The meeting took place in the Court Room, Town and County Building, 16 Broad Street, Nantucket, MA 02554. Members of the Commission present were Rick Atherton, Brian Chadwick, Michael Kopko, Allen Reinhard, and Patricia Roggeveen. Chairman Chadwick called the meeting to order at 7:14 PM. ANNOUNCEMENTS None. PUBLIC COMMENT None. APPROVAL OF MINUTES, WARRANTS AND PENDING CONTRACTS Approval of Minutes of 18 December 2008 at 9:00 AM. The minutes of 18 December 2008 at 9:00 PM were approved by unanimous consent of the meeting. Approval of Payroll and Treasury Warrants for March, 2009. The payroll and treasury warrants for the month of March 2009 were approved by unanimous consent of the meeting. COMMISSIONERS REPORTS/COMMENTS Update on House Bill 103 (An Act Transferring County Sheriffs to the Commonwealth). Chairman Chadwick reviewed a committee hearing he attended recently at the State House regarding the state taking over the County Sheriffs and noted an amendment presented at the hearing to retain a specific amount of local County funding was well received by Senator O’Leary and Representative Madden. County Manager C. Elizabeth Gibson explained that the Massachusetts Association of County Commissioners put forth an amendment on Nantucket’s behalf which would exempt Nantucket from portions of the proposed legislation. Ms. Gibson said the hope is to keep all or a portion of Nantucket’s County Deeds Excise funds on Nantucket to help fund all or a part of the debt service for the new police station. Update as to Execution of Letter Agreement with Sheriff for County Funding Commitment. Chairman Chadwick said he was hopeful the Sheriff would sign a document supporting the commitment of funds for the construction of the police station. Mr. Kopko noted that if the agreement is not signed this potential source of funding could be taken over by the state, and that if the agreement is signed, it could potentially save Nantucket taxpayers up to $7.5 million over the life of the police station debt service. He said he anticipates the Sheriff signing the agreement in a timely manner. Request to Amend FY 2009 County Budget. Ms. Gibson said the request is to amend the FY 2009 County budget to use the Corrections Deed Excise fund balance for the police station project. She noted that the fund balance currently is $1.2 million. She said the proposal seeks to increase the current County Administration budget by $850,000. Ms. Gibson also reviewed the three-step approval process, which includes approval by the Nantucket County Commissioners, approval by the Finance Committee acting as the County Review Committee, and approval by the state County Government Finance Review Board. Mr. Kopko, after encouraging Ms. Gibson to request the Sheriff to sign off on the amendment, moved to amend the FY 2009 County budget by increasing it 2 by $850,000 to be dedicated to the police station project; Mr. Atherton seconded. All in favor, so voted. Ms. Gibson additionally requested an amendment to the FY 2010 County budget which she noted the County Commissioners and the Finance Committee acting as the County Review Committee already approved. She explained that amendment would correct a miscalculation on the maintenance of effort number for the Registry of Deeds which was under-budgeted by $67,600. Ms. Gibson said the County fund balance can cover the correction. Ms. Roggeveen moved to approve the amendment to the FY 2010 county budget; Mr. Reinhard seconded. All in favor, so voted. Chairman Chadwick notified the public of a special County Commissioners meeting currently scheduled for 1 April 2009 to discuss the Sheriff’s claim to unused vacation and sick pay, and noted the meeting has been scheduled at the Sheriff’s request. The meeting was unanimously adjourned at 7:34 PM. Approved the 30th day of December, 2009.
