Dear BOS,
As you may now be aware, the DEP has issued a decision in the SBPF appeal of the Conservation Commission’s denial of the geotube NOI application. The existing 3-tier system was installed
under an Emergency Order, and SBPF and the Town had jointly applied to keep and finish the
geotube system by installing a fourth tier, installing returns on the ends, and vegetating the face of the bluff. The DEP decision upholds SBPF’s appeal and issues a Superseding Order of Conditions, which is a state permit for the proposed work. The DEP Decision is detailed and complex. I
request that you schedule an agenda item on the BOS Meeting on January 7, 2015 for SBPF and
Town staff to update you on the details of the DEP Decision. Best
