not be in attendance and so Senior Planner Leslie Snell will advise the Board on the following matters. II. Approval of the agenda – all set. III. Minutes: March 6, 2008 (Special Meeting) – ready for approval. July 14, 2008 – ready for approval. Note: the ANRs may be endorsed as a bundle if there are no issues with them. IV. ANR’s: ƒ #7147 Inhabitants of the Town of Nantucket, Miller Lane (between Old South Road & Airport Road) (Map 68 Parcel None) – This is the third part of the takings plan for Miller Lane: Part one you endorsed for the County Commissioners; Part two they signed off; now Part three the Planning Board may endorse this as an ANR plan creating the lots. This ANR may be endorsed as Approval Under the Subdivision Control Law Not Required. ƒ #7148 Nantucket Board of Selectmen, Cherry Street, Poplar Street between Nonantum Avenue and Atlantic Avenue and Western & Atlantic Avenue north of Western Avenue (Map 87 Parcels 58, 59, 105, 107-110 & 139) – This is the ANR plan which puts in plan format the real estate acquisition proposed in Article 109 of the 2008 Annual Town Meeting for portions of Poplar Street, Cherry Street, Western Avenue and Atlantic Avenue. This ANR may be endorsed as Approval Under the Subdivision Control Law Not Required. ƒ #7149 Nantucket Board of Selectmen, Sherburne Turnpike (Map 30 Parcels 174.1, 197 & 198) – This revised ANR plan shows the changes made per Town Counsel's request: 1) Title changed to "Proposed Modification of Sherburne Turnpike" and 2) Date changed to "February 2007". You previously endorsed this very same plan. This ANR may be endorsed as Approval Under the Subdivision Control Law Not Required. Staff Report for Planning Board Meeting Monday, July 28, 2008 ƒ #7150 Nonantum Nominee Trust, Kevin F. Dale Trustee, 160 Surfside Road (Map 87 Parcel 105) - This ANR plan is a simple conveyance plan which allows for the transfer of "Lot B" as shown on the plan to the Town of Nantucket for parking purposes in conjunction with the above noted plan ANR# 7148. This ANR may be endorsed as Approval Under the Subdivision Control Law Not Required. ƒ #7151 Dalton & Jennifer L. Frazier, 51 West Chester Street (Map 41 Parcel 228) – This ANR plan shows a minor lot line adjustment: the new lot line is the dark line separating lot 1 from lot 2 and the old lot line is the dashed line adjacent to it. This ANR may be endorsed as Approval Under the Subdivision Control Law Not Required. ƒ #7152 Frederick C. Coffin, Jr., Shirley Louise Coffin Spencer, Trustee of the Coffin Family Nominee Trust, 24 Trotters Lane & 31 Fairgrounds Road (Map 67 Parcels 147 & 149) – This ANR plan divides parcels 147 and 149 shown on map 67 into three new lots taking some land from the larger parcel 149, combining it with parcel 147 with the result of three new lots numbered 20, 21 & 22 all with adequate frontage and lot area. This ANR may be endorsed as Approval Under the Subdivision Control Law Not Required. ƒ #7153 David Hulme, Milestone Road (aka Main Street) (Map 73 Parcels 3.11 & 3.12) – This ANR plan shows Parcel A of 6,122 s.f. being separated from Lot 1with Parcel A to be conveyed to the abutting property. Parcel A is not a buildable lot in and of itself and the garage located on site will need zoning relief for side yard setback when combined with the abutting parcel and if it is not combined then the garage will need to be removed as it is not subordinate to a principal structure on site. This ANR may be endorsed as Approval Under the Subdivision Control Law Not Required. Note: the Second Dwellings may be approved as a bundle if there are no issues. V. Second Dwellings: For each second dwelling please see Venessa Moore's reports. ƒ 3 Norquarta Drive, Nantucket Housing Office/Aaron Marcavitch (Map 67 Parcel 511) ƒ 50 Vestal Street, Gillies & Patricia Bridier (Map 41 Parcel 56) ƒ 14 Tennessee Avenue, Randolph G. Sharp, Jr., (Map 60.1.2 Parcel 6) ƒ 51 West Chester Street, Dalton & Jennifer L. Frazier, (Map 41 Parcel 228) VI. Previous Plans: ƒ #03-86 Stop & Shop, 129 Pleasant Street/21 & 31 Sparks Avenue, removal of cart corrals – Please see Attorney Steven Cohen's memo to the Chairman explaining that since HDC disapproved of the design of the cart corrals presently installed and ordered their revision or removal, Attorney Cohen's client desired to remove the cart corrals. Since the cart corrals were proposed by the applicant and the Board approved the application "as shown on the plans and application materials" the MCD needs to be modified to remove that requirement or the applicant must seek re-design and approval from the HDC. The corrals are usually for the convenience and safety of the clients of the store they serve, i.e. keeping them out of the parking spaces, however if the Board determines their use to be obsolete then removing the requirement would not cause undue hardship. VII. Public Hearings: ƒ #7084 WB Nantucket Holdings, 3 Arrowhead Drive, action deadline 07-30-08 – REVISED SUBDIVISION PLANS HAVE BEEN SUBMITTED. Pesce Engineering & Associates have reviewed the revised plans and their memo to the Board is included. Please note that many 2 Staff Report for Planning Board Meeting Monday, July 28, 2008 previous comments remain unanswered and the design unchanged. The Board should review each comment presented, whether addressed or not, and determine if the response is satisfactory or whether further review is necessary. The applicant and/or his engineer may be able to provide a response at the meeting. However, since Mr. Pesce will not be in attendance, staff recommend extending the action deadline to August 31, 2008 to allow the applicant to respond to Mr. Pesce's comments at the August 11th meeting and to direct the staff to prepare a decision for consideration at the August 25th meeting in response to information presented at the August 11th meeting. ƒ #7133 Philip Minella, 72 North Liberty Street, action deadline 08-10-08- Staff met with Dan Mulloy, the applicant's engineer along with Mr. Pesce, the Board's engineering consultant and both Jeff Willet, DPW Director and Mohamed Nabulsi, Assistant Director to discuss the drainage issues in the general area of the proposed development site. A drainage study plan was developed by the Mr. Mulloy and was reviewed with all parties named above. Consensus was that the applicant is not making the area drainage situation worse but that they are unable to address correcting existing problems due to inability to obtain access rights to clean existing or install new drainage. The DPW faces the same challenge. Many of the existing drainage structures were placed in the area without benefit of easements or sound engineering design. Mr. Pesce has provided an updated review of the design based upon new information submitted. His letter to the Board is dated July 21, 2008. Please review his letter, the drainage analysis, and the drainage plan. In addition staff has in the office for review information on the pervious paving materials if the Board is interested. Staff recommends the Board determine if the applicant's responses to Pesce Engineering's comments, whether addressed or not, are satisfactory or whether further review is necessary. Mr. Pesce will be unable to attend the July 28th meeting but Mr. Willet and Mr. Nabulsi will be in attendance to discuss overall drainage issues. ƒ #40-08 Hither Creek Boatyard, Inc., 20 North Cambridge Street, action deadline 10-12-08 – Please see Pesce Engineering's July 22, 2008 memo to the Board and the Draft decision prepared for your consideration. Staff recommends that if the decision reflects the direction of the Board, that staff be directed to complete all preparations to bring this application to a close. ƒ #41-08 Nantucket Commons Modification, 5C,5D, 8D & 8E Bayberry Court, action deadline 10-26-08- You will recall that the Board discussed the issues involved at its July 14th meeting and was advised that a modification public hearing was scheduled for July 28th to address those issues. Attorney Marianne Hanley has provided a brief addendum to the application for modification of Special Permit #6-86 that explains exactly what the proposed modification will entail. Since this is a public hearing, the Board will need to open the hearing, listen to the applicant's presentation, take public comment, and if so inclined, close the public hearing and vote to approve, approve with conditions or deny. Board member Linda Williams excused herself from the discussion at the meeting of July 14th and will do the same on July 28th. Therefore the Chairman will need to activate an alternate to serve in her place. Staff recommends the Board consider public input and if no testimony contradicts the Board's understanding of the issues, that the Board approve the elimination of the inclusionary housing requirements and direct the Staff to prepare a decision for signature in the office. VIII. ZBA Cases: ƒ #44-08 Cynthia J. Thomas & Melinda as Owner, Cynthia J. Thomas as applicant,4 Sparks Avenue (Map 55 Parcel 191) – The Planning Board should recommend to the ZBA that the revised parking layout plan entitled "Sketch Plan of Proposed Salon" and attached at the 3 Staff Report for Planning Board Meeting Monday, July 28, 2008 end of the ZBA Public Notice appears adequate in that parking has been delineated for two (2 ) residential spaces off Goldstar Drive and four (4) spaces, one (1) of which is a handicapped space, off Milestone Lane. The applicant should be further directed to inform clients that parking other than on-site is prohibited and could jeopardize the applicant's permit to operate. The balance of these applications have no planning issues except for #52-08: ƒ #46-08 Barbara A. Mansfield, Trustee, 12 Greenleaf Road (Map 39 Parcel 46) ƒ #47-08 James R. Crane, 6 Salt Marsh Road (Map 55 Parcel 296) ƒ #48-08 Remain 54, LLC. 54 Main Street (Map 42.3.1 Parcel 193) ƒ #49-08 Anthony E. Beale & Ann Patricia Beale, 4 Mooers Avenue (Map 30 Parcel 247) ƒ #50-08 Richard E. Norton & Valerie G.B. Norton, 4 Tawpoot Road (Map 54 Parcel 112) ƒ #51-08 Kenneth S. Lindsay & Karyn S. Lindsay, Utah Avenue (Map 59.4 Parcels 168, 169, 225, 231, 232, & 233) ƒ #52-08 Killen, Walsh, McCrea, & Stone as Owners, Bouque as applicant, Nobadeer Farm Road/Hinsdale Road (Map 69 Parcels 114, 115 & a portion of 23) – Please review the site plan attached at the end of the ZBA Public Notice entitled "Feasibility Study Nantucket Millworks". The parking layout for spaces #9 – 12 and the ADA space are inadequate requiring backing out onto Nobadeer Farm Road. Since none of the structures shown have been built, the Board should advise the ZBA to instruct the applicant to revise the parking layout so that no vehicle will need to back out onto Nobadeer Farm Road. IX. Other Business: Planning Director Vorce will be present to lead discussion on the following. ƒ Road Taking MGL 41-81 I (Town of Nantucket) 1. Nobadeer Bike Path – Please see the easement plan prepared by GEOD Consulting. ƒ Planning Board application survey – Please see the draft survey to be given to applicant's after completing the development review process. ƒ House Bill #1770 – revisions proposed by the legislature.
