Rick ____________________________________________________________________________ _________ RICK ATHERTONPO Box 3126Nantucket MA 02584508.228.2366rickatherton@comcast.net Draft outline:Agreement between BOS and SBPF 1.SBPF,the Sconset Trust,Sankaty Head Golf Club and all affected private stakeholders to assist Town in developing and finalizing alternative access and utilities plans for Baxter Road. 2.BOS confirms that imminent danger to public assets and private property exists as a result of past winter's storms.BOS recognizes that this does not change the requirement for Con Com review and approval.It simply expresses the BOS's view of the urgency of the situation. 3.BOS will work with SBPF,the 'Sconset Trust,Sankaty Head Golf Club and private stakeholders in 'Sconset to develop and implement an emergency and long term plan to protect Baxter Road and its utilities as well as private property. 4.The BOS endorses the concept of installing a continuous revetment from the end of Baxter Road at Sankaty Lighthouse to the southernmost point at which erosion impacts the toe of the bluff,currently approximately 53 Baxter Road.The BOS recognizes that the most vulnerable sections will be constructed first so that on an interim basis the revetment may not be continuous during what will necessarily be a two season installation period.The plan will include annual and post-storm monitoring of infrastructure and possible sand re-nourishment needs. 5.The following timeline is agreed to in order to protect Baxter Road in winter of 2013:a Notice of Intent (NOI)must be filed prior to July 1,a Con Com decision supporting the application must be issued in July and work must begin in August. 6.SBPF agrees to privately fund for emergency work for 2013,and BOS agrees to support the public private funding mechanism post-2013 to enable a formalized cost sharing agreement to be put in place,with specifics to be approved by BOS by mid-July.SBPF to substantially fund the long term infrastructure and property protection.Hold Town's share to a fraction of the Town's full reasonably expected cost of alternative access/utilities if infrastructure protection has not been installed. 7.SBPF agrees to secure abutter consents to infrastructure and property protection, alternative access/utilities plans,public access plans,and other needed rights and consents.
