Call to order: Everyone should be present. II. Approval of the agenda: III. Minutes: ƒ August 25, 2008 – ready for approval. IV. Second Dwellings: ƒ 29 Kimball Avenue, Thomas Mleczko (Map 30 Parcel 24.2), extension request – The applicant simply needs more time to complete the project which was approved in 2006. Since there is a two (2) year time frame to complete the work, the applicant seeks the extension. Everything is exactly as previously approved. Staff recommends approval of the extension request. V. Public Hearings: ƒ #7084 WB Nantucket Holdings, 3 Arrowhead Drive, action deadline 08-30-08 – This public hearing remains open. In the packet please find Ed Pesce's August 16th, 2008 review. Several issues that are not fully addressed rise only to the level of staff intervention with the help of Ed Pesce to be solved. Other issues need your direct input to the applicant to be solved. Staff recommends that you direct Mr. Pesce to meet directly with the applicant's engineer, Bill Weller, to solve the lower level issues but ask directly of the applicant how he will solve the major issues. Staff incorporated all the information from the Planning Board members, applicant's representatives, abutters, and standard language used in all definitive subdivision (Approval Required) decisions. The decision may be amended/modified at the meeting to reflect the concerns of the Board. The public hearing remains open. ƒ #42-08 Westender Modification, 324 & 326 Madaket Road, action deadline 11-09-08 (Note: Draft decision) – Please review the DRAFT decision and the prior decisions applicable to this property for a historical perspective on how the property has evolved to its current use. Houghton, 7 Farmer Street (Map 42.3.4 Parcel 85) ƒ #58-08 Murat Aslansan, 1 Brock’s Court (Map 42.3.4 Parcel 85) ƒ #59-08 First Sun, LLC, 86 West Chester Street (Map 41 Parcel 533.1) Staff recommends you review only two (2) of the above ZBA cases: #54-08 Roche et al – the applicant is operating an automotive electronics repair shop out of a site previously used as a taxi depot however it is zoned residential so a special permit to change from one non-conforming use to another non-conforming use is being sought. Usually the Town attempts to bring properties into compliance with the Zoning By-law rather than perpetuating non-conformities. Staff recommends a negative recommendation on this special permit application. #58-08 Aslansan et al – the definition of a dwelling v. dwelling unit is confusing in the Zoning By-law. In this case the applicant is asserting that he is changing his "garage" use to a "living area" and also changing his "barn/workshop" use to a "living area". Neither one has a kitchen, so what are they? Question is that since only two dwelling units are allowed per lot, how should these "living areas" without kitchens be defined? VII. Other Business: ƒ Squam Road Association, discussion on update road maintenance- Planning Director Vorce will address this issue regarding improvements to be made to Squam Road. Please see information in your packet. ƒ Master Plan Chapter 41, Section 81-D, Update from Board of Selectmen – Planning Director Vorce will update the Board on the progress on the Master Plan to date. ƒ Please find miscellaneous information for your review.
