B. EXECUTIVE SESSION: The Executive Session is for Purpose 6 [G.L. c. 30A, 21(a)(6)J. The
particular transactions and parcels of real estate are not identified since disclosure of the
property information may have a detrimental impact on the Land Bank's negotiating position
with one or more third parties. The Commission will not reconvene in open session at the
conclusion of executive session.

CALL TO ORDER: 4:00 p.m.
PRESENT: Richard Glidden, Neil Paterson, Allen Reinhard, John Stackpole, Kristina Jelleme.
STAFF PRESENT: Eric Savetsky, Executive Director; Susan Campese, Administrator/Finance
Manager; Marian Wilson, Assistant Administrator.
Community Preservation Committee, Land Bank Representative, Ken Beaugrand, and Marleah
Lydon were also present at call to order.
I. CONVENE IN OPEN SESSION:
A. PUBLIC COMMENTS / STAFF ANNOUNCEMENTS: None.
B. REGULAR BUSINESS:
L Community Preservation Committee ("CPC") Representative — Update: Mr.
Beaugrand reported that Fiscal Year 2021 requests totaled over $4,000,000 and they expected to be
able to fund approximately $2,400,000, with $240,000 (10%) allocated to open space/recreation-
There were four applications for open space/recreation that total $643,967 which included
Nantucket Platform Tennis Association, Linda Loring Foundation, Sustainable Nantucket
Community Farm Institute, and the Dreamland's application for $443,690 for the development of
Mr. Rogers' Neighborhood Park. Mr. Beaugrand asked the Commission for guidance regarding the
impact of installing another park across the street from the Land Bank's Easy Street Park. Mr.
Beaugrand inquired whether Joe Hale, Executive Director, of the Dreamland Theatre had been in
contact with the Land Bank. Mr. Savetsky confirmed that he had spoken with Mr. Hale regarding
the aforementioned lot designated for the park and did not anticipate any conflict. Commissioner
Jelleme concurred with Mr. Beaugrand's assessment of Land Bank support for the CPC open
space/recreation grant applicants and stated that the lowest priority should be the Dreamland
request. Chairman Paterson thanked Mr. Beaugrand for his hard work on behalf of the Land Bank.
Mr. Beaugrand departed the meeting at 4:26p. m.
C. TRANSFER BUSINESS:
1. Five -Year Ownership Noncompliance — Request for Waiver/No. 36694
Christopher R. Lydon and Marleah Lydon: Ms. Lydon explained that she and her husband
purchased their home 4 years ago at Tristram's Landing and confirmed that they are year-round
residents and with the addition of a child and anticipating a second child, they have outgrown their

living space. Therefore, they have listed their home on the market and are planning to purchase a
larger home on the island in December 2019. Ms. Lydon requested a waiver for the accrued penalty
and interest due to the extenuating circumstances. Furthermore, she inquired if any of the $8,000.00
fee could be prorated or forgiven based on the 4 years, they were in compliance with the exemption
requirements. Ms. Lydon stated that she did not understand the reasoning behind the "M"
Exemption first time home buyers 5 -year requirement. Mr. Savetsky clarified that when the "M"
exemption was created, the five-year domicile requirement was to deter purchasers from purchasing
properties for speculation and claiming the exemption which was meant to assist first time
homeowners. Discussion ensued and the Commission asked Ms. Campese to review the
requirements of the exemption and to determine the feasibility of making any changes. Chairman
Paterson thanked Ms. Lydon for her comments and agreed to take it under advisement; he
confirmed that a decision will be delivered at the October 22, 2019 meeting.
Ms. Lydon departed the meeting at 4:27p.m.
D. GOLF BUSINESS:
1. Miacomet Golf Clubhouse Replacement — Project Update: Mr. Savetsky noted
that MGC'clubhouse construction is about 95% completed. The temporary trailer was scheduled for
disconnection and move to the parking lot on October 10, 2019 so site work can be completed. Mr.
Savetsky anticipated the temporary occupancy permit to be issued on October 18, 2019, although a
few days of progress may be lost to weather due to a nor'easter this week. Commissioner Jelleme
acknowledged that Mr. Costa had forwarded her the Dellbrook completion schedule upon request.
Mr. Savetsky advised the Commission to expect ACG to request additional compensation due to
substantial additional work caused by missing plan details and/or errors by the architect. Mr.
Savetsky commented that the Miacomet Golf Course Summer Employee Administration, Housing,
and Storage Facility septic work was underway with TCE Construction. The modular units are
scheduled to be moved onto the property at the beginning of November.
2. Warrant Authorization — Clubhouse Requisition: Upon a motion made by
Commissioner Glidden and duly seconded by Commissioner Stackpole, it was unanimously
VOTED to execute the October 9, 2019, warrant document in the amount of $1,150,936.28 to be
provided to the county treasurer.
E. PROPERTY MANAGEMENT:
1. Cisco Beach — Post Season Review: Mr. Savetsky displayed photographs of
vendor operations at Cisco Beach during the summer. Chairman Paterson had received a complaint
with concerns about the Nantucket Surf School operations. Mr. Savetsky displayed recent photos
showing surfing equipment strewn all over the bushes. Further, he raised concerns that Gary
Kohner's business has grown substantially and his business may be taking up too many parking
spaces at the front of Cisco Beach. Additionally, a discussion followed regarding the mobile vendor
operations and their parking arrangements. Commissioner Jelleme recommended putting in
parameters on future mobile vending licenses to include, parking in the back of parking lot instead
of beach front, limiting the size of the operation to a defined area, eliminating employee parking up

front. The Commission encouraged the Land Bank staff to present recommendations for new
commercial vendor policies at a future meeting.
2. 48 Tennessee Avenue/Chase Dock — Dock Replacement Update: Mr. Savetsky
reported that replacement of the boardwalk and dock was scheduled to start soon, and a large crane
would be on the property for a few weeks to drive pilings in. Further, the new walkway will be
three feet above the creek per wetland regulations and Land Bank staff will reach out to the
Madaket Civic Association to alert them of the project.
F. REGULAR BUSINESS:
1. Cross -Island Hike — Post Hike Update: Ms. Campese displayed numerous
photographs of the Cross -Island Hike and confirmed that around 200 participants enthusiastically
followed the trail segments and approximately 60 people finished the entire 20 -mile hike. Chairman
Paterson expressed appreciation for Land Bank staff's organization and success of the first Cross
Island Hike. Commissioner Reinhard acknowledged the staff's efforts to pull together a major event
in a short time. Mr. Savetsky informed the Commission that the other conservation organizations
were interested in collaborating to make a permanent cross -island trail.
G. APPROVAL OF MINUTES:
1. Upon a motion made by Commissioner Glidden and duly seconded by
Commissioner Reinhard, it was unanimously VOTED to accept, approve and release the regular
session minutes of September 24, 2019 as corrected.
H. TRANSFER BUSINESS:
1. September 2019 Transfers — Record Nos. 40997 through 41090: The Commission
reviewed transfers for the period of September 1, 2019 through September 30, 2019.
a. Current "M" Exemptions and Liens: The Commission authorized the placing of
liens against the following properties as a result of the purchasers claiming the "M" exemption as first-
time buyers of real property:

b. Current "O" Exemption and Lien: The Commission authorized the placing of
lien against the following property as a result of the purchasers claiming the "O" exemption as part of a
deed -restricted affordable housing program:

c. Two—Year Domicile Non -Compliance — Request for Waiver/No. 41148
Kimberly Dadah: Ms. Campese explained that Ms. Dadah had purchased her condominium, Unit A
at 18 Miacomet Avenue, in October 2017 and she had called the office prior to her 2 year "M"
check to explain a series of unexpected life changes which prevented her from moving to the island
within two years and meeting the full time residency domiciling requirement for the first time
homebuyers "M" exemption. Ms. Dadah sent a cashier's check to repay the $9,000.00 Land Bank
fee, additionally, she also sent an email request to the Commission requesting a waiver on the
Penalty and Interest on the $9,000.00 fee due to her changes in circumstances. Ms. Campese did
not recommend waiver of penalty or interest as the change of circumstances did not seem to be due
to any hardship and further Ms. Dadah had never lived on the island, yet she appeared to be keeping
the property as a rental unit. Upon a motion made by Commissioner Glidden and duly seconded by
Commissioner Jelleme, it was unanimously VOTED to deny the request for waiver of accrued
penalty and interest as recommended by staff.
I. FINANCIAL BUSINESS:
1. Monthly Transfer Statistics: Monthly transfer statistics reports comparing calendar
years 2018 and 2019 through September 2019 were presented to the Commission.
2. Warrant Authorization — Cash Disbursements: Upon a motion made by
Commissioner Stackpole and duly seconded by Commissioner Jelleme, it was VOTED to execute
the October 9, 2019 warrant document in the amount of $287,298.19 to be provided to the county
treasurer.
II. EXECUTIVE SESSION: Upon a motion made by Commissioner Stackpole and duly seconded
by Commissioner Reinhard, it was unanimously VOTED to go into executive session in order to
discuss the purchase, exchange, lease or value of real property. A roll call vote was taken Jelleme-
Aye, Reinhard -Aye, Paterson -Aye, Stackpole-Aye, Glidden -Aye. The Chairman under Purpose 6
[G.L. c. 30A, 21(a)(6)] declared that discussion of these matters in open session may be detrimental
to the Land Bank's negotiating position and that the Commission would not reconvene in regular
session following executive session. /
