The particular transactions and parcels of real estate are not identified since disclosure of the property information may have a detrimental impact on the Land Bank's negotiating position with one or more third parties; and for Purpose 3 [G. L. c. 30A, 21(a)(3)J. Discussions concerning strategy with respect to ongoing litigation. The Commission will not reconvene in open session at the conclusion of executive session. 1. Nantucket Conservation Commission et al, Nantucket Superior Court, Case No. 1875CV0003 44 ADJOURNMENT MINUTES Nantucket Land Bank Commission Regular Meeting of April 9, 2019 Land Bank Conference Room, 22 Broad Street Nantucket, Massachusetts CALL TO ORDER: 4:00 p.m. PRESENT: Kristina Jelleme, Neil Paterson, Allen Reinhard, John Stackpole. A13SENT: Richard Glidden. STAFF PRESENT: Eric Savetsky, Executive Director; Susan Campese, Administrator,'Finance Manager; Marian Wilson, Assistant Administrator; Leedara Zola, Project Manager. Inquirer and Mirror Reporter, Brian Bushard,- Steve and Karla Butler and Samuel Daniels, Siasconset residents were also present at call to order. 1. CONVENE IN OPEN SESSION: A. CITIZEN BUSINESS/ANNOUNCEMENTS: None. B. PROPERTY MANAGEMENT: 1. Codfish Park Playground — Shade Discussion: Chairman Paterson opened the discussion asking for civility and decency which he said was lacking in some of the emails the Commission received in response to the Historic District Commission ('`HDC") notification for the Land Bank's application to add two pergolas, a picnic table and to replace two open slides with tube slides. He explained that there had been requests for an additional table and shade on the equipment and sitting areas due to the heat and lack of breeze in the summer months. Mr. Savetskv explained that the application to the HDC was to see if the concept would be acceptable, but the Commission had not approved it yet. Mr. Butler and Mr. Daniels expressed their frustration at the short notice for the meeting and further Mr. Butler explained that many of the neighbors already felt the design of the playground was not in keeping with Codfish Park and adding further elements. particularly the tube slides xNas upsetting to some. Commissioner Jelleme asked the neighbors to email their suggestions on ho« to create shade which was the challenge before the Commission. Chairman Paterson reported that the 1 -IDC application has been postponed for a few weeks and all suggestions would be taken under advisement. Rachael Freeman, Environmental Coordinator entered the meeting at 4: I Sp.m. Mr. Daniels, Mr. and Mrs. Butler departed the meeting at 4: 25 p.m. C. GOLF BUSINESS: 1. Miacomet Golf Clubhouse Replacement — Project Update: Mr. Savetsky reviewed the Project Update submitted by Architectural Consulting Group ("ACG") and reported that framing had started and interior partitions are ongoing, but according to the master schedule the project was behind about one week. Warrant Authorization — Clubhouse Requisition: Upon a motion made by Commissioner Reinhard and duly seconded by Commissioner Jelleme, it was unanimously VOTED to execute the April 9, 2019, warrant document in the amount of $820,318.73 to be provided to the county treasurer. D. PROPERTY MANAGEMENT: 1. Dog Park — Planning Update: Ms. Zola reported she had received some information with qualifications for a few dog park designers and had also viewed several parks on Cape Cod. Additionally, she was pulling together a workgroup with representation from various interests and would report back to the Commission at a future meeting. 2. 71 Washington Street — Planning Discussion: Mr. Savetsky reported that he and property staff had met on the property and recommended a less formal version of the park at 50 Union Street with a couple of benches and a fence at the back of the property with some shrubs. In the interim the site would be loamed and seeded. 3. Easy Street Park — Bulkhead Replacement Discussion: Ms. Freeman informed the Commission that she had contacted AGM Marine Contractors and had requested a second opinion on the merits and drawbacks of various materials and costs associated with them. AMG proposed a complete report along with field testing and a presentation to the Commission for $21,850, however Ms. Freeman said the proposal could be pared down. The consensus of the Commission was go forward with getting the second opinion since replacing the bulkhead was such a large project, but to cut out the written report and to have AGM present the options at a Commission meeting. 4. Gardner Farm — Canine No Trespass Order: Mr. Savetsky explained that the Land Bank had signed a 60 day No Trespass Order for the Gardner Farm property against Frank Daily and his two dogs on the recommendation of the Town Animal Officer. A log of incidences was provided by the Animal Officer outlining the numerous attacks on other dogs that were hospitalized as well as two nearby goats that later died of their injuries. After some discussion upon a motion made by Commissioner Reinhard and duly seconded by Commissioner Jelleme, it was unanimously VOTED to issue a No Trespass Order for one year on all Land Bank properties against Mr. Daily and his dogs for the safety of the public and further to notify town officials of the action. 5. Nobadeer Farm/Pickle Ball — Sewer Connection Fee Discussion: Mr. Savetsky told the Commission that it was determined that the expansion of four pickle ball courts by Nantucket Paddle Tennis Association ("NPTA") required a sewer connection that would cost approximately $20,000. NPTA had received a grant from the Community Preservation Commission to build the courts but could not use the funds for the sewer connection. After some discussion upon a motion by Commissioner Stackpole and duly seconded to Commissioner Reinhard, it was unanimously VOTED to pay for the sewer work and connection fee with NPTA responsible for all use fees. Ms. Freeman departed the meeting at S: 00 p.m. 6. Petrel Landing/ 17 Commercial Street — Figawi V.I.P. Tent Request: Commissioner Stackpole presented a request from Figawi, Inc. to have their VIP tent set up at Petrel Landing from Friday, May 24, 2019 through Monday morning May 27, 2019 to be used for meetings, award Land Bank Commission April 9, 2019 Pate ; ceremonies and sponsor receptions as they had in prior years. Upon a motion made by Commissioner Reinhard and duly seconded by Commissioner Jelleme. it was unanimously VOTED to approve the request as in previous years, subject to the Land Bank named as additionally insured on their insurance policy. Commissioner Stackpole presented a donation from Figawi Charities, Inc. for 51,000 to the Land Bank. The Commission asked Ms. Campese to send a letter of thanks to Figaxvi Charities, Inc. 7. Dump Truck Replacement — Request: Mr. Savetskv presented a request from Land Bank Property Foreman Jeff Pollock for a new F550 dump truck to replace the 1997 F350 dump truck which was in need of repairs. Mr. Pollock had received a state contract price for 570,913.60 and �N as seeking additional prices. Upon a motion made by Commissioner Stackpole and duly seconded b, Commissioner Jelleme, it was unanimously VOTED to approve the expenditure fora new truck «ith a price not to exceed $73,000. E. APPROVAL OF MINUTES: Upon a motion by made by Commissioner Stackpole and dul% seconded by Commissioner Reinhard, it was unanimously VOTED to accept, approve and release the regular session minutes of March 26, 2019, as written. F. REGULAR BUSINESS: 1. Memorandum of Understanding ("MOU") between Town of Nantucket Fire Department and Nantucket Islands Land Bank — Signatory Authorization: Mr. Savetskv reported that the fire chief had requested the MOU and it had been vetted through town counsel and Ms. Bell. Upon a motion made by Commissioner Stackpole and duly seconded by Commissioner Reinhard. it NN as unanimously VOTED to execute the MOU. G. TRANSFER BUSINESS: 1. March 2019 Transfers — Record Nos. 40500 through 40575: The Commission revie"N ed transfers for the period of March 1, 2019 through March 31, 2019. a. Current "M" Exemptions and Liens: The Commission authorized the placing of liens against the following properties as a result of the purchasers claiming the "M" exemption as first- time buyers of real property: No. 40529 Donna L. Johnson and Brian '\1. Johnson No. 40550 Andrew G. O'Shea No. 40555 Justin P. Geagan and Rosini '0. Geagan No. 40564 Zhaneta Avramova No. 40573 Keith Barry Ward Ms. Zola departed the meeting at 5:10 p. in. b. Two -Year Domicile Non -Compliance — Request for Extension i No. 37881 Rudy Valencia: Ms. Campese explained that Mr. Valencia had experienced some delays in the Land Bank Commission April 9, 2019 Page 4 delivery of his modular home but it was on the property and he expected to be living in the house with a certificate of occupancy by June. Upon a motion made by Commissioner Jelleme and duly seconded by Commissioner Stackpole, it was unanimously VOTED to grant an extension to October 19, 2019, in accordance with the recommendation of staff. H. FINANCIAL BUSINESS: 1. Monthly Transfer Statistics: Monthly transfer statistics reports comparing fiscal years 2018 and 2019 through March 2019 were presented. 2. Warrant Authorization — Cash Disbursements: Upon a motion made by Commissioner Reinhard and duly seconded by Commissioner Jelleme, it was unanimously VOTED to execute the April 9, 2019 warrant document in the amount of $204,234.26 to be provided to the county treasurer. Mr. Bushard departed the meeting at 5:15 p.m. II. EXECUTIVE SESSION: Upon a motion made by Copwissioner Stackpole and duly seconded by Commissioner Reinhard, it was unanimously VOT o go into executive session in order to discuss the purchase, exchange, lease or value of real p erty, discuss pending litigation and review and approve executive session minutes. A roll c vote was taken: Reinhard -Aye, Paterson -Aye, Stackpole- Aye, Jelleme-Aye. The Chairman under rpose 6 [G.L. c. 30A, 21(a)(6)] and Purpose 3 [G.L. c. 30A, 21(a)(3)] declared that discussion of th se matters in open session may be detrimental to the Land Bank's negotiating position and that the Commission would reconvene in regular session following executive session.
