Minutes of the Meeting of 25 June 2008 at 6:00 PM. The meeting took place in the Town and County
Building, 16 Broad Street, Nantucket, MA 02554. Members of the Commission present were Brian
Chadwick, Patricia Roggeveen, Rick Atherton, Allen Reinhard and Michael Kopko. Chairman Chadwick
called the meeting to order at 6:00 PM.
Approval of Pending Contracts for 25 June 2008. The pending contracts for 25 June 2008 were
approved by the unanimous consent of the meeting.
Approval of Payroll and Treasury Warrants for June 2008. The payroll warrant and treasury
warrants for June, 2008 were approved by the unanimous consent of the meeting.
Request for Adoption and Approval of Order of Layout and Taking By Eminent Domain or
Otherwise Acquiring Portions of a Certain Way Known as Macy’s Lane, between Old South Road
and Hinsdale Road, for the Purpose of Use as a Public Way. Chairman Chadwick opened the
hearing and noted that a viewing took place earlier at the subject location and there were no
objections expressed. Transportation Planner Mike Burns explained the reason for the layout and taking
and noted that the taking has no adverse effects on abutters. As no objections were expressed to the taking,
Chairman Chadwick closed the hearing. Mr. Atherton moved that the County Commissioners, in accordance
with the provisions of Chapter 82 and Chapter 79 of Massachusetts General Laws, hereby adopt and
approve the order of taking by eminent domain and layout of a portion of Macy’s Lane, Hinsdale Lane
(portion) shown on plans entitled “Layout and Taking Plan for Macy’s Lane, Hinsdale Road (portion) in the
Town and County of Nantucket, MA., dated November 6, 2007 by GEOD Consulting, 24 Ray Avenue,
Burlington, MA 01803 (the “Plan”), and as more particularly described in said Order of Layout and Taking.
Mr. Atherton further moved that the Commissioners, in accordance with the provisions of Chapter 79 of the
Massachusetts General Laws, hereby adopt and approve the Resolution Regarding Damage Award Layout
and Eminent Domain Takings Macy’s Lane, Hinsdale Road (portion) and that the Commissioners vote to
endorse the sheets of the Plan entitled “Layout and Taking Plan for Macy’s Lane, Hinsdale Road
(portion) in the Town and County of Nantucket, MA, “ dated November 6, 2007 by GEOD
Consulting, 24 Ray Avenue, Burlington, MA 01803 and that the Commissioners hereby direct the
administrative staff to record the order of taking and plans with the Nantucket Registry of
Deeds/Nantucket Registry District of the Land Court within the statutory thirty (30) days; seconded
by Mr. Kopko. So voted unanimously.
Request for Approval of FY 2008 Supplemental Budget (non agenda item). County Manager C. Elizabeth
Gibson explained that fiscal year 2008 county expenses need to be increased by $80,000 to cover
legal and surveying expenses that exceeded the budget. Ms Gibson stated the funding will come
from unobligated county administration deeds excise fund balance. Mr. Atherton moved to approve
the amendment; seconded by Mr. Reinhard. So voted unanimously.
At 6:15 PM, Chairman Chadwick polled the Commission and Ms. Roggeveen, Mr. Kopko, Mr.
Reinhard, Mr. Atherton and Chairman Chadwick voted unanimously to adjourn to Executive
Session, following an open session of the Board of Selectmen, not to return to open session of the
County, for the purpose of discussing real estate disposition.
