HomeMy WebLinkAboutCounty Commission Minutes 07-23-2008_201402051726444313COUNTY COMMISSIONERS Minutes of the Meeting of 23 July 2008 at 6:00 PM. The meeting took place in the Town and County Building, 16 Broad Street, Nantucket, MA 02554. Members of the Commission present were Brian Chadwick, Patricia Roggeveen, Rick Atherton, Allen Reinhard and Michael Kopko. Chairman Chadwick called the meeting to order at 6:40 PM, following a meeting of the Board of Health. Approval of Minutes of 28 May 2008 at 6:00 PM; 11 June 2008 at 6:00 PM; 25 June 2008 at 6:00 PM. The minutes of 28 May 2008 at 6:00 PM; 11 June 2008 at 6:00 PM and 25 June 2008 at 6:00 PM were approved by the unanimous consent of the meeting. Approval of Payroll and Treasury Warrants for July 2008. The payroll and treasury warrants for July 2008 were approved by the unanimous consent of the meeting. With regard to one of the Sheriff’s invoices, the Commission voted unanimously to send the Sheriff a letter requesting information on his “gun policy.” Public Hearing Pursuant to Section 2.5 of County Charter to Consider Acceptance of Grant of Easement at 204 Cliff Road. Chairman Chadwick excused himself from the table and left the room thus abstaining from the following discussion and vote. Vice-Chairman Atherton, acting as Chairman, opened the hearing and asked if any individual was present to speak in favor of the easement. Planning Director Andrew Vorce spoke in favor. As no individual was present to speak in opposition, Chairman Atherton closed the hearing. Mr. Reinhard explained the purpose of the easement noting it provides legal access to the Founders burial ground. Mr. Reinhard commended the Public Works Department for the new signage at the location and moved, pursuant to section 2.5 of the County Charter, to accept the grant of easement from the Nantucket Angler’s Club; seconded by Mr. Kopko. So voted unanimously. Chairman Chadwick returned to the room and took his seat at the table. Public Hearing Pursuant to Section 2.5 of the County Charter to Consider Acceptance of Grant of Easement Near 57 Prospect Street. Chairman Chadwick opened the hearing and asked if any individual was present to speak in favor of the easement. Planning Director Andrew Vorce spoke in favor and explained the purpose of the easement. As no individual was present to speak in opposition, Chairman Chadwick closed the hearing. Mr. Kopko moved, pursuant to section 2.5 of the County Charter, to accept the grant of easement from Nantucket Cottage Hospital for sidewalk purposes; seconded by Ms. Roggeveen. So voted unanimously. Approval of Order of Layout of Portion of Miller Lane. Planning Director Andrew Vorce provided some background noting this matter first came before the Commission in 2006 and the plan to lay out a portion of Miller Lane has now been completed and accepted by the Planning Board. Chairman Chadwick noted that a viewing took place earlier today and there was no individual present to voice any opposition. Chairman Chadwick apprised the Commission that a citizen’s petition has been submitted asking the Commission to further extend Miller’s Lane as an improved roadway and this issue will be addressed at a public hearing at a future date. Mr. Reinhard moved that, pursuant to Massachusetts General Laws Chapters 82 and 79, as amended, and Article 1 of the Nantucket County Charter, St. 1996, c. 290, § 4, common convenience and necessity require the layout of a portion of Miller Lane as a public way from its intersection with the western sideline Minutes of the Meeting of 23 July 2008 – 6:00 PM Page II. of Airport Road (formerly known as Macy’s Lane) northwesterly to a boundary of a line between two corner bounds as shown on the Plan hereinafter described for all purposes for which a public way may be used in the County and Town of Nantucket, and do hereby adopt and decree this Order of Layout on behalf of the County, and do hereby lay out, as a public way for all purposes for which a public way may be used in the County and Town of Nantucket, including but not limited to providing and improving access for and safety of pedestrians and operators of emergency and motor vehicles and bicycles and installing utilities, the land (the “parcel”) bounded and described on Land Court Plan 16514-B and entitled “Land Court Division Plan of Land in Nantucket, MA.,” dated June 16, 2008, prepared for Town of Nantucket by Blackwell & Associates, Inc. and filed with the Nantucket County Registry of Deeds District of the Land Court; seconded by Ms. Roggeveen. So voted unanimously. Endorsement of Subdivision Plan; Approval of Conveyance of Property to Town of Nantucket from County of Nantucket Pursuant to Vote on Article 73 by 2007 Annual Town Meeting for Portion of Property Along Sherburne Turnpike. Planning Director Andrew Vorce explained the reason for the conveyance and Mr. Reinhard moved to endorse the subdivision plan conveying property along Sherburne Turnpike from the County to the Town (copy of Act attached); seconded by Ms. Roggeveen. So voted unanimously. Adoption of Compensation Schedule for Nantucket County Employees. Assistant Town Manager Malachy Rice explained the proposed schedule, noting that it has been reviewed by Town Counsel. After some discussion, Mr. Kopko moved to approve the schedule, as recommended; seconded by Mr. Reinhard. So voted unanimously. The meeting adjourned at 7:10 PM. Approved the 27th day of August 2008.
