Call to order – No Board member absences have been reported. II. Approval of the agenda – all set. III. Minutes: March 6, 2008 (Special Meeting) – ready for approval. July 28, 2008 – ready for approval. IV. ANR’s: the ANRs may be endorsed as a bundle if there are no issues with them. ƒ #7154 Sarah Helen Taylor Stephenson, Trustee, 4 Nantucket Avenue (Map 30 Parcel 148) – This 23,462 sq. ft. parcel of land at 4 Nantucket Avenue is zoned R-1 which requires minimum lot size of 5,000 sq. ft. and 50 feet of frontage. The proposal slices off 5,042 sq. ft. for Lot 5 with 134.07 feet of frontage on Cliff Road (a public way) and 68.17 feet of frontage on Mooers Avenue, and leaves 18,420 sq. ft. for Lot 6 with 151.74 feet of frontage on Nantucket Avenue and Mooers Avenue, both ways in existence on February 16, 1955, the year the Subdivision Control Law became effective in the Town of Nantucket which must provide, in the opinion of the Board, safe and adequate access. Both do. This plan may be endorsed Approval Under the Subdivision Control Law Not Required. ƒ #7155 C’Scape Nominee Trust; Judith C. Dickinson & Jane Kelley King, 25 Nobadeer Avenue, Surfside (Map 80 Parcel 14) – This is a different version of a previous ANR plan (# 7043) the Board endorsed on May 31, 2007. This plan shows a lot line change between the two lots that will provide frontage for Lot 1 on Weweeder Avenue in addition to the frontage on Nobadeer Avenue. This plan may be endorsed Approval Under the Subdivision Control Law Not Required. ƒ #7156 Nancy E. Field & Michael Schulder, 33 Nonantum Avenue (Map 87 Parcel 49) – This plan slices off a sliver of land shown as Lot 2B which will be conveyed to the abutting property at #31 Nonantum Avenue. The resulting Lot 2A remains in compliance with zoning. This plan may be endorsed Approval Under the Subdivision Control Law Not Required. Staff Report for Planning Board Meeting Monday, August 11, 2008 ƒ #7157 C. Jacqueline Seidel, 23 Pine Crest Drive (Map 68 Parcel 433) – This plan separates Lot A (the parcel fronting on Old South Road) from Lot B (the parcel fronting on Hinsdale Road. Old South is public and Hinsdale provides safe and adequate access. Each lot has the requisite frontage for the RC-2 Zoning District (40 feet). This plan may be endorsed Approval Under the Subdivision Control Law Not Required. ƒ #7158 Stephen & Debra Lawrence, 17 Allen’s Lane (Map 55 Parcel 95) – Previously the Board reviewed this ANR plan and advised the applicant to withdraw without prejudice due to a fence and gate located within the roadway. Both the gate and fence have been removed from the roadway and while both roads remain unpaved, they are passable and provide safe and adequate access to the new lots created. This plan may be endorsed Approval Under the Subdivision Control Law Not Required. ƒ #7159 Mathew K. Reinemo, Brinda Lane (Map 67 Parcels 315, 315.1 & 316.1) – This plan shows four (4) newly configured lots from three existing lots (see GIS handout). Three of the new lots have the requisite frontage of 75 feet on Hooper Farm Road (a public way) and the fourth lot (Lot 115) has 75 feet of frontage on Brinda Lane (a 40 foot wide private way providing safe and adequate access). This plan may be endorsed Approval Under the Subdivision Control Law Not Required. V. Previous Plans: ƒ #2976 Cedar Crest III, Form J-release of lots 629-633 – Please find a new Form J seeking release from the Covenant for Lots 629 through 633 (5 lots). The Board is still holding under covenant eight (8) lots which will not be released until all final cleanup within the subdivision is complete. This form J may be endorsed. ƒ #1351 Paul R. Harrington, Form J-re-signing - Please find a letter to the Board dated August 4, 2008 from Attorney Richard P. Beaudette along with a new Form J for you to sign. Previously in 1976 the Board endorsed a Form J releasing the covenant for this two (2) lot subdivision. This form J may be endorsed. VI. Public Hearings: ƒ #7084 WB Nantucket Holdings, 3 Arrowhead Drive, action deadline 08-30-08 – REVISED SUBDIVISION PLANS HAVE BEEN SUBMITTED, AGAIN. Pesce Engineering & Associates have been given the re-revised plans to review and their memo to the Board will be completed for the August 25, 2008 meeting. Many previous comments remained unanswered and the design unchanged after the previous revision was done. The current revised plans reflect the corrections suggested by Mr. Pesce. At the August 25, 2008 meeting the Board should review each comment presented and determine if the response is satisfactory or whether further review is necessary. The applicant and/or his engineer will be at the meeting. The action deadline was extended to August 30, 2008 to allow the Board to respond to Mr. Pesce's comments for consideration at the August 25th meeting and possibly to bring this matter to a close. ƒ #7133 Philip Minella, 72 North Liberty Street, action deadline 08-30-08- Dan Mulloy, the applicant's engineer has submitted final plans for consideration which reflect minor technical issues Mr. Pesce, the Board's engineering consultant, advised needed to be addressed. Jeff 2 Staff Report for Planning Board Meeting Monday, August 11, 2008 Willet, DPW Director and Mohamed Nabulsi, Assistant Director addressed the drainage issues at the July 28, 2008 meeting and the drainage study plan developed by Mr. Mulloy was reviewed with all parties. Staff recommended previously the Board determine if the applicant's responses to Pesce Engineering's comments were satisfactory. The Board directed the applicant and Mr. Pesce to work the issues out. Revised plans indicating the minor revisions have been reviewed. The revised plans show a thirteen (13) lot subdivision with larger sized lots and a roadway that meets the requirements for roadways as reviewed by Mr. Pesce. Staff directs your attention to the revised plans and the email dated July 31, 2008. This matter may be ready to bring to a close. ƒ #40-08 Hither Creek Boatyard, Inc., 20 North Cambridge Street, action deadline 10-12-08 – Please see the draft decision, specifically condition #8 which addresses the issue of defining "boats". This definition is in agreement with previous town decisions regarding boat storage. Staff recommends that if the decision reflects the direction of the Board, that staff be directed to complete all preparations to bring this application to a close. ƒ #42-08 Westender Modification, 324 & 326 Madaket Road, action deadline 11-09-08 (Note: Draft decision for the Board's review enclosed).
